[53331] Mr. Keith Bradley: [holding answer 2 May 2002]: Organisations which took part in the Criminal Record Bureau's (CRB) pilot phase did so on a voluntary basis. These included Stoke city council which along with others received written briefing and an informal presentation at CRB headquarters in Liverpool. The organisations taking part in the pilot phase were supplied with application forms to be completed whenever a police check under the (then) current arrangements was required. Police forces agreed to use these to undertake checks and then to pass them to CRB. The forms were produced especially for the pilot phase and it was made clear in all briefing that they could not be used after commencement of the live Disclosure Service. The pilot phase continued until the commencement of the Disclosure Service on 11 March 2002. This was an extension to the original timescale of 1 March 2002. Any person who agreed to take part in the pilot by completing a Disclosure application form supplied for that purpose would not have been able to submit it after the pilot phase had ended, but were able to continue to submit them to be received by 10 March 2002. CRB will consider any claims for compensation for loss of earnings caused by any delays as a result of proven errors by the CRB.

Mrs. Curtis-Thomas: To ask the Secretary of State for the Home Department if he will make a statement on the actions that he plans to take as a consequence of the Damilola Taylor case. [54120] Mr. Keith Bradley: First of all I would like to express my heartfelt sympathy for the Taylor family who still have many questions left unanswered despite an intensive police investigation and a lengthy trial. As my right hon. Friend the Prime Minister (Mr. Blair) has said there should be no rush to judgment. This was always going to be a difficult case. My right hon. and noble Friend the Attorney-General (Lord Goldsmith) has asked the Director of Public Prosecutions to look into the handling of the case, to consider whether there are implications for the conduct of future cases and to make recommendations. Her Majesty's Crown Prosecution Service Inspectorate will be involved in the review. In particular, the Director has been asked to examine whether the time has come to introduce a system where, before trial, interviews of certain key witnesses are conducted by the prosecutor in a limited category of cases. The review will report by mid-summer. We are already taking steps to help children and other vulnerable or intimidated witnesses give their best evidence. In June 1998 the Government published "Speaking up for Justice", a report of an interdepartmental working group on the treatment of vulnerable or intimidated witnesses in the Criminal Justice system. It proposed a coherent and integrated scheme to provide appropriate support and assistance for vulnerable or intimidated witnesses. Key recommendations include a range of special measures available for use at the trial including: screens around the witness box; clearing the court, in certain circumstances, so that evidence can be given in private; removal of wigs and gowns; video recorded statements to replace the evidence-in-chief; video recorded pre-trial cross-examination; live television links; assistance with communication if necessary, including the use of an intermediary. The measures requiring legislation were included in Part II of the Youth Justice and Criminal Evidence Act 1999. Implementation of the special measures is imminent and they will be an improvement on the current arrangements. In January I announced a phased implementation programme starting on 24 July this year. In the Crown court all the special measures will be implemented for vulnerable witnesses, with the exception of intermediaries and pre-trial cross-examination which will be subject to pilot projects. The same measures, with the added exception of video-recorded statements, will be implemented at the same time for intimidated witnesses. All other measures will be introduced in 2003-04 for all qualifying witnesses. In magistrates courts implementation of special measures in July 2002 will be restricted to television links and video recorded evidence for child witnesses in cases involving sexual offences, violence (including threats) and cruelty. This will provide protection for children in cases involving assaults, muggings and domestic violence. It will also bring the adult magistrates courts into line with the current provision in the Youth court. Most of the measures will be extended to magistrates courts by 2003-04 (after their evaluation in the Crown court) to bring them in line with the Crown court. Over the next year or two we will also be starting pilot projects on video-recorded pre-trial cross-examination and the use of intermediaries. A whole range of guidance and training materials for the criminal justice agencies have been published including: "Achieving Best Evidence", which is comprehensive guidance on preparing for and conducting interviews with vulnerable or intimidated witnesses (both adults and children). It will replace the "Memorandum of Good Practice in Video Recorded Interviews With Child Witnesses For Criminal Proceedings" from 24 May 2002; A practice guide on early special measures meeting between the police and Crown Prosecution Service and meetings between the Crown Prosecution Service and vulnerable and intimidated witnesses. From July, prosecutors will meet vulnerable witnesses to discuss special measures that can be taken in connection with their giving evidence. We are working closely with a full range of agencies in the criminal justice system and voluntary sector in implementing these measures. Arrangements are already in place to evaluate the special measures once they have had a chance to bed down. We will also be looking closely at the findings of the inquiries being conducted by the Crown Prosecution Service and the Metropolitan police to see if there are any lessons to be learned for the measures needed to enable children and other vulnerable or intimidated witnesses to give their best evidence. On the wider front, Sir Robin Auld's Review of the Criminal Courts was published in October last year which resulted in a public consultation. The report contains 328 recommendations and makes wide proposals for reforming the courts and their proceedings. The Government is looking at the report and the results of the consultation carefully as well as other ideas for modernising the criminal justice system. We will publish a White Paper setting out our proposals for the way forward shortly.

Norman Baker: To ask the Parliamentary Secretary, Lord Chancellor's Department under what circumstances schedule 1 sex offenders are allowed unsupervised contact with children. [41974] Mr. Keith Bradley: [holding answer 11 March 2002]: I have been asked to reply. Schedule 1 of the Children and Young Persons Act 1933 is a list of cruelty, violent and sexual offences against children. This list has been used by various agencies as a way of identifying those committing these offences as posing a risk to children, although not all necessarily do so or do so currently. Some of those guilty of offences on the list, for example, may have committed the offence many years previously, may themselves have been children at the time and the offence may have, for example, involved a fight with another child of a similar age. Others convicted of offences on the list may have been engaged in mutually agreed sexual activity, albeit with someone under the age of legal consent, to whom they were relatively close in age. There are no specified requirements flowing from commission of an offence on Schedule 1 of this Act that prohibit offenders from having unsupervised contact with children. There are, however, other more recent means of achieving this and of protecting children from the risk that violent and sexual offenders pose. Those offenders sentenced to more than 12 months imprisonment are released subject to a licence which can include, in relevant cases, a requirement not to have unsupervised contact with children. Breach of these conditions can result in a return to prison. Moreover, a similar prohibition can be included in a Sex Offender Order, for which the police can apply to magistrates' court with respect to a convicted sex offender whose current behaviour indicates they pose a risk of serious harm. Breaching the terms of the order may result in a maximum sentence of up to five years imprisonment. Part 2 of the Criminal Justice and Court Services Act 2000 provides for certain of those convicted of offences against children to be disqualified from seeking or taking employment, whether paid or unpaid, with children in the future. The Criminal Justice and Court Services Act also placed a statutory duty jointly on the policy and probation services to put arrangements in place for assessing and managing the risk posed by sexual and violent offenders. These arrangements enable a risk assessment to be undertaken and plans to be devised for managing the risk that such offenders pose. Despite these measures, it nonetheless remains important for parents to be vigilant about those to whom they entrust the care of their children, particularly when they are not present to ensure their safety.

Mr. Andrew Turner: To ask the Secretary of State for the Home Department if he will list the criminal offences which have been (a) created in each year since 1997 and (b) abolished. [44995] Mr. Keith Bradley: [holding answer 21 March 2002]: A comprehensive and exhaustive list of new and abolished offences could be provided only at disproportionate cost. We can, however, provide the following information about Home Office measures which have been enacted since 1 May 1997. The Crime and Disorder Act 1998 created two new offences: breach of antisocial behaviour orders and breach of sex offender orders. It also created nine racially- aggravated offences (amended by the Anti-terrorism, Crime and Security Act 2001 to "racially or religiously aggravated offences"), but these are based on existing offences and do not render unlawful behaviour which would otherwise have been lawful. The Data Protection Act 1998 created four new offences. The Immigration and Asylum Act 1999 created 12 new offences. The Youth Justice and Criminal Evidence Act 1999 created four new offences. The Football (Offences and Disorder) Act 1999 created one new offence. The Terrorism Act 2000 created 38 new offences. The Regulation of Investigatory Powers Act 2000 created four new criminal offences. The Football (Disorder) Act 2000 created two new criminal offences. The Licensing (Young Persons) Act 2000 created one new criminal offence. The Freedom of Information Act 2000 created three new criminal offences. The Political Parties, Elections and Referendums Act 2000 created 69 new criminal offences. The Criminal Justice and Court Services Act 2000 created three new criminal offences. The Sexual Offences (Amendment) Act 2000 created two new criminal offences. The Regulation of Investigatory Powers Act 2000 created six new criminal offences. The Criminal Justice and Police Act 2001 created 15 new criminal offences. The Vehicle (Crimes) Act 2001 created 12 new criminal offences. The Private Security Industry Act 2001 created 10 new offences. The Anti-terrorism, Crime and Security Act 2001 created 19 new offences.
