Mr. Hume: To ask the Secretary of State for Northern Ireland what part was played by the Department in the processing of train carriages containing asbestos in the Crosshill Quarry Site between November 2003 and June 2004; what method of processing was used; on what dates; and whether the Department has assessed the extent to which statutory obligations were adhered to by the asbestos processing company. [219540] Angela Smith: The Department of the Environment played no part in the repositioning of the carriages at Crosshill. I understand that this work commenced before 19 December 2003 when the regulatory powers for waste management transferred from district councils to the Department's Environment and Heritage Service (EHS). I understand that the original method of moving the carriages was modified as they were too heavy to be removed in one piece. The carriages were removed by cutting them into three sections using large mechanical shears. The work was undertaken by an operator trained in asbestos removal, who did not observe any asbestos when the work was being carried out. The site was inspected by my waste management officials on 13 February 2004 and they saw no evidence of railway carriages or asbestos waste, findings reinforced by photographic and documentary evidence on file. The site is also subject to regulation by EHS under the terms of the Water (NI) Order 1999. In the course of a regulatory site visit on 24 February 2004, EHS Water Management officials noted "that no carriages were visible". In addition, EHS has undertaken independent water quality and soil sampling tests at the site and concluded that there has been no breach of the water order consent nor evidence of contravention of waste licensing controls. The Department therefore has no grounds to take action against the company. EHS will continue to monitor the Crosshill site for the presence of asbestos to ensure full compliance with the water order consent. Independent air quality monitoring will be a condition of any subsequent waste licence or permit application.

Mr. Hoyle: To ask the Deputy Prime Minister pursuant to the answer of 9 February 2005, Official Report, column 1586W, on sand reserves, how much of the 3.2 million tonnes of sand released under the Lancashire Minerals and Waste Local Plan has been taken; what estimate he has made of how long the sand at the existing permitted reserves will last; whether a full survey has been carried out to establish the total sand reserves in Lancashire; and how much sand will be needed for the next 10 years for Lancashire in accordance with revised Minerals Planning Guidance Note 6. [217159] Keith Hill: None of the 3.2 million tonnes of sand required to be released by the Lancashire Minerals and Waste Local Plan has been extracted since the plan was adopted. All production has been from reserves which already had planning permission at the time of adoption. Two applications for sand extraction have been submitted recently and await determination--one is near St. Michaels on Wyre, in Wyre borough, and the other is at Adlington in Chorley borough. The existing permitted reserves of sand in Lancashire amount to £3.54 million tonnes. At the present rates of production, these reserves would last for seven years. Stage 1 of a Sand and Gravel Study, undertaken by planning consultants and the British Geological Survey on behalf of the Lancashire joint authorities, has recently been completed. It identifies potential areas of high grade sand deposits within the county for further investigation in stage 2 to be conducted later this year. The revised Mineral Planning Guidance Note 6 require the north-west to provide 55 million tonnes of land-won sand and gravel over the period 2001 to 2016. Lancashire's share of this total is 8.2 million tonnes, which equates to 5 million tonnes in a 10-year period.

Mr. Hoyle: To ask the Deputy Prime Minister what sand reserves are recorded in the Lancashire Structural Plan; where deposits are located; and what planning guidelines apply to (a) sand quarries and (b) sand extraction. [214973] Keith Hill: The draft Replacement Lancashire Structure Plan, due for adoption in March 2005, does not record sand and gravel reserves or future requirements. However, the Lancashire Minerals and Waste Local Plan, adopted in December 2001, requires the release of 3.2 million tonnes by 2006. The local plan identifies three areas of search, which are: North and West of Preston; The Lower Ribble Valley; and The Leyland-Chorley area. The returns to the North West Aggregates Working Party for 2003 show that there are 3.54 million tonnes of permitted reserves at the three working sand quarries in the county. The national context for sand extraction is given by Minerals Planning Guidance Note 6, revised in 2004. It sets out a regional apportionment, of which Lancashire's share is 15 per cent., or 8.2 million tonnes. Planning policy in relation to sand quarries and sand extraction is given at a national level by Minerals Planning Guidance Note 1 (currently being revised as Minerals Planning Statement 1: Planning and Minerals). Sand extraction is covered by MPG 6, referred to above. The draft Replacement Lancashire Structure Plan has a policy (26) on "Provision for working minerals" which covers all aspects of minerals' working in overall terms; more detail is provided by the Lancashire Minerals and Waste Local Plan, which contains policies relating to: Safeguarding Mineral Resources; Mineral Consultation Areas; Prior Extraction; Concurrent Working; and Conservation of High Quality Material.
