Kate Hoey: To ask the Secretary of State for Culture, Media and Sport (1) whether a regulatory impact assessment was carried out on the voluntary sports clubs sector in respect of increased charges arising from the Licensing Act 2003; [198052] (2) whether a regulatory impact assessment was carried out on the voluntary sports clubs sector in respect of the increased charges from the Licensing Act 2003. [198310] Mr. Caborn: Yes. Our estimates of fee levels were first publicised in the White Paper "Time for Reform: Proposals for the Modernisation of Our Licensing Laws" (CM 4696) on 10 April 2000, which included a regulatory impact assessment. A regulatory impact assessment, which also included estimates relating to fee levels, was also presented to Parliament with the Licensing Bill in November 2002, and was revised when the Bill entered the House of Commons in March 2003. In September 2004 a draft regulatory impact assessment was published with a consultation document on regulations to be made under the Licensing Act 2003. All of these documents are available in the Library of the House. For the purpose of the regulatory impact assessments, sports clubs are treated as members' clubs holding registration certificates under the Licensing Act 1964 and which expect to hold club premises certificates under the 2003 Act. Such clubs include as well as sports clubs, political clubs, working men's clubs, ex-services clubs, social clubs and others. There are approximately 20,000 such clubs. A further regulatory impact assessment will be presented with regulations relating to fee levels when they are made following the public consultation which began on 4 November. The consultation document enables any individual club to calculate precisely the fees it could expect to pay, under the proposals in the document, in respect of applications made for the grant and variation of a club premises certificate under the 2003 Act.

Mr. Reed: To ask the Secretary of State for Culture, Media and Sport what assessment she has made of the likely impact on community and amateur sports clubs of the licensing charges announced on 4 November; and if she will make a statement. [197449] Mr. Caborn: The fee levels to be set by the Secretary of State under the terms of the Licensing Act 2003 have not been finalised. On 4 November, we announced the publication of a consultation on fee levels. We welcome the views of sports clubs as part of that public consultation, which ends on 23 December. All responses will be carefully considered before the fees are finalised. The proposal is that fees for grant of a club premises certificate will range between £80 and £500 and annual charges between £40 and £225. These fee levels have been proposed to ensure that licensing authorities are able to recover fully their costs of administration, inspection and enforcement under the terms of the Act and no more. In proposing fee levels and the allocation of premises to a band based on its non-domestic rateable value we have considered the impact of the approach on clubs, including community and amateur sports clubs. We do not therefore consider that the impact on such clubs would be significant. The Licensing Review that preceded the White Paper on licensing reform showed that alcohol licensing fees have been set too low for many years, and it would be wholly wrong for central or local taxation to continue to subsidise the consumption of alcohol. Consequently, we do not believe that the best way to promote sport is through Government subsidy of sports club bars. The Government's commitment to amateur sport is illustrated by the introduction in 2002 of a scheme which gives registered Community Amateur Sports Clubs mandatory rate relief at 80 per cent. and tax relief through Gift Aid on donations from individuals. So far the scheme has given amateur sports clubs an extra £5 million. This is in addition to the £60 million we have put into the Community Club Development Programme.

Mr. Moss: To ask the Secretary of State for Culture, Media and Sport if she will use her powers under the Licensing Act 2003 to include sporting events shown on large screens in bars, public houses and other licensed premises within the definition of regulated entertainment under Schedule 1 of the Act. [180370] Mr. Caborn: We have no current plans to use the powers in the Licensing Act 2003 to license the showing of live broadcast sporting events on large screens in licensed premises. Under the 2003 Act, all public houses and bars showing live sporting events on television will require premises licences because they sell alcohol and, as a result, will be required to take steps to ensure the promotion of the licensing objectives in relation to the premises. These objectives are the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm. If they fail to do so, they could face a review of the licence. Furthermore, it will be an offence under the 2003 Act to allow disorderly conduct on the premises and knowingly to sell, attempt to sell, or to allow alcohol to be sold to people who are already drunk. Finally, the police have powers (in certain circumstances) under the 2003 Act to close down instantly for up to 24 hours any relevant premises where a senior officer believes there is, or is likely to be, disorder on or in the vicinity of the premises, or alternatively where a public nuisance is being caused as a result of noise emanating from the premises.

Mr. Andrew Turner: To ask the Secretary of State for Culture, Media and Sport if she will list for each licensing authority in England (a) the cost of and (b) the expenditure on liquor and entertainment licensing in the last 12 months for which figures are available; and for each prospective licensing authority and for England what estimate she has made of the annual (i) cost of and (ii) income from liquor and entertainment licensing after implementation of the Licensing Act 2003. [159876] Mr. Caborn: No figures are kept centrally for the annual cost of, and the annual expenditure on, liquor and entertainment licensing by local authority area. Local authorities have no current responsibility for liquor licensing and fee income goes to the courts. The new arrangements under the Licensing Act 2003 will integrate six existing licensing regimes: liquor, public entertainment, theatre, cinema, late night refreshment and night cafe licensing. We estimate that the income from all these regimes collectively is about £36.8 million annually for England and Wales, if renewal fee income is spread across the period of the renewal (which varies). We estimate that the actual cost of the six regimes to the courts and local authorities involved is approximately £69.3 million annually. Estimates of future expenditure under the new arrangements set out in the Licensing Act 2003 are currently being considered. No final decisions have yet been taken about fee levels and these will affect total income. Fee levels will be set so as to permit full recovery of the costs of administration, inspection and enforcement associated with the licensing regime.
