Mrs. Lawrence: To ask the Secretary of State for the Environment, Transport and the Regions on what date, and by whom, licences were issued for the (a) growing and (b) marketing of Chardon-LL or T25 maize. [159994] Mr. Meacher: [holding answer 2 May 2001]: T25 is the name of a type of genetically modified (GM) maize developed by Aventis. The modification, transformation event 25 (T25) confers resistance to a particular herbicide, in this particular case, Glufosinate Ammonium. Chardon LL is a variety of T25 maize. Directive 90-220, on the deliberate release of Genetically Modified Organisms (GMOs), recognises two types of release. First, those for research purposes (known as Part B releases) and, second, those for marketing (known as Part C releases). Applications for Part B releases are assessed on an individual basis at Member State level and approved by the competent authorities in that state. Applications for approval of GMOs for marketing (Part C approvals) are made initially to one of the 15 Member States. The competent authority in this Member State reviews the application and forms an opinion. If favourable, the opinion and application dossier (which includes the risk assessment for the GMO) are passed to the European Commission and the 14 other Member States. Each Member State then examines the application in detail. If there are no objections to the favourable opinion, formal Part C approval is granted by the Member State in which the application was first made, on behalf of the whole European Union (EU). Once granted the Part C consent is valid across the EU. The French competent authority received the initial application for Part C approval of T25 maize in 1995, which was for both commercial cultivation and for importation. Following consideration by other Member States, the French granted formal approval for T25 maize on 3 August 1998. A number of Member States have also given approval to the cultivation of T25 maize for research (Part B releases). The Statement of the French Competent Authority for T25 maize shows that various Part B approvals were given by the French, Italian, German and United Kingdom competent authorities between 1992 and 1997. I have placed a copy of the statement in the library of the house. This contains the exact details of each release. Any crop, irrespective of it being GM or not, also requires approval under the National Seed Listing legislation. Varieties may not be marketed until they have been added to the UK National List or EU Common Catalogue. A proposal to add Chardon LL to the UK National List was published in March 2000. A number of affected persons made written representations or asked to make oral representations. A Hearing began on 2 October and was adjourned on 15 November until further notice pending resolution of concerns about the system used in France. Meanwhile, I understand that MAFF has sought the views of the European Commission on the legal status of the French authority's testing procedures. Chardon LL will only be added to the UK National List if all the legal requirements have been met in full.

Mr. Paul Marsden: To ask the Secretary of State for the Environment, Transport and the Regions if he will list the GM maize plantings in Shropshire by Ordnance Survey grid reference; and if he will make a statement. [155968] Mr. Meacher: EU Directive 90/220, on the deliberate release of genetically modified organisms (GMOs) to the environment, recognises two types of release. The first, known as Part B releases, are carried out for research purposes and must be notified to the Government. Their location must be advertised locally and made publicly available through the register of releases held by my Department. The second type of release, known as a Part C release, is for commercial purposes. Such releases do not have to be notified to the Government, as the crops have undergone detailed safety assessments at European level and been approved for commercial use. However, where such releases are carried out as part of the farm scale evaluations or as part of the National Seed List trials then their location is notified to Government and made publicly available. The public register of releases shows that no GM maize is presently being grown in Shropshire under Part B consents. I also understand that no National List trials of GM maize are presently taking place in Shropshire and that no GM maize is presently under cultivation as part of the farm scale evaluations. However, the locations of the next round of GM maize sites for the evaluations will be announced shortly by my Department. The sites are likely to be sown from the end of April. Details of their locations, including Ordnance Survey grid references, will be placed on our website at www.detr.gov.uk. We will also write to parish councils in whose area an evaluation is to be sited to provide information about the release.

Mr. Yeo: To ask the Minister of Agriculture, Fisheries and Food (1) if the voluntary agreement with the GM industry on the conduct of crop trials in the United Kingdom (a) covers trials licensed under a Part C consent and (b) allows the harvesting and storage of GM seed from trial sites before the completion of the crop trials; [144371] (2) if fertile seed is being harvested from GM trial sites in the United Kingdom and stored. [144367] Mr. Meacher: [holding answer 8 January 2001]: I have been asked to reply. The Government and the industry body SCIMAC made a voluntary agreement in November 1999 on the conduct of the farm scale evaluations of certain GM crops. The agreement covers all GM crops including those with Part C consent under European directive 90/220. At present one of the crops involved in the evaluations, herbicide tolerant maize, has a Part C consent. The Part B consents permitting the oil seed rape, fodder beet and sugar beet to be grown in the farm scale evaluations require the crops to be destroyed on harvest. The maize in the evaluations, which has a Part C consent, is a forage variety which would be harvested for silage not seeds. The terms of the approval for herbicide use on the maize does not permit it to enter the food or feed chain and the crop is destroyed on harvest. The agreement does not permit any other field scale plantings of these crops without the approval of the Scientific Steering Committee who will take account of the relevance of the proposals to biodiversity. A number of Part B consents for small scale plantings of other GM crops are currently in force. Each specifies the fate of the crop at the end of the trial and some permit the saving of seed for further research or testing.

Member for Stretford and Urmston (Ms Hughes), in a Department of the Environment, Transport and the Regions press release of 23 August 2000. [151539] Mr. Meacher: [holding answer 1 March 2001]: The News Release of 23 August 2000 set out the arrangements for the farm-scale evaluations of autumn oilseed rape. It recognised that the review of separation distances for GM crops published by MAFF earlier that month had highlighted that increased separation distances might be required for certain types of oilseed rape. As an interim measure the News Release announced a 100 m separation distances for varietal association oilseed rape pending full consideration of the NIAB report. If as a result the separation distances turned out to be greater than 100 m, consideration would be given to other risk reduction measures such as removal of flower heads from the rape plants to prevent pollen dispersal. MAFF announced the outcome of their review and the distances to be applied to future rounds of the farm-scale evaluations on 6 February 2001, Official Report, column 492W. As a result, the Government have asked the agriculture and farming industry body SCIMAC to incorporate two changes into their revised code of practice on GM crops. The first is to continue to apply the 100 m separation distance used at the autumn sown sites where varietal association oilseed rape was nearby and mentioned in the 23 August press release. The second is an increased distance of 80 m for maize crops. This is intended to ensure that contamination of neighbouring crops does not exceed 1 per cent. The MAFF announcement means that it is not necessary to remove the flower heads from the GM oilseed rape fields presently growing or planned for this spring where they are near conventional crops of varietal association oilseed rape. There are no maize or beet sites presently being grown. The new separation distance for maize crops will be implemented at all of the spring 2001 sites, when they are sown later in the year.
