Dr. Whitehead: To ask the Secretary of State for Environment, Food and Rural Affairs at what point in the processing cycle her Department ceases to define compost as waste. [197852] Mr. Morley: The definition of waste in force in the United Kingdom is the definition in Article 1(a) of the Waste Framework Directive (as amended). Whether or not a substance is discarded as waste, and when waste ceases to be waste, are matters which must be determined on the facts of the case and the interpretation of the law is a matter for the Courts. The European Court of Justice (ECJ) has issued several judgments on the definition of waste which are binding on member states and their "competent authorities". The ECJ has ruled that " . . . whether [a substance] is..waste..must be determined in the light of all the circumstances, regard being had to the aim of the Directive and the need to ensure that its effectiveness is not undermined." In practice, this means that waste does not cease to be waste until it has been fully recovered within the meaning of the Directive and there is certainty of its use as a product without undergoing a further recovery operation. The Environment Agency considers that (a) source-segregated waste which, after composting, meets a recognised and suitable quality standard (e.g. BSI PAS 100) is likely to meet the first criterion; and (b) mixed waste which is composted is likely to remain waste until it is used in a further recovery operation (e.g. land treatment resulting in agricultural benefit or ecological improvement) subject to control by the Agency under a licence or registered licensing exemption.

Mr. Hancock: To ask the Secretary of State for Environment, Food and Rural Affairs what the latest figures are for the amount of compostable material disposed of each year in England; how much is reclaimed and recycled as compost; and what plans she has to increase this figure. [187547] Mr. Morley: The Municipal Waste Management Survey of local authorities in England for 2002-03, shows that 14.28m tonnes of biodegradable municipal waste was disposed of to landfill, and 1.2m tonnes composted. In addition 1.1m tonnes of paper and card were recycled. As yet there is no method of measuring the amount recycled through home composting. From the Environment Agency's National Waste Production Survey of a sample of 40,000 businesses, conducted in 1998, it is estimated that 2.78m tonnes of biodegradable industrial and commercial waste was disposed of to landfill, 0.85m tonnes composted and a further 4.75m tonnes of paper and card recycled. The Government are taking a number of steps to increase the amount of biowaste composted. For example, we have established the Waste Implementation Programme (WIP), to support local authorities in achieving the UK's Landfill Directive targets to divert biodegradable municipal waste from landfill. The Government has also established the Waste and Resources Action Programme (WRAP) to create stable and efficient markets for recyclates, including organic material. WRAP is also running a home composting programme and has already organised distribution of over 60,000 composting bins to households in England. In addition Defra, through the Environmental Action Composting Association with 282,000 over three years to raise awareness of composting. These and other measures have seen the proportion of municipal biowaste composted rise to 32 per cent. of all municipal waste recycling in England in 2002-03.

Norman Baker: To ask the Secretary of State for Environment, Food and Rural Affairs if she will make a statement on the steps she is taking to promote composting. [142343] Mr. Morley: Defra has set up the Waste Implementation Programme (WIP) to help local authorities meet their targets for reducing the landfilling of biodegradable municipal waste under the Landfill Directive. One of WIP's programmes being taken forward by the Waste and Resources Action Programme (WRAP) is to promote kerbside recycling and composting best practice in local authorities. This sub-programme has two components: 1. A Recycling and Organics Technical Advisory Team (ROTATE) which will provide technical advice to local authorities needing to implement and improve kerbside recycling, with an emphasis on organics collections systems. This is supported by £14.9 million over the next three years. 2. An Organics Materials Programme which provides material- specific support and investment to the growing composting sector. It aims to develop markets in compost, with headline targets of increasing the market share of compost in the landscaping and horticultural markets by 35 per cent. and 30 per cent. respectively, by end 2006. This is supported by £12.2 million over the next three years. These targets will be achieved through a range of activities including: development of compost standards; business development initiative for emerging compost companies; marketing and product development targeted at the landscaping and horticultural sectors. Defra also provides £272,000 over three years to the Composting Association to raise awareness and increase the understanding of composting and uses of compost. In addition, Defra's Waste Minimisation and Recycling Fund has supported composting schemes run by local authorities. In 2003-04, 21 green waste-only kerbside schemes and five composting site developments received funding.
