We take the view that Section 10 of the Countryside and Rights of Way Act 2000 means that a review must be completed not more than 10 years after the issue of the conclusive map that is being reviewed.

English Nature—now Natural England—as the relevant advisory body for nature conservation purposes in England, has provided the relevant authorities with formal advice for sites of potential concern in the light of the introduction of the right of access under the Countryside and Rights of Way Act 2000. Natural England has not published this advice and is under no statutory duty to do so.

The Education (Nutritional Standards for School Lunches) (England) Regulations 2006, which cover primary, secondary and special schools, state that pupils should have easy access at all times to free, fresh drinking water.
For nursery schools and nursery units within primary schools, previous guidance still applies. Healthy school lunches for pupils in nursery schools/units—guidance for school caterers on implementing national nutritional standards recommends that drinking water should be available to all children every day, free of charge.

The Countryside Agency (now Natural England) issued guidance under Section 33 of the Countryside and Rights of Way Act 2000 to the relevant authorities. This sets out criteria for determining applications to exclude or restrict access under the CROW Act. The guidance was approved by the Secretary of State and the relevant authorities are required to have regard to it in making their decisions.
While it is not a statutory requirement to carry out site visits, they have so far been undertaken for the majority of applications received by the relevant authorities.
Restrictions under Section 26 of the CROW Act are for nature conservation and heritage purposes and are not available on application. However, Natural England gives consideration to representations from external organisations and members of the public on these grounds. The relevant authorities consider whether restrictions are required in the light of any advice from the relevant advisory bodies (Natural England for nature conservation and English Heritage for heritage preservation purposes).
Where a long-term restriction is proposed, it is subject to statutory consultation procedures and the relevant authority considers any objections that are received before making its decision.

The Care Homes Regulations state that homes must provide, in adequate quantities, suitable, wholesome and nutritious food which is varied and properly prepared and available at such times as may reasonably be required by service users. Food, in the regulations, includes fluids.
The review of the National Minimum Standards for Care Homes, which the Commission for Social Care Inspection must take into account when inspecting care homes, is ongoing and will be subject to public consultation in due course. The issue of availability of drinking water to residents is being considered as part of the review. The intention is to implement any revised standards in 2007.
The Food Standards Agency (FSA) published, on 19 October 2006, nutrient and food-based advice for those providing food in care homes. The advice includes example menus, which include making water available at all eating occasions. Government advice is that we need to drink six to eight glasses of fluid every day. It is therefore implicit that care homes should make water freely available throughout the day.
There is no specific standard relating to the provision of drinking water in the National Health Service. However, there are two core standards that refer to food, against which the Healthcare Commission assesses as part of its annual health check. Food, for this purpose, as in care homes, includes fluids.

In his speech in Oxford last week, the Prime Minister encouraged us all to become more scientific. He said that we must become a more scientifically literate society and make the subject popular again. Does my hon. Friend agree that science centres and science museums have an important role to play in that respect? In particular, I would mention the national marine aquarium in the city of Plymouth. Will he consider the balance of funding and how it might be made more favourable, to enable such centres and museums to share their expertise and help us all to become scientifically literate?

My hon. Friend is right. There is no doubt that a key part in making young people not just want to take an interest in science but become scientists themselves is the work that our museums are doing. Both the national marine aquarium and the Science museum are doing a huge amount to make science accessible to young people and in getting through the doors to work with schools and with parents. As she would expect, we are looking at all these issues closely as we enter the comprehensive spending review.

Will the Minister congratulate the director of the Macclesfield silk museum, which was recently visited by His Royal Highness the Duke of Gloucester, on involving junior schools and their curricula with the textile history and tradition of Macclesfield? Will he go a little further and assure me and the House that small museums will not be neglected in respect of funding? They are critical to the history and tradition of our country and, in particular, of Macclesfield and the textile industry in the north-west.

The hon. Gentleman is right to attach his museum to the social cohesion that is no doubt important in Macclesfield. The museum in Macclesfield has benefited from the renaissance in the regions programme, which has £147 million for our regional museums up to 2008. That money was not there before. Our regional and local museums were in a dire state prior to that funding. In the House last week, I was pleased that so many people, and so many Members, were able to attend an event at which we celebrated the success of that programme, which Macclesfield has benefited from.

The review is in the mind of one person—the Chancellor of the Exchequer—and I do not think that he has yet completed his deliberations on those matters.

The European Community and its member states made clear on21 September 2005 that they, "““expect full, non-discriminatory implementation of the Additional Protocol, and the removal of all obstacles to the free movement of goods””,"
and that, "““the EU will monitor this closely and evaluate full implementation in 2006””."
This evaluation is yet to be published. The Government continue to urge the Turkish authorities to implement the protocol.

There is no doubt that the Lindisfarne gospels are one of our greatest national treasures, and are certainly a great source of pride in the north-east of this country. The My hon. Friend will know that it is important that Ministers at the Dispatch Box always maintain the independence of the British Library and the decisions that its board feels that it needs to make about the gospels. However, I am pleased that I will meet her this week to discuss these matters in greater detail.

Thanks to the Government’s support for the renaissance in the regions programme, museums across England are working with schools in greater numbers than ever before. I am pleased that, as a result of our investment, every school in Durham will benefit from educational access to museum collections.

Will he join me in pressing the British Library to move the Lindisfarne gospels on a permanent or temporary basis to the north-east, so that local people, including schoolchildren and visitors, can better appreciate their significance to the cultural heritage of the region?

There is no doubt that the Lindisfarne gospels are one of our greatest national treasures, and are certainly a great source of pride in the north-east of this country. The My hon. Friend will know that it is important that Ministers at the Dispatch Box always maintain the independence of the British Library and the decisions that its board feels that it needs to make about the gospels. However, I am pleased that I will meet her this week to discuss these matters in greater detail.

Onsite legal services are available to all claimants detained at Oakington for their application to be considered under the fast-track process irrespective of the basis of their claim for asylum. All claimants who enter the detained fast-track (DFT) process at Harmondsworth or Yarl's Wood are offered the services of a duty representative but they can instruct their own private firm instead if they wish.
Claimants detained at Oakington can be referred to the Medical Foundation by representatives in the same way as other claimants who are not detained. If the Medical Foundation agrees to accept a claimant for pre-assessment the claimant is taken out of the Oakington process. The referral is usually accepted within 24 hours. Similarly at Harmondsworth and Yarl's Wood, if a written confirmation of a Medical Foundation is produced before the initial decision is made, claimants are released from detention and the DFT process.
