Ms Munn: To ask the Secretary of State for Health what his policy is on whether patients who are being treated privately for a
hospital operation may receive public funding to meet part of the cost. [224765]
Mr. Hutton: There is no statutory power under existing legislation, which would enable patients to receive public funding, in whole
or in part, for private treatment in such circumstances.
Current legislation makes provision for a national health service which is delivered free of charge, except where there is a
statutory basis for making a charge. Any other charge for a NHS service would be unlawful. We have no plans to introduce legislation
to change this, and remain committed to a free NHS.
There is no statutory provision for charging United Kingdom residents for their hospital operations funded by the NHS, whether they
are carried out by an NHS organisation or through the independent sector. Nor is there any statutory provision for such services to
be part funded in this way by the NHS. If they are funded by the NHS they must be free of charge to the patient and funded in full.

Mr. Burstow: To ask the Secretary of State for Health how many operations were contracted for in each of his Department's contracts
with independent sector firms to provide NHS operations; how many operations have been completed under each contract; and how many
operations have been paid for but were not completed within the contracted time scale. [223254]
Mr. Hutton :[holding answer 22 March 2005]: All wave 1 contracts with independent sector (IS) providers are for fixed terms
(usually five years) and set numbers of procedures. IS providers are required to treat patients referred to them in order to be paid
and it is the responsibility of the national health service to ensure that appropriate numbers of patients are referred to ensure
that resources are not wasted and that patients receive treatment as quickly as possible. The number of patients treated under the
schemes that are currently operational is shown in the tables

Mrs. Curtis-Thomas: To ask the Secretary of State for Health what assessment he has made of the effect that contracts with
Interhealth Care Services for treatment centres will have on waiting lists for orthopaedic joint replacements in Sefton. [223754]
Mr. Hutton: Interhealth Care Services will carry out over 900 orthopaedic procedures in the Sefton area, starting from June 2006.
Interim service with Nuffield hospitals and Capio Healthcare began in October 2004 and will provide South Sefton Primary Care Trust
with an additional 269 procedures for their patients in that year.
These arrangements will help to speed up operations that patients might otherwise have had to wait longer for.

Dr. Ladyman: Published data for cancelled operations is available for 2004 to December 2004 (the latest available data). Great
Ormond Street hospital has had 74 last-minute cancellations for non-clinical reasons.
Based on data from the previous year, we can estimate that 9,611 inpatient operations were performed without cancellation during the
same period.

Sussex hospitals trust. [223099]
Ms Rosie Winterton: I am aware that there are concerns about the recent number of cancelled operations at East Sussex hospitals NHS
trust.
It is the responsibility of primary care trusts, working with their strategic health authorities, councils and other stakeholders to
plan, improve and sustain services for local people.
Leaders of the local health and social care organisations met early in March to discuss the operational problems faced by the
hospital, and have agreed measures designed to help address these problems.

Ms Rosie Winterton: The Department's guidance on the tracking of surgical instruments is contained in Health Service Circular (HSC)
2000/032 (Decontamination of Surgical Instruments). This asked chief executives of national health service trusts to have taken
steps, by April 2002, towards having systems in place to enable the tracing of surgical instrument sets to patients on whom they
have been used. The presence (or absence) of such a system was taken into account in assessing each NHS trust's compliance with the
Department's guidance made as part of the "Review of the decontamination of surgical instruments in the NHS in England", published
in December 2001. NHS trusts are not required to report to the Department which tracing system they use.
Compliance with the provisions of the Medical Devices Directive (93/42 EEC)--compulsory for commercial reprocessing centres
providing a service to the NHS-- implies the ability to track surgical instruments through the system. It does not--and nor does
Departmental guidance--require any particular form of marking, such as bar codes, to be used. The detailed contents of contracts
between NHS organisations and private sector providers of decontamination services are a matter for the parties concerned.
The Department's guidance on handling instruments used on suspected CJD patients or in certain brain biopsies recommends that such
instruments should be quarantined pending confirmation of a diagnosis. All hospitals that have implemented the guidance in HSC
2000/032 will have the capacity to do this. Other than the review published in 2001, no complete survey of their compliance has been
undertaken.
The NHS Purchasing and Supply Agency (NHS PASA) has commissioned a survey that includes tracking and tracing systems in use in NHS
trusts. NHS PASA is also discussing with the NHS the technologies presently available for marking instruments, such as laser
etching; and those being developed, such as the implantation of radio frequency identification chips in individual instruments.
