My Lords, I tend to agree with my noble friend Lord Tyler. We have had situations today where the measures are agreed in principle but then the Government’s reasoning is challenged. This is another case in which the Opposition are not quite sure where to be on this issue.

To ask the Secretary of State for Justice how many legal proceedings involving the licensing of taxi and private hire vehicles, operators and drivers have been dealt with in the court system in each year since 2000.
To ask the Secretary of State for Justice how many legal proceedings involving the licensing of taxi and private hire vehicles, operators and drivers have been dealt with in the court system in each year since 2000.
The Ministry of Justice Court Proceedings Database hold information on defendants proceeded against, found guilty and sentenced for criminal offences in England and Wales. However, not all offences are individually reported within the centrally held data. Offences involving the licensing of taxi and private hire vehicles, operators and drivers under the Private Hire (London) Act 1998 are reported as part of a miscellaneous group of offences, and it is not possible to separately identify proceedings for these specific offences from others offences relating to motor vehicles. This detailed information is not reported to Justice Statistics Analytical Services due to their size and complexity.
Court proceedings data for 2013 are planned for publication in May 2014.

To ask the Secretary of State for Business, Innovation and Skills what estimate he has made of the proportion of (a) official receivers and (b) all Insolvency Service officials who will receive training leading to a (i) personal insolvency partial licence and (ii) corporate insolvency partial licence.

The legislation relating to official receivers and Insolvency Service technical staff, does not require study to hold an insolvency practitioners’ licence and, as such, no staff will receive training that will lead to either a personal insolvency partial licence or a corporate insolvency partial licence.
Under S399(1) of the Insolvency Act 1986 “………the official receiver, in relation to any bankruptcy, winding up, individual voluntary arrangement, debt relief order or application for such an order is any person who by virtue of the following provisions ………….is authorised to act as the official receiver ………..” and S399(2) “The Secretary of State may ……. appoint persons to the office of official receiver ……………….”.
All technical staff are required to study for, and pass, a bespoke accredited training programme at qualifications and credit framework level 3 and are required to undertake a minimum of five days continuous professional development per year.
Incidentally, over 50% of official receivers hold a professional qualification e.g. ACCA.

As at 8 April 2014, 69 prosecutions have been undertaken against 44 individuals and companies that operated without a licence, one company that obstructed the Gangmasters Licensing Authority (GLA) officers, and 24 individuals and companies that used the services of unlicensed gangmasters.
A standard GLA licence allows a gangmaster to undertake activity in both agriculture and food supply. As a result, the GLA do not retain data on whether individual prosecutions related to agriculture or food supply.

On 14 March 2014, European Union member states formally adopted the revised Tobacco Products Directive, including the provisions for regulation of electronic cigarettes. Article 18 of the directive will subject electronic cigarettes to consumer products legislation, with specific additional regulatory requirements unless they fall under the definition of a medicinal product.
The Medicines and Healthcare products Regulatory Agency is continuing to focus on regulating medicinal nicotine containing products, including electronic cigarettes, to enable licensed products that meet appropriate standards of safety, quality and efficacy to be available. Marketing authorisation applications have been submitted and interest in licensing continues.
