Mr. Harvey: To ask the Secretary of State for Health what precautions against vCJD are taken in surgical procedures other than tonsillectomies; what organs are known to incubate vCJD; and if he will make a statement. [150433] Yvette Cooper: On 4 January 2001 the Department announced a precautionary strategy for reducing the theoretical risk of transmission of variant Creutzfeldt- Jakob disease (vCJD) from patient to patient via surgical instruments. The strategy focuses first and foremost on ensuring high standards of decontamination. This has been identified by the Spongiform Encephalopathy Advisory Committee (SEAC) to be a key step in reducing risk. In October 2000, the Department required all National Health Service trusts and health authorities to conduct comprehensive reviews of their decontamination services. As part of this work, decontamination facilities at neurology and posterior ophthalmology centres have recently been inspected and any necessary improvements identified. A comprehensive strategy to modernise NHS decontamination facilities, backed by £200 million funding announced on 4 January and based on the trust reviews, is currently being prepared. This strategy will be published once it is complete. The "Risk Assessment for the transmission of vCJD via surgical instruments" published by the Department on 16 March (available from the Department's website at www.doh.gov.uk/cjd/riskassessmentsi/htm confirms that the risks of transmission are significantly reduced if instrument decontamination is carried out to the highest standards. On body organs, the risk assessment also shows that the central nervous system and the back of the eye would carry the highest potential infectivity, whereas lymphatic tissue such as tonsils, and front of the eye tissue are of a lesser order of risk. When the Department's strategy was presented SEAC at its meeting in November 2000, the committee welcomed it and the advances being made on decontamination. The committee also endorsed the concept of using tonsillectomy as a pilot scheme to see how single-use instruments would work in practice.

Ms Rosie Winterton: To ask the Secretary of State for Health if he will make a statement about clusters of cases of Variant Creutzfeldt Jakob disease. [155227] Yvette Cooper: Ninety-seven `definite' and `probable' cases of variant Creutzfeldt Jakob Disease (vCJD) have been identified to date. A number of geographically associated case groupings is under investigation, but only one such grouping has so far been identified by the Spongiform Encephalopathy Advisory Committee (SEAC) in July 2000 as being unlikely to have occurred by chance. That grouping of cases occurred in an area in Leicestershire near Queniborough. A subsequent investigation by Leicestershire health authority into these cases has been undertaken and the results are being announced in a report published today. A copy is being placed in the Library. The main conclusion from the investigation is that there is a strong association between these cases and cross-contamination of carcase meat with cattle brain material which occurred at a number of local butchers' premises during the 1980s. Controls on specified risk material (SRM) have, since 1989, required brains of cattle over six months old to be removed and disposed of under controlled conditions. It has been illegal since then for them to be used for human consumption. And, since 1996, it has been a legal requirement for the whole head of cattle over six months old to be disposed of in the slaughterhouse as SRM under the supervision of the Meat Hygiene Service. Scientific advisers and health experts, including SEAC, will be looking very carefully at the results of the study, to assess the implications for our wider understanding of vCJD.

Mr. Yeo: To ask the Secretary of State for Health what advice he has sought on the statistical risks involved in eating (a) French beef products and (b) beef-on-the- bone in the period leading up to the ban on beef-on- the-bone. [146402] Ms Stuart: [holding answer 22 January 2001]: Responsibility for the provision of advice on food safety matters rests with the Food Standards Agency (FSA). The FSA commissioned Dr. Christl Donnelly to research the risks associated with French beef and her paper was published in Nature on 14 December 2000, as was a letter from the FSA Chairman Sir John Krebs. Dr. Donnelly estimated that the risk from imported French beef from cattle aged no more than 30 months old at slaughter is essentially zero (no cattle within 12 months of developing clinical BSE). If the Over-30-Month-Rule is not fully enforced, the risk rises in proportion to the frequency of the breach. Dr. Donnelly estimated that if compliance with the Rule is 75 per cent., which Sir John Krebs considered to be reasonable on the basis of informal indications to the FSA from local authorities, the risk from French imports would be of the same order of magnitude as the current estimate for Britain's domestic beef. The FSA estimated that comparable if not greater risks to United Kingdom consumers could arise from imported meat products that contain French beef. The risk that applied in the period leading up to the UK's ban on beef-on-the-bone was estimated by the Spongiform Encephalopathy Advisory Committee (SEAC) at its 2 December 1997 meeting. At that meeting, SEAC considered the experimental finding in BSE infected cattle that dorsal root ganglia (DRG) became infective in the pre-clinical phase of the disease and that in one experiment bone marrow appeared to be infective. SEAC reviewed a risk assessment which estimated that 24 per cent. of the total infected DRG were attributable to bone-in beef. The remaining DRG related to infectivity arises from the ganglia that cannot be removed from cuts of joints of meat in the normal boning out process. The Committee estimated the risk to people from DRG in food to be "very small", and commented that "there was a 95 per cent. chance of no case of nvCJD arising as a result of this exposure and a 5 per cent. chance of one case arising". However, the Committee also noted that given the major uncertainties about many aspects of the transmission of the disease in cattle to humans the actual figure could be anywhere between 0 and 10 nvCJD cases being induced by eating infected DRG. The risk from UK beef has declined since 1997. In July 1999 the Chief Medical Officer assessed the additional risk of lifting the UK's bone-in beef ban as "tiny and unquantifiable in any meaningful way".
