Mr. John Taylor: To ask the Chancellor of the Exchequer (1) if he will instruct the Economic Secretary to the Treasury to provide substantive answers to Questions concerning decennial censuses after consulting the Registrar General; [224047] (2) whether Treasury Ministers have used their powers under section 2(1) of the Census Act 1920 to control and direct the Registrar General since 1990; [224048] (3) whether the necessary permission to retain the (a) 1981 and (b) 1991 census records for England and Wales in the Office for National Statistics once they are over 30-years-old has already been granted by the Lord Chancellor. [224049] Mr. Timms: I am the Minister responsible for the population census. Day-to-day responsibility rests with the Registrar General, who is also the National Statistician. All Parliamentary questions to the Chancellor of the Exchequer are answered substantively. It has been the practice of successive Administrations for many years to delegate questions concerning the census to the Registrar General for answer by letter. All such letter answers are printed in the Official Report. The Registrar General undertakes his functions under section 2(1) of the Census Act 1920 and of any Census Order or Regulations made under the 1920 Act. His powers to carry out the census are subject to the control of, and in compliance with, any Ministerial direction by virtue of Section 2(2) of the 1920 Act. The Registrar General has regular meetings with the relevant Minister to discuss census-related issues. The Government's proposals for the 2001 Census were published in a White Paper ("The 2001 Census of Population", Cm 4253) in March 1999. Parliamentary authority for the 2001 Census was subsequently given by virtue of the Census Order 2000 (SI 2000/744), the Census Regulations 2000 (SI 2000/ 1473), the Census (Amendment) Order 2000 (SI 2000/ 3249), and the Census (Amendment) Regulations 2000 (SI 2000/3351). I understand that no application has yet been made by the Registrar General to the Lord Chancellor, under the provisions of section 3(4) of the Public Records Act 1958, for him to retain the records from the 1981 or 1991 Censuses once they are over 30-years-old.

Letter from Len Cook to Mr. John Taylor, dated 14 March 2005: As National Statistician and Registrar General for England and Wales I have been asked to reply to your recent Parliamentary Question asking what action was taken by Ministers to establish that the Registrar General had statutory authority to state that personal information from the 1981 and 1991 decennial population censuses for England and Wales would be retained for 100 years before being released. (221179) A Registrar General is empowered to conduct a census under the provisions of the Census Act 1920 as amended by the Census (Confidentiality) Act 1991. The protection of personal information is covered by Section 8(2), which makes provisions with respect to unlawful disclosure of information. Censuses from 1921 onwards have been taken under this Act and, as records which are retained in my custody, remain covered by these provisions. The necessary permission to retain these census records once they are over 30 years old has been granted by the Lord Chancellor under the provisions of Section 3(4) of the Public Records Act 1958, and has continued to be granted at periodic intervals. Particularly at the time of a census there is great public concern about confidentiality and the use to which personal census information is put, and it has been the practice to give strong declarations of strict confidentiality including on the front of the census form, to allay these concerns. At the time of the 1981 and the 1991 Censuses, there was legislation in force that closed Census records for a period of 100 years. This legislation was Instrument 12 dated 1966 made under the provision of Section 5(1) of the Public Records Act 1958. The declarations however, did not specifically make reference to this legislation. In an attempt to simplify the confidentiality message on the front of the 1981 and the 1991 Census forms, the assurances, as worded, stated that the Registrar General had authority himself to retain the records for 100 years. This pledge asserts authority that the Registrar General does not have. As explained above the authority for the Registrar General to retain Census records rests with the Lord Chancellor. Notwithstanding this, the legal basis of access to, and confidentiality of, Census records was not affected. Assurances given on the 2001 Census form, however, more accurately referred to the relevant statutory authority as existed at the time.

Letter from Len Cook to Mr. John Taylor, dated 9 March 2005: As National Statistician and Registrar General for England and Wales I have been asked to reply to your recent questions asking (i) what the statutory penalties are for refusing to complete a decennial population census form for England and Wales; and how many successful prosecutions there were for that offence in connection with the censuses for (a) 1981, (b) 1991 and (c) 2001 and (ii) what the statutory penalties are for unlawfully disclosing personal information from closed decennial population censuses for England and Wales, and how many successful prosecutions there have been for that offence since 1990. (220592, 220593) The penalty for failing to complete a census form is prescribed by Section 8(1) of the Census Act 1920 which states that on summary conviction a person shall be liable for a fine not exceeding level 3 on the standard scale. The maximum fine of level 3 on the standard scale under the Criminal Justice Act 1982 was £1,000 at the time of the 2001 Census. The numbers of successful prosecutions for failing to complete a census form in England and Wales were 692 in 1981, 342 in 1991 and 38 in 2001. The statutory penalty for unlawfully disclosing personal census information is prescribed by Section 8 (5) of the Census Act 1920 as amended by the Census (Confidentiality) Act 1991 which states that (a) on summary conviction a person shall be liable to imprisonment for a term not exceeding six months or to a fine not exceeding the statutory maximum or to both; (b) on conviction on indictment, to imprisonment for a term not exceeding two years or to a fine or to both. Since 1990 there has been one prosecution for unlawful disclosure of personal census information.

Mr. David Atkinson: To ask the Deputy Prime Minister if he will list those local authorities for whom the revenue budget settlement for 2005-06 has been based on 1991 Census data; and if he will make a statement. [218373] Mr. Raynsford: The main indicators used in the Formula Spending Share formulae are the population estimates. The population estimates from mid-2001 onwards have been based on the 2001 Census. They are then adjusted for births, deaths and both internal and external migration. The population estimates used in the Local Government Finance Settlements from 2003-04 onwards have been based on the 2001 Census. The formulae also use other socio-demographic indicators derived from the Census, for example population sparsity and population density. 1991 Census data is used for these other indicators in the 2005-06 Formula Spending Share formulae for Education, Personal Social Services, Police, Highway Maintenance and Environmental, Protective and Cultural Services. This Census data is not used in either the Fire or the Capital Financing Formula Spending Share formulae, and is therefore not used in the calculation of RSG for single service fire authorities only, i.e. LFEPA, metropolitan fire authorities and combined shire fire authorities. I announced on 21 July 2004 that we would not be amending the other socio-demographic indicators to incorporate 2001 Census data in the 2005-06 settlement (21 July 2004, Official Report, column 30WS). This is because it would have been technically incorrect to have simply introduced the data without first amending the statistical models underlying the Formula Spending Share formulae. Changing the formulae in this way would have broken the formula freeze that we have introduced to provide funding stability for authorities. Further research is being undertaken on the formula changes needed to incorporate the 2001 Census data into the Formula Spending Share formulae. The Office of the Deputy Prime Minister will be consulting local authorities during the summer of 2005 on the formulae for the 2006-07 settlement.
