My Lords, the US has confirmed that it intends to transfer responsibility for Camp Ashraf to the Iraqi authorities. Transfer should take place before 31 December. The Iraqi authorities have given assurances that residents will be treated humanely. The Iraqi human rights ministry plays a key role in the transition. The US and the ICRC continue to follow developments at the camp closely and are content with Iraqi assurances so far received. The US and Iraqis have discussed the transfer with UNHCR and UNAMI.

My Lords, is the Minister aware of the rather ominous directive of the Iraqi Government of 17 June which called for the removal of US troops and their replacement with Iraqi forces, and for the expulsion of the PMOI residents in Ashraf City? Does he realise that expulsion in those circumstances would almost certainly mean execution? This is an extremely serious situation. Can he assure the House that he will keep a very close eye on developments and secure what guarantees he can from the Iraqi Government to avoid what would otherwise become a humanitarian catastrophe?

My Lords, as the noble Lord is aware, this is primarily a matter for the United States, to which this group surrendered at the time of the invasion in 2003. The US has sought clear understandings from the Iraqi authorities that there will be no such expulsions and that the group will be properly protected. The letter of 1 August 2008 from the Permanent Representatives of France, the United Kingdom and the United States to the President of the UN Security Council provides a list of banks domiciled in Iran and their branches and subsidiaries abroad in order to facilitate the implementation of United Nations Security Council Resolution (UNSCR) 1803. UNSCR 1803 calls upon all states "to exercise vigilance over the activities of financial institutions in their territories with all banks domiciled in Iran, in particular with Bank Melli and Bank Saderat, and their branches and subsidiaries abroad, in order to avoid such financial support contributing to proliferation sensitive nuclear activities".The Government have taken comprehensive steps to implement these vigilance requirements in the UK, in relation to both UK subsidiaries of Iranian banks and transactions with any other Iranian bank. The UK made a significant contribution to the development of Council Regulation (EC) 1110/2008 which implements the vigilance requirements of UNSCR 1803 throughout the EU. The regulation requires enhanced vigilance over activity with Iranian banks, additional information in payment instructions, enhanced record-keeping, and establishes a new requirement on financial institutions to report transactions they suspect are related to proliferation finance. It also requires reporting of all transfers of funds by Bank Saderat plc.The UK has also worked with international partners to secure common standards of implementation of the vigilance requirements of UNSCR 1803 for all members of the Financial Action Task Force (FATF), including those outside the EU.

I have been asked to reply.Discussions with international partners have repeatedly highlighted the risk of deceptive practices by Iran in support of proliferation sensitive nuclear activities, including stripping Iranian names from transactions to hide Iran's involvement. The UK Government are aware of this threat and shares these concerns. It would not be appropriate to comment on individual notifications.EU Regulation 1110/2008, concerning restrictive measures against Iran, which took effect throughout the EU this month applies a series of financial vigilance measures to all transactions involving Iranian financial institutions. These measures will guard against deceptive practices—including that of stripping Iranian names from transactions.In addition, the EC Regulation onWire Transfers (1781/2006) assists in accurately identifying the sources of such transfers by requiring that transfers of funds sent or received by a payment service provider in the EC shall be accompanied by complete information on the payer-name, address (or other identifier) and account number (or unique identifier allowing the payment to be traced back to the payer).

The political directors from the E3+3(UK, France, Germany, US, China and Russia) and a representative for the EU High Representative met in Paris on 13 November to discuss the Iranian nuclear issue. This meeting followed UN Security Council Resolution (UNSCR) 1835 on 27 September which reaffirmed the importance of the dual-track approach. The meeting allowed the participants to review the current situation and to discuss both tracks. We have made clear to Iran that our offer of dialogue the demands of successive UNSCRs we will pursue further sanctions, in line with the dual-track policy.

UN Security Council Resolution 1737 (2006) prohibits the transfer of materials, equipment, goods and technology to Iran if they would contribute to enrichment-related, or reprocessing, or heavy water-related activities, or to the development of nuclear weapon delivery systems. But the Resolution provides an exemption for the supply of equipment for light water reactors and for the technical support or training relating to such a reactor. Since passage of the Resolution, we understand that a substantial number of Iranians have been trained in Russia in preparation for working at the Bushehr Light Water Reactor, but we are unable to confirm a precise number.The UN Sanctions Committee established by UNSCR 1737 oversees member states' implementation of the measures adopted. While we too continue to monitor implementation, the Committee's reports have not cited any breaches by the Russian Federation of UN sanctions against Iran.

My Lords, there is no doubt that with the return of these people to the Iranian Government, the rights not just of women but of the whole group would be in some jeopardy. That is why I assure my noble friend that the United States has worked hard to make sure that the camp remains open and people are not at risk of return.

My Lords, some 300 members of this group have returned—they are admittedly low-level people in most cases—and we have no evidence that they have been inhumanely treated on their return. However, it has been the intention of the Americans in the understandings that they have sought from the Iraqis that Camp Ashraf remains open, and therefore that those individuals in it will not be expelled.

My Lords, does the Minister agree that the question is not so much, ““What are the intentions of the Iraqi Government?”” but, ““What would be the intentions of the Iranian Government if these people were delivered up into their hands?””. My Lords, I hope that the noble Lord will agree that there is a difference between the dispersed communities to which he refers and the limited capacity of the Iraqi Government to protect them and the situation of this group, contained within Ashraf City. The right of protection can easily and effectively be transferred to the Iraqi authorities, so long as they are committed to playing that role.

My Lords, is this not a premature decision, given the failure of the Iraqi Government at present to protect the Chaldeans, the Syriacs, the Yazidis and other minorities, whose lives are endangered on the Nineveh plains where they have been expelled from Mosul? Is it not premature to change the status of those Iranians in Ashraf City?

My Lords, the noble Lord asks a very different question. I do not know whether all Iraqis share that view, but obviously there is a dramatic change in direction in which there is a rundown of western forces in Iraq. It is important that this group’s rights be protected while we recognise that new situation—that Iraqis will be responsible for security and human rights in Iraq.

My Lords, the Minister referred to the responsibility of the United States but surely Britain, by virtue of its membership of the multinational force, will be as much in breach of international law as America if the protection of Ashraf City is handed over to Iraq without any real expectation that the rights of the inhabitants will be respected and that the Iraqi Government will not return them to Iran. Surely that must be the legal position.

My Lords, on the second point, the United States absolutely shares the noble Lord’s concern, which is why it has pressed the Iraqi Government to ensure that undertakings to look after this group are in place. I think that they are satisfied that that is the case. As to the UK’s legal responsibility, it is our view that the MEK/PMOI specifically chose American forces to surrender to. Secondly, the proclamation from the multinational commander at the time in 2004 that confirmed camp resident status as being ““treated as protected persons”” was clearly made on behalf of the United States alone.

The UK led pressure for a new EU Common Position and Regulation to implement UN Security Council Resolution 1803. The Regulation was adopted on 10 November 2008 and the provisions for increased vigilance over the activities of Iranian financial institutions are now being implemented. HMT have issued guidance on their website:"http://www.hm-treasury.gov.uk/d/fin_sanc_iran_notice_111108.pdf."The UK is continuing to press for additional individuals and entities to be subjected to an EU assets freeze. Following United Nations Security Council Resolution 1835 the UK is also discussing a range of possible EU measures which would go beyond the scope of Security Council resolutions should Iran continue to fail to implement its international obligations. As my right hon. Friend the Prime Minister has signalled, this could include a ban on investment in Iranian liquefied natural gas.

Iran was not formally discussed at the General Affairs and External Relations Council (GAERC) meeting of 10 and 11 November, though Iran is regularly discussed in the margins. However, we welcomed Council Regulation (EC) No. 1110/2008 of 10 November 2008, which was agreed at the GAERC, implementing UN sanctions resolution 1803 on Iran. The next meeting of the GAERC is scheduled for 8 December though the agenda for that meeting has yet to be finalised. Going forward we will be looking to the EU to enhance measures already in place against Iran and will aim to build further consensus for coordinated measures in support of the UN as required by the Council Conclusions of 14 December 2007.

My Lords, the noble Lord asks a very different question. I do not know whether all Iraqis share that view, but obviously there is a dramatic change in direction in which there is a rundown of western forces in Iraq. It is important that this group’s rights be protected while we recognise that new situation—that Iraqis will be responsible for security and human rights in Iraq.

My Lords, is this not a premature decision, given the failure of the Iraqi Government at present to protect the Chaldeans, the Syriacs, the Yazidis and other minorities, whose lives are endangered on the Nineveh plains where they have been expelled from Mosul? Is it not premature to change the status of those Iranians in Ashraf City?

My Lords, I hope that the noble Lord will agree that there is a difference between the dispersed communities to which he refers and the limited capacity of the Iraqi Government to protect them and the situation of this group, contained within Ashraf City. The right of protection can easily and effectively be transferred to the Iraqi authorities, so long as they are committed to playing that role.

My Lords, will the Minister encourage our allies to make sure that there is at least some international monitoring of the situation when the Americans leave, and that there is some way of reporting back if there is a deterioration in the circumstances of these people?

My Lords, it is for exactly that reason that the United States has involved both the International Committee of the Red Cross and the United Nations in trying to ensure continued international monitoring.
