The contract awarded to Seaborne was part of a broader procurement exercise to secure additional freight capacity after Brexit, wherein nine companies were approached and contracts were awarded to three. Due to the complexity of disaggregating the data from related contingency planning, the precise staff and consultancy time involved with Seaborne, and associated discussions on Ramsgate dredging, could be obtained only at disproportionate cost.

Under section 75 of the Marine and Coastal Access Act, certain activities by a harbour authority (or on behalf of one), within their area, are exempt from requiring a marine licence if they have a local act or a harbour order (the Ramsgate Corporation Act 1934 is the relevant local act in this case).
As a result of the dredging activity, referenced within the answer provided on 15 January 2019 to Question 207205, no arisings are being physically excavated during the dredging work and there is no material which requires disposal. The Marine Management Organisation (MMO) has not therefore granted a licence for the specific works being undertaken.
The MMO did issue a separate marine licence (L/2016/00086/2) on 18 March 2016 for ongoing maintenance and navigational dredging to the Port of Ramsgate which licences activity at the port until 2026.

From discussions with the Port of Ramsgate and its owner, Thanet District Council, Natural England (NE) understands that the dredging undertaken at the start of this year is considered to be maintenance dredging and as such is covered by previous environmental assessments.

The Government is not a party to this contract and so this information is not held centrally. Works in ports and harbours are matters for the relevant authority and must comply with the relevant regulatory regimes.

Infrastructure work is necessary to enable the port to resume Ro-Ro services. Thanet Council is in discussion with both the Department and Seaborne Freight to finalise the funding arrangements for the infrastructure works at the port, and vital dredging work has already started.

The Environment Agency was consulted by the Marine Management Organisation on the application from Ramsgate Royal Harbour for the current dredging project at the Port of Ramsgate, on the 10 December 2015.
The application included an environmental impact assessment and the Environment Agency submitted comments on the 22 December 2015.
The Environment Agency accepted the proposal with the condition that material deposited within European Union bathing waters is only deposited outside the European Union bathing season.
The dredging activity does not put at risk the Water Framework Directive, therefore there is not a significant risk to the environment.
Permission was given for the activity by the Marine Management Organisation on the 29 March 2016.

In 2010/2011, Natural England (NE) worked with Ramsgate Harbour on environmental assessment and monitoring of their water injection dredging activities, including a Habitats Regulations Assessment of the activity undertaken at that time. After noting reports that dredging was taking place in order to prepare the port for expansion via water injection, NE have contacted the port directly to clarify what dredging is being undertaken, including volumes and locations. NE have also been in touch with the Marine Management Organisation (MMO) to clarify under which powers the port are undertaking this activity and whether an MMO licence would be required.

Work undertaken at ports, including compliance with any regulatory standards, is a matter for the relevant port authorities.

Maintenance dredging is currently in progress. Additionally, limited works are needed to restore the readiness of the port for regular ro-ro services, including appropriate Border Force facilities. Seaborne and my Department are working closely with Thanet Council to ensure that the Port will be ready to accept new services.

A number of studies have been carried out over the years by a variety of research bodies and individuals, which have looked specifically at the impacts of dredging on the marine environment.
For example, in 2015 the Government funded a three-phase project which is considering the impacts of towed fishing gears on mobile sediments against the background of natural variability. The report of the first phase of this project is available here (Natural variability phase 1 report).
There are a number of management measures in place, both nationally and locally, which are aimed at reducing the impact of dredging on the marine environment. Measures are reviewed regularly to ensure they remain effective and enforceable. This will continue as we work to ensure our future fisheries management is robust and effective in protecting the sustainability of our fisheries and the marine environment.

The Secretary of State is the appropriate licensing authority for the English inshore and offshore regions, although most of the Secretary of State’s licensing functions have been delegated to the Marine Management Organisation (MMO) under the Marine and Coastal Access Act 2009 (MCAA). Under Section 71(6) of the MCAA the MMO is required to comply with international law when exercising its licensing functions, including the London Protocol 1996. This Protocol was adopted in 1996 to modernise the London Convention 1972.
The MMO has issued one licence for maintenance activities at Hinkley Point B for the removal of sand and cobble material along the base of the sea wall, in order to keep the power station’s surface water drains clear. The licence is valid between 2015 and 2025, and allows for removed material to be deposited or ‘spread’ across a beach located to the east of Hinkley Point B.
Any dredging activities associated with the original construction of Hinkley Point B station would have been considered by the relevant regulator at the time of the application.

HMRC landfill tax returns do not require taxpayers to specify which relief applies to material that is not subject to tax. It is therefore not possible to establish how many taxpayers benefitted from a particular exemption. HMRC does not require this level of detail because it would place a disproportionate administrative burden on business.
