Sir Peter Emery: To ask the Secretary of State for the Environment, Transport and the Regions for what reason part of funding for
hardship relief payments is being met by local authorities; and if he will take steps to ensure that such funding is borne by the
Government. [159369]
Mr. Meacher: Local authorities are required to meet part of the cost of their decisions to grant rate relief to businesses suffering
from hardship to reflect the benefit to the local community. Central Government normally funds 75 per cent. of the cost of granting
such relief. We have increased central Government's contribution rate relief from 75 per cent. to 95 per cent. where relief is
granted to small businesses who are suffering hardship as a result of foot and mouth disease. This increase applies to relief
provided in these circumstances by 151 rural authorities in England, for an initial period of three months.
This remains a discretionary rate relief scheme and it is therefore right that local authorities have a stake in the decisions they
make on the award of rate relief. I am keeping the scheme under review on the basis of evidence of how it is operating and waiting
for across the board evidence on local authorities' position from the Local Government Association.

Ms Quin: [holding answer 2 April 2001]: We are aware that the outbreak of foot and mouth disease is having serious consequences for
many businesses. The Task Force, chaired by my right hon. Friend the Minister for the Environment announced measures on 20 March to
assist businesses affected by the outbreak, such as agricultural suppliers, and alleviate the effects of foot and mouth disease. The
Task Force is continuing to consider the economic impact of the disease and the Department of the Environment, Transport and the
Regions is collecting information relating to this from all parts of the country.

ramblers, (b) the cost of hiring extra wardens and (c) contingency funds for potential legal action involving landowners. [142692]
Mr. Meacher: The duty to draw up maps showing open country and registered common land in England falls entirely on the Countryside
Agency. Local authorities will have an opportunity to comment on draft maps if they wish to do so, but this is not expected to
involve significant cost. The need to appoint additional wardens, where appropriate, to help with management of the new right of
access will arise when the new right comes into effect in a few years' time. A recent study for the Local Government Association
suggested that the cost of managing the new right, including wardening, will be around £1.5 million per year for England and Wales.
We intend to make provision for funding of wardening services through the normal revenue support system for local authorities.
Taking into account the specific functions of local authorities under the Countryside and Rights of Way Act 2000, and the extensive
provision for appeals by landowners to the Secretary of State, we do not consider that there is likely to be any need to make
provision for costs arising from potential legal action.

Sir Peter Emery: To ask the Secretary of State for the Home Department what action he is taking to combat the rise in rural crime,
with special reference to the south-west. [142696]
Mr. Charles Clarke: The British Crime Survey shows that crime levels are significantly lower in rural areas than in urban areas,
with levels of burglary, violent and vehicle crime declining. Nevertheless, tackling crime and the fear of crime in all areas,
including rural areas, remains a high priority for this Government. Our approach in all areas is to assist the police and the local
crime and disorder partnerships to address local crime effectively.
We announced in June that rural police forces were to benefit this year from an additional £15 million from the Police Modernisation
Fund. The allocation to forces in the south-west is as follows: Avon and Somerset, £494,892; Devon and Cornwall £1,554,673; Dorset
£221,858; Gloucestershire £387,093; and Wiltshire £544,900. The money rises to £30 million next year.
This money will make a real difference to policing in rural areas. In addition, we are providing funding for a range of initiatives
and projects in rural areas as part of the Government's Crime Reduction Programme. In Devon and Cornwall, these include £81,000 to
tackle persistent offending in east Devon and £950,000 to tackle alcohol related crime across the force area as part of the Targeted
Policing Initiative; and £367,200 for four projects as part of the Reducing Burglary Initiative.

Ms Armstrong: Standard Spending Assessments already include elements that recognise that there are additional costs in providing

distribution.

include the administrative areas of Plymouth City council, Torbay council and Dartmoor National Park Authority as they will be
covered by the emerging Local Plans of those authorities).
In October 1998, the county council consulted interested parties about the draft Waste Local Plan which contained policies for waste
disposal by landfill. In their response to the consultation, the Government Office for the South-West commented that: The Plan does
not convey a clear sense of the spatial strategy, or of the preferred mix of waste management methods, and there are no specific
development proposals or land allocations, or clear locational guidance. Government policy advises that local plans need both to set
out the authority's policies for the control of development and to make proposals for the development of land and to allocate land
for specific purposes. It is important to confront these issues, because the Plan indicates that important choices will need to be
implemented well within the plan period to 2011. The Plan should therefore make those choices and propose the key developments
necessary to implement them.
The Plan will be deposited for public consultation in the autumn; if a public local inquiry is necessary it is likely to take place
in the autumn of 2001, and the Plan is expected to be adopted in the summer of 2003. The county council will review the Plan every
five years in order to take account of evolving technology, any revised planning policies and new legislation.

Mr. Caborn: The range of assistance available to new and existing small and medium-sized businesses in East Devon, and other parts
of the UK, is included in this Department's "A Guide to Help for Small Business", a copy of which I am sending to the right hon.
Member. In addition, the new Small Business Service will, from April 2001, provide an enhanced service to business in England. There
is also new assistance under the £180 million Enterprise Fund which will provide risk capital to the UK's small companies with
growth potential.

Jane Kennedy: None. Under the provisions of the Justices of the Peace Act 1997 the Axminster and Exmouth magistrates courts are
managed locally by the Devon and Cornwall Magistrates Courts Committee. Decisions concerning closure are for that Committee to
determine, although a contributing local authority may appeal to the Lord Chancellor against a proposed closure. The procedure for
such appeals is set out in section 56 of the Act. In the absence of an appeal the Lord Chancellor has no locus in the matter.

request from Devon county council for dispensation to pay for its redundancy and restructuring costs over a period of years.

Ms Armstrong: Devon county council asked to be allowed to treat these revenue costs as capital expenditure. Such applications are
granted only when we conclude, in accordance with published criteria, that the costs could not be met out of available revenue
resources. My officials have notified the council that, on the basis of the figures provided in January, the criteria are not
satisfied and that consent will not be given.
