Though special schools are not legally required to follow the national curriculum (NC), those pupils who are able to do so are entered for tests and public examinations. In the interests of recognising that many pupils with special needs are capable of high achievement, the results of special schools are included in the tables.
Independent schools also are not legally obliged to follow the NC and are not included in the key stage 2 and key stage 3 tables. However, the vast majority of pupils in the independent sector are entered for public examinations and are included in the key stage 4 (GCSE) tables and post-16 (A-level) tables.
Pupil referral units (PRUs) are different because their purpose is not to provide a permanent place of education. The purpose of PRUs is to provide a placement for pupils temporarily displaced from mainstream schools. The majority of pupils spend less than two terms in a PRU and many never sit an exam. Any test and exam results that were published would not give a reliable picture of educational standards.
We believe that good PRUs should be recognised and encouraged, but we do not believe that publishing their results in the achievement and attainment tables would achieve that. They are inspected by Ofsted and, where a PRU is achieving well, this will be detailed in the school’s inspection report. PRUs that are judged by Ofsted to be ““outstanding”” appear alongside other high-performing schools on Ofsted’s annual outstanding provider list.
With the plans to include PRUs in pupil level data collection, we anticipate including their results in the LA averages once we know that the data are reliable.

The Department launched a new phonics area of the standards website in March this year. The website contains published criteria to help schools and early years settings judge how well phonics teaching programmes meet the characteristics of high quality phonic work as defined in Sir Jim Rose’s review of the teaching of early reading. To ensure that this process is as easy and useful as possible for schools and settings we have invited publishers of commercial programmes to evaluate their own programme against the criteria and complete a self-assessment form which is then published on the site. This is a purely voluntary process.The Department does not rank, endorse or promote any particular commercial phonics programme. We have committed to establishing a monitoring process to assess the accuracy of the information provided in the self-evaluation forms. This process is currently being developed and further information about how it will work will be provided on the website.Letters and Sounds is one of many high quality phonics teaching programmes which meet the core criteria and we are not promoting it as the preferred phonics programme. An early version of the materials was previewed in some local authorities and with practitioners and the feedback was overwhelmingly positive. Letters and Sounds was distributed to all primary schools and local authorities during May and June. It will therefore take some time for the full effects to become known but we are confident that Letters and Sounds will make a significant contribution to improving standards of literacy. Initial feedback from practitioners indicates a very positive response to the materials and we will use this information to further refine our support for local authorities. Pupil referral units are not published in the achievement and attainment tables or local authority averages because they are not required to follow the national curriculum.
When the pupil level annual school census was developed the priority was to ensure that it successfully captured information on pupils attending maintained mainstream schools. The department has recently expanded the scope of the census and is currently piloting a pupil level data collection from pupil referral units before they are included in the annual census.

Six thousand copies of the publication, Peacemaking in Northern Ireland: A Model for Conflict Resolution?, were produced and distributed by the Northern Ireland Office, which bore the cost.
The production cost for the document was £3,950, and it was distributed to a wide audience of individuals and organisations locally, nationally and internationally, selected because of their interest in Northern Ireland affairs. The distribution costs are not available as the pamphlet was distributed as part of normal departmental business by a mixture of Royal Mail and internal courier services.

Occupational Aspects of the Management of Chronic Fatigue Syndrome (CFS): A National Guideline was proposed by the department’s NHS Plus project as part of its evidence-based guidelines work. A committee of stakeholders external to the project approves the scope and draft proposals for all the project guidelines. Each guideline is produced by a guideline development group and scrutinised by two external assessors. All members of the CFS guideline development group and the external assessors are listed in the published guideline, which is available on the NHS Plus website at www.nhsplus.nhs.uk.
NHS Plus worked closely with the National Institute for Health and Clinical Excellence (NICE) in the development of the above guideline, which is specifically focused on occupational issues. NICE is looking at clinical aspects of management of the condition.
The guideline was distributed in printed copy to all NHS Plus occupational health departments and the faculty of occupational medicine. A full scientific review and accompanying summary leaflets are freely available on the NHS Plus website. The guideline cost less than £15,000 to produce and distribute.

The UK has not received any specific complaints from opposition parties concerning the registration of electors in Cameroon, although we are aware that in previous elections there have been complaints that many who wished to vote were unable to register to do so. The Government of Cameroon are making good progress to fulfil a pledge made to computerise the electoral roll. When completed, this should greatly assist transparency, since voters and political parties should have access to it and be able to see who is registered to vote in individual constituencies.
The independent electoral body ELECAM was voted into law by the National Assembly at the end of 2006. The law provides for a transitional period of up to 18 months, during which ELECAM will assume the functions now carried out by the Interior Ministry and the National Elections Observatory. We are aware of the preference among some opposition politicians for a postponement of the forthcoming elections until ELECAM is in a position to run them. There is no sign that the Government will pursue the option of a postponement, which would present problems under the constitution. The international community, in Yaoundé, including the UK, is urging the Government of Cameroon to press on with the implementation of ELECAM as quickly as possible.
We are aware of a general level of dissatisfaction among the opposition and others that the results of the latest census are yet to be published and have pressed the Government of Cameroon to expedite this.

The UK is not currently providing any technical or financial assistance to support the creation of ELECAM, although officials and Ministers from Cameroon visited the UK in 2006 to examine our electoral arrangements.
The Commonwealth has been Cameroon's partner in developing a blueprint for ELECAM. It sent expert groups twice to Cameroon to assist in drafting legislation and paid for key Ministers to visit a sample of countries to review election commissions. It is currently encouraging them to appoint ELECAM members before the legislative/municipal elections scheduled for this year. If they do so, the Commonwealth will offer technical assistance.
As far as we are aware, neither the UK nor the Commonwealth has received any requests in connection with assistance to publish the results of the 2006 census.

My Lords, does the Minister appreciate the problems encountered by parents whose children are taken away from them? When they feel that there has been a gross miscarriage of justice, the gagging order applied by these courts means that they can speak only to their MP or their lawyer. I have spoken to many such parents here under parliamentary privilege. They cannot go to anybody but their lawyer, who they may feel to be inadequate, or their MP, who also may not be able to help, because of the gagging orders. Is there any way that these orders can be relaxed a little so that they can go to other people for good advice?

It is important that confidentiality is preserved in case, for example, the identity of an adopted child became known in its locality, together with the circumstances that led to its adoption; or, in case in a particular locality it became known that allegations made against the parents were in part proved and the children were still in that locality.
The noble Countess will know how cross individual parents might feel, but the damage to the child would be immense if there was not a restriction on using the material. We have looked at the family procedure rules recently and made some changes. One can apply to the judges, but I am clear that confidentiality must be protected.

Will he in his consultations and discussions involve the Press Complaints Commission, because if we had better guarantees that the coverage of such cases would be carried out with extra sensitivity, it might be possible to move in the direction of more openness, which most people would like to see?

My Lords, as I made it clear in my original Answer, the extent to which a judgment is made public is a matter for the individual court. Normally a judgment is not made public, but my noble and learned friend Lady Butler-Sloss, as president of the Family Division in 2004, issued a practice direction saying that it is also worth giving consideration to increasing the frequency with which anonymised—protecting confidentiality—family court judgments in general are made public. I agree with the noble Baroness, Lady Walmsley, that thought should be given to the matter and that we must be clear that the children’s identity is kept anonymous. However, to deal with the original Question, if one is convinced that one can protect anonymity in a case, the practice can be used to avoid there being misapprehensions about how the court operates, but it must be done with great care as the noble Baroness implied.

My Lords, does the Minister agree that it would be better for transcripts of judgments to be handed down later rather than in court after the event? Does he share my concern that if judgments are handed down in public, with members of the public being in court, it would be obvious who was being talked about and the participants would feel extremely uncomfortable, which would add to the stress of the situation?
