Mr. Robert B. Jones: As my hon. Friend is aware, my right hon. Friend the Secretary of State for the Environment and my right hon.
Friend the Secretary of State for Transport issued our decisions on the planning and associated transport matters relating to
Stockton town centre development on 20 February. Those decisions should effectively allow city challenge to proceed with its
redevelopment plans.

Mr. Devlin: To ask the Secretary of State for the Environment what action he proposes to take in the light of the Law Commission's
report, "Landlord and Tenant: Responsibility for State and Condition of Property Law", Com. No. 238. [18377]
Mr. Clappison: I am grateful to the law Commission for its very full and helpful analysis of this area of the law in England and
Wales.
Of the Commission's four main recommendations for change, we agree that the law should be amended so that, in respect of new leases,
etcetera created after the commencement of the new provisions:
there should be implied into every lease, subject to the exceptions listed below, a covenant that the landlord shall keep the
premises in repair, to a standard which is appropriate having regard to the age, character and prospective life of the premises and
to their locality. This would not apply to a lease of a dwelling house for a term of less than seven years; to a lease of an
agricultural holding; to a farm business tenancy; or to an oral lease. Nor would it apply in cases where there was an express
repairing covenant in the lease, or the implied covenant was expressly excluded in the lease. Where the premises which are leased
form part only of a building, and the landlord has an interest in other associated premises within the building, a similar repairing
covenant would apply in respect of the associated premises.
a court should have a power to decree specific performance of a repairing obligation in any lease or tenancy
the law of waste should not longer apply in most cases, and the implied covenant that a tenant will use premises let to him in a
tenantlike manner should be abolished. Instead, an implied statutory covenant or duty should be created by which any tenant or
licensee would undertake to take proper care of the premises, including any common parts of the building; to make good any damage
wilfully done to them by him or by others with a right to be on the premises; and not to carry out works to the property which would
be detrimental to the landlord's or licensor's interest.
The commission also recommended that, with certain exceptions, there should be implied into a lease of a dwelling house for a term
of less than seven years a covenant by the lessor that the dwelling is fit for human habitation at the start of the lease and that
the lessor will keep it fit during the lease. We are not yet able to come to a view on this recommendation, since a review of the
fitness standard is currently taking place.
Once that review is complete, we will resume consideration of the commission's recommendation on fitness of dwellings and, when we
have reached a decision, seek a suitable legislative opportunity for the implementation of the agreed proposals.

Mr. Soames: In addition to her other duties, the West Indian guard ship, WIGS, together with her Royal Fleet Auxiliary tanker, makes
a very considerable and valuable contribution to the fight against drug trafficking in the Caribbean. WIGS has in recent years been
directly involved in the interception of substantial amounts of illegal drugs in the region.

Sir Paul Beresford: Of the planning applications considered by the Teesside development corporation, since it was established in
1987, 14 were opposed by either Cleveland county council or Stockton borough council. Of these, 12 were approved by the corporation
and have led to the creation of an estimated 3,480 jobs, with a further 500 expected to be provided in due course. Two applications
were not approved.
These applications, and the estimated numbers of jobs created by each project are as follows.

Sir Paul Beresford: Since 1987, Stockton borough council has opposed three planning applications initiated by Teesside development
corporation. The applications were for developments at Teesside retail park, phase 2, the Rowing Course at Teesdale and a fenland
village at Cowpen Bewley. Cleveland county council also opposed the Teesdale retail park phase 2 development.

Mr. Devlin: To ask the Secretary of State for the Environment if he will make a statement on the work on (a) the Teesside
development corporation and (b) Stockton city challenge. [11873]
Sir Paul Beresford: The Teesside development corporation was established in 1987 and will be wound up in March 1998. The corporation
estimates that during its lifetime it will have achieved:
the reclamation of 525 ha of derelict land;
the building or upgrading of 29 km of roads;
the building of 1,400 homes;
provision of 470,200 sq m of non-housing floorspace;
the attraction of £1,090 million of private sector investment;
the creation of over 11,000 permanent jobs in new developments, and over 26,000 job opportunities.
The development corporation has already made substantial progress towards these targets. Its activities are successfully
transforming large areas of dereliction around Hartlepool, Middlesbrough and Stockton into exciting and attractive developments
which are providing jobs, homes and leisure opportunities. Stockton city challenge partnership currently estimates that, during the
lifetime of the initiative, it will:
create 3,400 jobs;
lever in £111 million of private sector investment;
build or improve 4,928 homes;
support 291 new business start-ups;
and provide 81,300 training weeks.
The operation of the city challenge in Stockton has also helped forge closer working relationships between the public and private
sectors and the local community.

Mr. Kirkhope: On 12 November, we issued revised proposals on expanding the list of casino permitted areas. The consultation period
ends on 31 January.

Mrs. Angela Knight: Total employment in autumn 1996 was almost 300,000 up on a year earlier, 900,000 million higher than at the end
of 1992, and 1.5 million higher than at the end of 1979. Our impressive record on job creation means that, at 69 per cent., we have
a higher proportion of our working age population in work, and a lower unemployment rate than any other major EU country.

Sir Paul Beresford: The Secretary of State received the report of the inspector who conducted the public inquiry on 3 June 1996, and
is considering it. Following receipt of the report, he was asked to re-open the public inquiry by one of the non-statutory objectors
to the compulsory purchase order, and this required some further consultation with the parties involved in the inquiry. Those
consultations are now complete and are also being considered. The decision will be issued as soon as it is practicable to do so.
