Mr. Lidington: To ask the Secretary of State for Environment, Food and Rural Affairs what assessment she has made of the impact upon (a) egg producers, (b) small markets and (c) consumers of her proposed requirement for ungraded eggs to be marked. [184197] Alun Michael: Defra has received over 3,000 inquiries from small-scale egg producers on the Registration of Laying Flocks Order and the Egg Marketing Regulations. All producers must register with departments in order to obtain an identifying code. Currently small producers with less than 350 birds are exempt from this requirement, provided that the eggs are ungraded and sold direct to the final consumer. Because of enforcement difficulties in other member states, it was agreed in November 2003 that part of the derogation from marking for ungraded eggs be removed. From 1 July 2005 farmers selling eggs from their own farms at local public markets will no longer be exempt from the requirement to mark their eggs, irrespective of the number of laying hens kept A Partial Regulatory Impact Assessment was prepared on this in November 2003. The cost for small producers to purchase the necessary equipment is low. A hand stamp can be bought for around £30. The time required to register as a producer and then to stamp eggs is unlikely to be significant. The majority of small producers appear to be satisfied that the costs are reasonable and can be borne comfortably. Some producers with fewer than 350 laying hens will therefore have to register for the first time, in order to obtain a distinguishing number. This measure had the support of the majority of other member states. Sales in farm shops and door-to-door do however remain exempt.

Mr. Colman: To ask the Secretary of State for Trade and Industry what work has been undertaken with Ofgem in the past year to ensure administrative arrangements under the New Electricity Trading Arrangements are fully accessible to smaller generators as highlighted on the Sustainable Energy Policy Network website; and what assessment she has made of how effective these measures have been. [182009] Mr. Timms: Both the DTI and Ofgem have been involved in a number of initiatives aimed at improving the position of smaller generators. With regard to the Balancing and Settlement Code, Ofgem has considered and approved a number of modifications. For example, a revision of the definition of the System Buy and Sell Prices has significantly reduced the spread of imbalance prices and thus the risk to which smaller generators in particular are exposed. Modifications have also been made to National Grid Transco's charging methodology, which now allows "embedded benefits" to be paid directly to generators in certain circumstances, which again will particularly benefit smaller generators. In this area, it is primarily the role of the Balancing and Settlement Code Panel to assess the impact of measures, and for industry participants to bring forward modifications to the code if they are considered unsatisfactory. In the context of the future British Electricity Trading and Transmission Arrangements, the DTI and Ofgem have recognised the special position of smaller generators through the provision of a discount for small transmission-connected generators in Scotland. More generally, the Distribution Commercial Forum, which is facilitated by Ofgem, is responsible for assisting industry participants in improving the governance framework of the existing distribution connection and use of system arrangements. The Distribution Generation Working Group--jointly chaired by Ofgem and DTI--is looking at ways in which the barriers to the connection of smaller-scale generation can be removed, and their contribution to the system in terms of losses, contribution to security and other embedded benefits can be fully recognised. Both of these forums therefore play assessment roles vis-a¬-vis the position of smaller generators.

Miss Kirkbride: To ask the Secretary of State for Culture, Media and Sport how many premises have a licence to serve alcohol all night, broken down by local authority. [178410] Mr. Caborn: Alcohol licences are granted by licensing justices and, where available, statistics are broken down by petty sessions areas and not by local authority areas. Generally, no justices' licences permit the sale or consumption of alcohol all night. This is the effect of section 60 of the Licensing Act 1964 which details the permitted hours for the sale and supply of alcohol from licensed premises. There are however four exceptions. Firstly, all on-licensed premises are able to sell alcohol all night on each New Year's Eve unless the premises are subject to a restriction order. Secondly, the 1964 Act does not prohibit or restrict the sale or supply of alcohol to, or its consumption by, any person in any licensed premises where he is residing, or the supply for consumption by any private friends of such a person who are being entertained by that person at his own expense. Thirdly, the 1964 Act does not prohibit or restrict the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of a justices' licence if the alcohol is supplied at the expense of their employer or the person carrying on or in charge of the business on the premises. Fourthly, under section 74 of the 1964 Act, justices of the peace on application from premises situated in the immediate neighbourhood of a public market or place where people follow a lawful trade or calling, may grant an order adding, either generally or for such days as may be specified in the order such hours as may be so specified, to the permitted hours in those premises. These are commonly called "general orders of exemption". There are no centrally held statistics on the numbers or dispersal of general orders of exemption. However, the number permitting the sale or supply of alcohol all night in connection with a public market (for example, Smithfields Meat Market in London) is believed to be very small.
