All three bidders in the London Community Payback competition were provided with a £2 million contract exit indemnity in relation to any pension liabilities arising during the contract period. Additionally the Ministry of Justice has agreed to indemnify any liabilities arising from historic pension liabilities at the point of contract transfer. The amount of these liabilities have been recently valued at approximately £3.7 million but this amount may vary subject to triennial revaluations.

The department does not generally hold information centrally about NHS contracts because it is local NHS bodies themselves such as primary care trusts (PCTs) which are procuring authorities and are accountable and responsible for decisions concerning the performance of the contract and the contractor.
As information on this contract is not held centrally, the noble Lord may wish to contact Cornwall and Isles of Scilly PCT for further information. We understand that Kernow Clinical Commissioning Group will take over the contract from 1 April 2013.

I can confirm that applications under the Business Appointment Rules (BAR) process were authorised for the following: one payband SCS3 to take up employment as an independent consultant for G4S; one payband SCS2 to take up employment to work for Sodexo; one payband SCS2 to take up employment to work for G4S and one payband SCS1 to take up employment with G4S since May 2010.
Where appropriate, restrictions were placed on the activities individuals could undertake in their new employment. For example, as a general principle, there is a two year ban on civil servants at SCS3 and above lobbying Government (including Ministers, special advisers and officials) on behalf of their new employer after leaving the civil service.
Since April 2012 there have been no applications from individuals in paybands SCS1, SCS2 and SCS3 to work for any of these companies.
I can release the details of the payband SCS3 because his name has previously been released—he is Philip Wheatley, previously Director General of the National Offender Management Service.
Under the Data Protection Act, it is not appropriate for me to disclose the names of the other individuals I refer to in my answer.

Since January 2012, the UK Border Agency has worked with Serco who provided a service in the London and south east area to ascertain the cost and effectiveness of a new approach to identify and as necessary remove those refused extensions of leave.
Serco was given 7,600 cases as a proof of concept ahead of a competitive tender and was not paid for this work.

Since January 2012, Serco has provided a free of charge service in the London and south east area to ascertain the cost and effectiveness of a new approach to the Migration Refusals Pool. This is a matter for Cornwall and the Isles of Scilly primary care trust and the Care Quality Commission (CQC). However, we understand that the CQC is currently carrying out an inspection
into Serco. As the CQC is an independent body it would not be appropriate to comment further on this inspection.

This Government have made no assessment of Serco’s whistleblowing procedures. The Public Interest Disclosure Act (PIDA) forms part of the wider employment rights legislation and gives legal protection to all staff (employees and workers as defined in PIDA) who make disclosures in the public interest, providing they follow the procedures set out in it. PIDA applies to all staff working in the National Health Service.
Although PIDA does not require organisations to set up whistleblowing policies and procedures, it does provide an impetus for doing so. Guidance issued by the department in 2003, and further updated in 2010, Speak up for a Healthy NHS, made clear that NHS organisations should put in place local policies and procedures that comply with the Act and set out minimum requirements for such policies. A copy of this guidance has been placed in the Library. A letter reminding all trusts of their obligations in respect of PIDA was issued by the department in January 2012.
I understand that the primary care trust cluster’s medical director and executive nurse will be writing to Serco’s medical director and to all out-of-hours clinicians reminding them of whistleblowing policies and of their duty to raise concerns where patient safety issues are identified or suspected.
