Dr. Julian Lewis: To ask the Secretary of State for Foreign and Commonwealth Affairs what assessment he has made of the implications
for UK sanctions against Iraq of recent French commercial dealings with the Iraqi regime. [140144]
Mr. Hain: Sanctions against Iraq, imposed by the UN in response to its illegal invasion and occupation of Kuwait in 1990, will
remain in place until Iraq fulfils its obligations under UN Security Council resolutions. Under the UN "oil for food" programme, $16
billion will be available this year for food, medicine and infrastructure contracts. European (including French and UK) companies
are participating in this legal trade, which benefits the Iraqi people.

Maria Eagle: To ask the Secretary of State for Foreign and Commonwealth Affairs if he will make a statement on the lifting of the EU
arms embargo against Croatia. [139836]
Mr. Hain: European Foreign Ministers agreed at the General Affairs Council on 20 November that the EU arms embargo against Croatia
should be lifted with immediate effect.
This is in recognition of Croatia's continuing progress towards implementing her Dayton responsibilities. These include the removal
of discriminatory legislation against Croatian Serbs and assistance in war affected areas, the adoption of legislation encouraging
refugee return, the establishment of a transparent relationship with the HVO (Bosnian Croat army) in Bosnia and civilian oversight
of the Defence Ministry. Croatia joined Partnership for Peace in May 2000 and will soon begin negotiations with the EU on a
Stabilization and Association Agreement.
On 20 November, the Council of the EU adopted a new Common Position amending 96/184/CFSP so that Croatia is no longer subject to the
EU arms embargo against States of the Former Yugoslavia. Applications for licences to export defence equipment to Croatia will be
considered on a case by case basis against the consolidated EU Code of Conduct and national arms export licensing criteria.

Mr. Hain: While the number and value of oil for food contracts placed on hold by the UN Iraq Sanctions Committee changes daily, in
early November the value of contracts placed on hold was about $2.2 billion, of which $0.3 billion of contracts were on hold at UK
request. At the same time, Iraqi bureaucracy was reported to be holding back the delivery of $1.1 billion worth of goods already
approved by the Sanctions Committee. Where we place holds on contracts we do so mostly temporarily, because of concerns about the
goods possible use in Iraq's Weapons of Mass Destruction programmes or because of a lack of (often basic) information about goods
which might be of concern.
Since the oil for food programme began in December 1996, almost $16 billion worth of contracts have been approved, including $8.1
billion of food, $1.4 billion of health and $1.1 billion of oil spare parts. Through Security Council resolutions we have introduced
a fast-track system for contracts in key humanitarian and infrastructure sectors. To date more than $2 billion worth of goods have
been processed in this way.

Sir Sydney Chapman: To ask the Secretary of State for Foreign and Commonwealth Affairs what his estimate is of the value of
humanitarian goods the UN Sanctions Committee is currently holding back from delivery to Iraq. [137681]
Mr. Hain: The total revenue available under the Oil for Food programme since its inception in 1996 is over US$37 billion. This year
alone, Oil for Food revenue is expected to reach more than US$16 billion. The current value of Oil for Food contracts on hold
because of concerns over dual use is approximately US$2.3 billion. The UK accounts for about US$0.3 billion of this, which is less
than 1 per cent. of the total value of Oil for Food revenue. The UK, as a responsible member of the UN Iraq Sanctions Committee,
scrutinises contracts very carefully to ensure that goods are not supplied to Iraq in violation of Security Council resolutions.
Holds are normally lifted after assurances have been received about the end-use or in-country monitoring of these goods. It is
noteworthy that at the end of October Iraq's bureaucracy was holding back the delivery of US$1.1 billion worth of goods already
approved by the Sanctions Committee.

Mr. Alan Keen: To ask the Secretary of State for Foreign and Commonwealth Affairs what recent changes have been made to EU sanctions
in relation to the Federal Republic of Yugoslavia. [138419]
Mr. Vaz: Following the election of Vojislav Kostunica as President of the Federal Republic of Yugoslavia (FRY), European Union
Foreign Ministers agreed at the General Affairs Council on 9 October to revise EU sanctions against the FRY and to retain specific
targeted measures.
The EU oil embargo and flight ban were lifted with effect from 9 October.
On 10 November the Council of the EU adopted a Common Position to restrict financial sanctions and the visa ban to Milosevic and
persons associated with him.
The provisions on financial sanctions were implemented by an EC Regulation adopted on 10 November. This Regulation repeals EC
Regulations 1294/99 and 607/2000 as well as Article 2 of EC Regulation 926/98. The Regulation will come into force this week with
its publication of the Official Journal of the European Communities.
The new Regulation provides that all funds held in the EU belonging to individuals listed in the annex to the Regulation shall be
frozen and that no funds shall be made available, directly or indirectly, to or for the benefit of any person listed in the annex.
Under the new Regulation all EU financial sanctions in relation to FRY companies will be lifted. All EU restrictions on the
provision of export credit support finance and on investment in the FRY will also be lifted.
UK legislation providing penalties for breaches of the financial sanctions will be amended to take account of the new Regulation.
The individuals subject to financial sanctions are identical to those subject to the EU visa ban, which is the subject of a Council
Decision of 10 November.
The EU arms embargo and embargo on the supply to the FRY of equipment which might be used for internal repression or terrorism are
unaffected. The UN arms embargo against the FRY and prohibition on the arming and training for terrorist activities there remain in
force.

Mr. Hain: The UK Government does all it can to ensure that goods imported into Iraq under UNSCR 986 are used for agreed purposes.
Our experts scrutinise all contracts carefully to ensure that they fall within the terms of the relevant UN resolutions. We
frequently discuss monitoring of Oil for Food goods in Iraq with the office of Iraq programme and, where goods are of concern, ask
for specific in-country monitoring. Of particular concern are goods identified by UNMOVIC as of potential use in weapons of mass
destruction programmes. We continually call for the Iraqi regime to allow UNMOVIC into Iraq to verify Iraq's compliance with its
obligation to halt its weapons of mass destruction programme.

Mr. Vaz: No "outer wall" of sanctions is operated by the United Kingdom or by the European Union. In common with all countries, the
FRY will need to show its commitment to the obligations which flow from the membership of international organisations, including
major financial institutions, and to those organisations' values.

being revised to ensure that only those measures aimed directly at Milosevic and those persons directly associated with him remain
in place: this process should be complete by the end of November.
The UN arms embargo and ban on arming and training for terrorist activities there, imposed by UNSCR 1160 (1998), will remain in
place.

Mr. Denzil Davies: To ask the Minister of Agriculture, Fisheries and Food when legal proceedings brought by the EU against France
for prohibiting the importation of British beef will be heard by the European Court of Justice. [136196]
Ms Quin: The timing of the various stages in the European Commission's case against the French Government is determined by the
European Court of Justice. The case is now entering the final phase of the written procedure and once that is concluded the Court
will fix a Hearing date. It is possible, but not certain, that the Hearing could take place by Spring 2001. However, if the French
Government, the Commission and the Court all agreed that a Hearing was not necessary, the oral procedure could be dispensed with
altogether leaving the Court to begin its deliberations in advance of the Advocate General's Opinion and the Court's Judgment.
