Mr. Sykes: To ask the Secretary of State for the Environment what performance targets he has set for the Planning Inspectorate agency for the financial year 1997-98. [20804] Mr. Robert B. Jones: I have today set key targets for the Planning Inspectorate in England in furtherance of the dual objectives of securing improved efficiency, and safeguarding the impartiality and quality of the agency's work. These targets form part of the phased programme of performance which I initiated last year. The targets for 1997-98 are: Timeliness (a) 80 per cent. of all planning appeals decided by written representations to be determined in 20 weeks, reducing to 18 weeks by 1998-99; (b) 80 per cent. of all planning appeals decided by hearings to be determined in 33 weeks, reducing to 24 weeks by 1998-99; (c) 80 per cent. of all planning appeals decided by inquiries to be determined in 44 weeks, reducing to 36 weeks by 1998-99; (d) to provide an inspector for 80 per cent. of local plan inquiries on request within 26 weeks of the end of the objection period, and to deliver 90 per cent. of inspectors' reports to local authorities by the dates agreed in service agreements; Financial (a) unit costs of planning appeals decided by written representations not to exceed £690; (b) recover 90 per cent. of receipts within eight weeks of invoice date; Efficiency generate a 3 per cent. efficiency improvement in the use of running costs compared with 1996-97; Quality to satisfy the Advisory Panel on Standards, and thus the Secretary of State, annually and following rigorous monitoring, that the quality of the inspector's work is being maintained at a high standard with 99 per cent. of its casework free from justified complaint; Information and guidance to carry out a customer satisfaction survey of the quality of Inspectors' reasoning in decision letters.

Mr. Sykes: To ask the Secretary of State for the Home Department if he will make a statement on the provisions on the retention of case papers in the code of practice prepared under the Criminal Procedure and Investigations Act 1996. [18375] Mr. Howard: I published a draft code on 4 July 1996 for consultation, modified it in the light of representations received, and laid it before Parliament on 18 December. The draft code required each chief police officer to develop his own policy on the retention of case papers, taking account of certain specified criteria. I receive representations that the code should prescribe a national policy on this issue so that each police force followed the same practice. The version of the code which he laid before Parliament on 18 December contains a national policy in that it requires each police force to retain all material obtained by the police in the course of a criminal investigation which might be relevant to the investigation at least until the conclusion of the trial; and if the case resulted in a conviction following a not guilty plea, to retain the material for a further minimum period of one year following summary conviction or three years following conviction on indictment. At present, police forces are not subject to any statutory requirement to retain material for any specified period. Each police force has its own policy and there is no common practice. The effect of the provisions in the code is to increase protection for defendants by inserting a statutory minimum retention requirement where none exists at present. These provisions leave untouched the current ability of the police to retain material for any length of time beyond that. In very serious and high-profile cases, I would expect the police to continue to retain material for a long time, as they have tended to do under the informal arrangements which currently exist. Nevertheless, in the light of concerns expressed recently about these provisions, I have concluded that the interests of justice would be better served by an alternative set of requirements. Accordingly, I intend to amend the code of practice so as to require the police to retain material at least until the end of the trial and then, in the event of a conviction, either until the convicted person is released from custody, if the court imposes a custodial sentence, or until six months from the date of conviction, if the court imposes a non-custodial sentence. Where a convicted person is given a short custodial sentence and would be released within six months of conviction, material would still have to be retained for at least six months. If an appeal is in progress at the end of one of these periods, or an application is being considered by the Criminal Cases Review Commission, the period will be extended until the appeal is concluded or the commission makes a decision on the application. I will lay an amended code of practice before Parliament today.

Mr. Sykes: To ask the Secretary of State for the Environment what plans he has to encourage local authorities to assess levels of rough sleeping in their areas and to develop strategies to tackle any problem that they identify. [16303] Mr. Curry: Under the rough sleepers initiative, my Department has encouraged and assisted head counts of people sleeping rough in a number of areas. Following the Government's announcement in March 1996 that it would continue the rough sleepers initiative in central London and extend it to Bristol, my Department commissioned Shelter to co-ordinate evaluations of the level of rough sleeping in 23 areas where some evidence of a problem had been mentioned in consultation with local authorities and other statutory and voluntary sector agencies. The evaluations were conducted during June and July 1996 and Shelter's report to the Department informed the Government's decisions, announced on 31 October, Official Report, column 187, to expand the rough sleepers initiative in London and extend it to Brighton; and to offer financial support from a new rough sleepers revenue fund for strategies to tackle rough sleeping in 10 other areas. As part of that announcement, I said that the Department would publish guidance to help all local authorities to assess the extent of rough sleeping in their areas and to develop effective strategies to help people sleeping rough. I am pleased to announce publication today of that guidance, which is being made available free to all housing authorities and voluntary sector agencies working with people sleeping rough. Copies have been placed in the Library. My Department's housing strategies guidance to local authorities advises them that they should aim to make it unnecessary for anyone to sleep rough within their area and that they should aim to provide a strategic framework of assistance covering all the agencies involved in meeting the needs of single homeless people, including people sleeping rough. That guidance advises local authorities to consider undertaking a count of rough sleepers to assist in assessing local needs. I hope local authorities for areas in which rough sleeping problems exist will make use of the more detailed guidance published today. The Government will consider extending funding under the rough sleepers initiative and the rough sleepers revenue fund to areas where the guidance has been followed, where major rough sleeping problems have been demonstrated, and where local authorities take a lead in developing joint statutory and voluntary sector strategies to tackle rough sleeping.
