Mr. Key: To ask the Secretary of State for Environment, Food and Rural Affairs what (a) flood warning and (b) post-flood management systems are in place in the Wiltshire section of the Hampshire Avon catchment; and if she will make a statement. [196021] Mr. Morley: The Government are committed to ensuring a seamless, integrated and continuous service of flood forecasting, warning and response delivered by the Environment Agency. Defra has recently approved the Agency's new £226 million flood warning strategy. For Wiltshire, the Agency's regional flood forecasting and monitoring team in Exeter works with the Meteorological Office to provide the Flood Warning team at Blandford with information on weather conditions. The Blandford team considers this against the condition of the catchment and monitored river levels. When river trigger levels are exceeded, warnings are sent from Agency area office to the media, civil authorities, emergency services and those at risk of flooding who have chosen to be on the Agency's Automated Voice Messaging (AVM) system. The Agency has also written to those identified from flood maps as being at risk of flooding. Both the maps and those on the AVM are reviewed regularly taking account of any new information. Due to the characteristics of the chalk geology in the Salisbury catchment, groundwater can be a source of flooding and the Agency aims to provide an accessible, self-help groundwater flood warning service to all of the affected local parishes. The Agency has a comprehensive post-flood management system which reviews their response to events, the impact and sources of flooding. The Agency addresses issues within its responsibility and provides review information to all responsible organisations as a starting point for future work. Solutions, such as improvements to flood warning, enforcement, development control, maintenance of main rivers, improvement works and possible new defences, are prioritised within the Agency's work programmes.

Mr. Allan: To ask the Solicitor-General what action she intends to take following the decision not to proceed with the case against Mr. Robert Duqueria for the alleged removal of objects from the scheduled site of Cunetio in Wiltshire; and if she will issue new guidance on prosecutions for such removals to the Crown Prosecution Service. [172211] The Solicitor-General: I have already received and considered a detailed report from CPS Wiltshire concerning the case against Mr. Robert Duqueria who was charged with removing 25 Roman coins and three artefacts from a protected site following a police investigation including obtaining expert evidence. The CPS subsequently received a defence expert report which cast reasonable doubt on the evidence that the coins came from a protected site as opposed to a nearby site where permission may have been granted in any event. Prosecutions of this nature are relatively rare and may well demand appropriate expert evidence depending on the facts of the individual case. In this case all possible avenues were pursued and the case was correctly reviewed in accordance with the Code for Crown Prosecutors. I am, therefore, satisfied that there is no need to take any further action in this case. In addition, there is no basis for concluding that the outcome of this particular case would have been affected by the availability of further guidance for prosecutions for such removals. The issues were clear and the case was dealt with correctly. Nevertheless, in view of its importance, I have asked the CPS to consider developing guidance on the subject as part of its electronic Legal Guidance.

[149395] Mr. Raynsford: The Government have no plans at present to regionalise the Fire and Rescue service in the constituencies of the hon. Members. Their local Fire and Rescue Authorities will continue to be responsible for the service. The White Paper "Our Fire and Rescue Service" (Cm 5808) made clear that where voters choose to have an Elected Regional Assembly there will be a Regional Fire and Rescue Service, but no referendum is currently planned for any region other than the North East, the North West and Yorkshire and Humberside. All local Fire and Rescue Authorities are, however, expected to establish, by 1 April 2004, Regional Management Boards to deliver the functions which are most efficiently and effectively performed at a regional level. I hope these voluntary arrangements will succeed. There are, however, provisions in the Fire and Rescue Services Bill currently before the House to strengthen and streamline the power that already exists, in section 6 of the Fire Services Act 1947, to combine Fire and Rescue Authorities following consultation with the existing authorities and other persons affected.
