The Solicitor-General: During the period 1 April 1999 to 31 March 2000, the CPS received 2,417 racist incident cases from the
police. Prosecutions were brought against 1,832 defendants (76 per cent.) on a total of 2,651 charges. Cases against 585 defendants
(24 per cent.) were discontinued, dropped at court or could not be prosecuted because the defendant failed to appear.
Almost half (1,299) of the 2,651 charges were for racially aggravated offences under the Crime and Disorder Act 1998 which came into
force in September 1999. A high proportion of the remaining offences contained admissible evidence of racial aggravation and were
prosecuted under other legislation.
Information kept by the CPS on convictions and acquittals relates to charges rather than defendants. Guilty pleas were entered on 66
per cent. of the charges prosecuted and there were convictions after trial on a further 12 per cent. of the charges. There were
acquittals on 16 per cent. of the charges and the remaining charges resulted in other forms of disposal, eg bindover without trial.

Dr. Julian Lewis: To ask the Solicitor-General what guidance he will give to the Crown Prosecution Service on the prosecution of
motorists displaying the Union Flag on car number plates. [161033]
The Solicitor-General: The size and character of car number plates (properly known as registration marks) and of the letters and
numbers shown on them is governed by the Road Vehicles (Registration and Licensing) Regulations 1971 and the Vehicle Excise and
Registration Act 1994.
There is no provision which specifically prohibits the display of items, such as the Union Flag, on a registration mark. However, an
offence is committed if a registration mark fixed on a vehicle is in any way obscured. This may be as a result of fixing another
item to the registration mark or by simply allowing it to become so masked by dirt as to be no longer easily distinguishable.
The offence can be dealt with only in a magistrates court and is punishable by a fine of up to £1,000. If the police refer evidence
of such an offence to the Crown Prosecution Service, it will be reviewed in accordance with the Code for Crown Prosecutors and, if
appropriate, criminal proceedings will then result.

Mr. Kidney: To ask the Solicitor-General if he will make a statement concerning the decision of the Crown Prosecution Service not to
prosecute any person arising out the death of Colin Griffiths. [160360]
The Solicitor-General: A full investigation into the circumstances of Mr. Griffiths' death was undertaken by the Staffordshire
police. The findings of that investigation have been carefully reviewed by a senior lawyer in the Casework Directorate of the Crown
Prosecution Service. In addition, advice has been taken from experienced, independent counsel. Both have come to the firm conclusion
that there is insufficient evidence for a realistic prospect of conviction against any person arising out of the tragic death of Mr.
Griffiths. Mrs. Griffiths has been informed of the decision and she has also had a meeting with the CPS lawyer during which the
basis of the decision was explained to her.

Solicitor's Department has generally provided a high quality service to the Government and should continue to be an agency. Stage 2
of the review will examine how the agency's performance can be enhanced and improved to meet the increasing demands upon its
services.

Mr. Peter Atkinson: To ask the Solicitor-General when the trials of those accused of serious offences arising from Northumbria
police's Operation Rose will be restarted; and if he will make a statement. [159529]
The Solicitor-General: Operation Rose is a large scale investigation by Northumbria police into allegations of historic physical and
sexual abuse made by former residents of local authority care homes in the counties of Tyne and Wear and Northumberland, dating back
to the 1960s. Operation Rose began in 1997, and the first prosecution was brought in the same year. The first trial of an Operation
Rose case took place at Newcastle Crown court in 1998.
Thereafter, Operation Rose continued, in a number of distinct phases, throughout 1998, 1999 and 2000. The investigation is now
almost complete, and there have been a number of prosecutions during this period.
So far, 27 defendants have been charged with various offences. Nine separate Crown court trials have taken place within the period
from 1 January 2000 to 31 March 2001 and one retrial has taken place.
Of the 27 defendants prosecuted, five have been found guilty, eight acquitted by a jury and two have been found not guilty at the
direction of the judge. Indictments in respect of seven of the defendants have been stayed by the trial judge in three separate
trials, two defendants have died awaiting trial and three defendants are to be tried later this year at Newcastle Crown court.
Trial dates have been set for June and September 2001, in respect of two of the outstanding cases, and it is anticipated that the
trial of the final case will take place before the end of the year, although a firm date has yet to be fixed. No further
prosecutions are anticipated at this time.

Mr. Martyn Jones: To ask the Solicitor-General if he will set out, with statistical information relating as directly as possible to

The Solicitor-General: The Tiverton and Honiton constituency falls within the geographical area covered by the Devon and Cornwall
area of the Crown Prosecution Service (CPS). In November 1999, in line with national policy, CPS Devon and Cornwall, in liaison with
the police and the central Devon magistrates court, introduced procedures based on the Narey proposals. All adult defendants charged
with a criminal offence in central Devon should make their first appearance before Exeter, Tiverton or Honiton magistrates courts
within eight days. Due to the imminent court rationalisation, Tiverton court is due for closure.
A CPS Crown court unit, based in Exeter, deals with serious crime at Exeter Crown court and Barnstaple Crown court. The CPS has set
as a goal the better handling of serious cases in the interests of justice and of victims. From 15 January 2001, a fast-track
procedure was adopted which will ensure that offences which must be heard in the Crown court normally come before a judge within
eight clear days of their first hearing in the magistrates court.
The CPS, together with other agencies, has been working to speed up youth justice, particularly cases involving persistent young
offenders. The time taken for Persistent Youth cases has fallen in the CPS Devon and Cornwall area from 141 days in 1997 to 60 days
in 2000. This places Devon and Cornwall at the top of the national league.
All these changes illustrate the Government's successful policy of speeding up the criminal justice system.
On 30 November 2000, the Exeter office of CPS Devon and Cornwall altered its structure so as to fall in line with proposals in the
Glidewell Review. This represents a policy of more effective working between the police and prosecutors and will enable the CPS to
place greater emphasis on the more serious criminal cases.
Actions and policies of the Treasury Solicitor's Department and the Serious Fraud Office do not directly affect the Tiverton and
Honiton constituency.

The Solicitor-General: Some of the information sought by my hon. Friend is already available in supplementary volumes of the annual
Home Office publication Criminal Statistics England and Wales, which includes a breakdown of case outcomes by offence type.
In the past, the Crown Prosecution Service has held no records in respect of particular offences, and has been able to publish only
aggregate figures on case outcomes. This was because the Service lacked the technical infrastructure required to hold and analyse
the vast quantity of data that such records would involve, and because the administrative burden of maintaining manual records was
prohibitive. However, there are now two important initiatives within the CPS which promise more detailed and informative case
outcomes records for the future.
Firstly, the CPS is conducting a detailed review to ascertain exactly what information on case outcomes is required to manage
properly the prosecution process and to account to parliament and to the public for the standard of its work. This review will
consider, and make recommendations on, their requirement for detail on the outcome of particular offences and offence types.
Secondly, the Service has a new electronic case management under development, named Compass. This will provide the CPS with the
modern technology it needs both to support its core business of reviewing and prosecuting criminal cases, and to make available the
management information identified by the review mentioned above.
Of course, no information system can ever be comprehensive. Even with the most sophisticated computer support, a balance must be
struck between the data we would like, and the costs of collecting and recording those data.
Wider developments in information management throughout the criminal justice system must also be taken into account. The various
criminal justice agencies are working together to develop common systems of data collecting using agreed definitions, with the aim
of providing a fully consistent picture of criminal proceedings from the commencement of the case to its conclusion. This project
should specify criminal justice information needs for the foreseeable future, and manage the transition to fully automated data
collection.

The Solicitor-General: Disclosure of the evidence and all documentation in relation to the case has been requested by, and on behalf
of, Mr. Reddican's family. The Crown Prosecution Service has always indicated a willingness to meet with the family and their legal
representatives to discuss the case.
However, leading counsel for the Crown was asked to consider the question of disclosure, in particular the Human Rights implications
of disclosing all the case papers. He advised that, while the family are entitled to a full debriefing and to reassurance that the
murder of Malcolm Reddican was fully investigated and properly prosecuted, the rights of others must nevertheless be balanced
against the rights of the family.
Indeed national policy of the Crown Prosecution Service is generally to withhold details of decisions in individual cases, since not
to do so would breach confidentiality and might adversely affect the interests and reputations of the parties involved--witnesses,
the victim and the suspect. To discuss publicly a decision not to prosecute could amount to a trial of a suspect without the
safeguards which criminal proceedings are designed to provide.

the Ribble Valley constituency, the effects on Ribble Valley of his Department's policies and actions since 2 May 1997. [157849]
The Solicitor-General: The Ribble Valley constituency falls largely within the geographical area covered by the Crown Prosecution
Service office at Burnley. A Trials Unit has very recently been established there to deal with Crown court casework arising in
north-east Lancashire. This will enable greater emphasis to be placed on the conduct of more serious cases and is part of an ongoing
reorganisation within CPS Lancashire, in line with recommendations of the Glidewell Review.
At Preston police station, a Criminal Justice Unit, staffed jointly by the police and CPS is being piloted. Criminal Justice Units
enable the police and prosecutors to work together more effectively.
At the beginning of November 1999, in line with national policy, and in liaison with police and Lancashire Magistrates Courts
Service, the Crown Prosecution Service implemented the Narey recommendations throughout Lancashire, following a pilot in north-east
Lancashire. All defendants charged with a criminal offence now make their first appearance before magistrates courts in the area
within 48 hours.
The Crown Prosecution Service, together with other agencies, has also helped to draw up an action plan and associated procedures to
speed up youth justice, particularly in relation to persistent young offenders. The latest published figures show that Lancashire
was one of four areas in the country which achieved the Government's target of 71 days or less between arrest and sentence during
the year 2000 as a whole.
Both the Narey changes and the steps on persistent young offenders demonstrate that the Government have successfully speeded up the
criminal justice system.
Actions and policies of the Treasury Solicitor's Department and the Serious Fraud Office do not directly affect the Ribble Valley
constituency.

The Solicitor-General: The aim of review by the Essex police into the fatal attack on Jay Abatan was to examine the conduct of the
investigation by Sussex police officers. The review was commissioned by the Sussex police. The Crown Prosecution Service in Sussex
has not yet received a copy of the review but remain willing to consider any findings relating to the way the CPS dealt with the
prosecution of the case.
I explained in a detailed written answer on 24 May 2000, Official Report, columns 528-31W, when responding to a question put down by
the hon. Member, that the decisions made by the Sussex Crown Prosecution Service were entirely satisfactory, given the evidence
produced by the initial police investigation. I am willing to reconsider that conclusion in the light of any findings of the review.
Sussex police have appointed a new investigation team. Consistent with this fresh start, the Chief Crown Prosecutor for CPS Sussex
made arrangements for a senior lawyer from Hampshire Crown Prosecution Service to deal with any prosecution which may result from
the new investigation.
