My Department has not carried out such an assessment.
My Lords, the Minister will be aware that my Subterranean Development Bill passed through the House some time ago. At that time, it was determined that there was no need for more primary legislation—only regulation. It was agreed with the officials that they would produce regulations and a report. I am still waiting for that. Can the Minister tell me where that report is?

I pay tribute to my noble friend for his Private Member’s Bill in this respect. He is quite right; my understanding was certainly that guidance has been reviewed since his Bill, particularly on party wall issues. I will take back the issues he raised about not knowing whether the guidance has been issued. Certainly my understanding is that the party wall policy has been reviewed following that Bill.

My Lords, the Government have made it clear that payday lenders should make loans only to those who can afford to pay them back. From April 2014, the Financial Conduct Authority will require lenders to undertake thorough affordability assessments to ensure that borrowers are able to make sustainable repayments. No later than January 2015, the FCA will cap the cost of payday loans so that borrowers in financial difficulty do not face spiralling debt.

If my noble friend wanted, for example, to take out a payday loan for £1,000 to cover him over the Recess, what would the rate of interest and repayment be over a matter of a few weeks?

The use of computer systems to make marketing calls is already prohibited under Regulation 19 of the Privacy and Electronic Communications Regulations (PECR) 2003, unless the recipient has consented to receive them. The Information Commissioner’s Office (ICO) is responsible for enforcing the PECR and the Government would expect the ICO to tackle effectively any breaches of the regulations.
The Minister for Culture, Communications and the Creative Industries met with the ICO, Ofcom and the Telephone Preference Service (TPS) to press for action
in this area. As a result, measures have been introduced that will provide more effective protection for consumers. The ICO has since increased the resources devoted to enforcement of PECR, and on 1 October 2012, announced its intention to issue fines totalling over £250,000 to two illegal marketers responsible for distributing millions of spam texts. The ICO also intends to publish, on its website, a list of the most complained about companies that make calls to TPS registered consumers. If the companies fail to remedy their actions, then they could face further enforcement action.
Where a computer-generated call ends up as an abandoned silent call, then this is also prohibited, and such breaches are regulated by Ofcom. In April this year, Ofcom fined a company £750,000 for making abandoned and silent calls. Ofcom also has an ongoing enforcement programme, through which it monitors complaints and takes action.
In addition, to improve access to information for complaints, Ofcom set up new website pages on 1 October at: http://consumers.ofcom.org.uk/tell-us/telecoms/privacy that provide clearer advice on nuisance calls, texts and e-mails and it also published a new Consumer Guide, which provides clearer information and signposts the correct place to make a complaint: http://consumers.ofcom.org.uk/2012/10/tackling-nuisance-calls-and-messages.

Under the Privacy and Electronic Communications Regulations (PECR) 2003, citizens are protected from receiving such unsolicited telephone marketing calls, through the Telephone Preference Service (TPS). The Information Commissioner's Office (ICO) has enforcement responsibility for the regulations and considers complaints about breaches. The ICO can take formal action against those who have wilfully or negligently breached the regulations and can issue civil monetary penalties of up to £500,000 for the most serious breaches. The ICO works closely with the Office of Communications (Ofcom) and the Claims Management Regulator (CMR), which regulates financial companies, to identify those responsible for such calls. Also, the ICO has recently signed a memorandum of understanding (MoU) with the CMR, to facilitate the sharing of information about breaches of the regulations by claims management companies.

It has much significance, not least because of Gethsemane and the Mount of Olives. There is politics in this as well. Will my noble friend tell me what the economic deficit is here? What cost is being incurred by uprooting these olive trees and what is their value?

As we are dealing with newly planted trees, their value is all in the future. However, I am grateful to my noble friend for his reminder of the significance of the olive tree. I am full of admiration for his growing them because I was told that you could not grow olive trees with decent olives north of Valence in France.
