My Lords, dignity and respect are the cornerstones of good-quality care. The Government have made the Care Quality Commission responsible for assuring quality of care. It is the responsibility of local authorities to specify and commission care and providers to deliver it. The Government’s planned reforms for health and social care, with an emphasis on better commissioning, should increase our ability to drive up standards in services and result in improvements in quality of care.

My Lords, I thank my noble friend the Minister for his reply. However, is he aware that a large proportion of the responses to the interim report from the Equality and Human Rights Commission have come from the care workers themselves who feel that in present circumstances they are simply unable to provide care that provides dignity to the older people in their care? Can he assure this House that in those reforms that are going forward, measures will be taken to make sure that local authorities must commission services that allow real dignity, which probably means rather longer passages of care for the people concerned?

My noble friend makes some extremely important points and I agree with the thrust of them. As she said, these are interim findings. We all look forward to the finished report later in the year, which will no doubt contain deeper analysis than we have had access to so far. There can be no place for poor-quality care in care services. We should all welcome an inquiry of this kind because it clearly will expose poor practice and will point the way towards some clear messages that we must bear in mind in the context of the Health and Social Care Bill. In that context, we are seeking to achieve much more joined-up commissioning so that we have health and social care working together towards quality outcomes.

Given the news that we are now to have a new contractor, Reliance, conducting these deportations, perhaps I may ask whether its contract will spell out in greater detail than hitherto what control can be used, and, indeed, whether the individual staff members will have to sign up to a code of practice. I think that that would give the House considerable reassurance.

The noble Baroness raises some of the absolutely pertinent issues which our further review needs to take into account. I cannot comment precisely on the contract of the company that will be employed in addition to G4S but I think it fair to say that the Government feel they need to look at all aspects of the services provided. They need to start with the contract and go right through to what happens on the aircraft.

My Lords, the vast majority of people who are being removed from this country depart voluntarily. There is a small category of people who resist. It is known policy that escorts may be used to control and restrain such individuals and that these techniques are accredited by the National Offender Management Service.
Following the death of Mr Mubenga, the UK Border Agency temporarily suspended the use of control and restraint on scheduled flights for a 10-day period between 15 and 25 October. That was for the purpose of carrying out an immediate review to see whether the techniques used on the aircraft were appropriate.
The use has been reinstated. The National Offender Management Service, which conducted this review, has said that there is no substantiation to the claims that have been made that the restraints being used were inherently dangerous. We are now going on to conduct more investigation of the appropriateness and utility of restraint. We do not believe that we have anything like achieved the last word. So I can assure the House that this issue, which I know is a matter of anxiety to us all, will be taken forward and that we are examining what needs to be done very thoroughly.

My Lords, it is indeed the case that the noble Baroness, Lady O’Loan, reported in March this year and all her recommendations are being put into effect. As she reported at the time, she found no evidence of systematic abuse by the UK Border Agency.

My Lords, the circumstances of Mr Mubenga’s death are the subject of police investigation. A Prisons and Probation Ombudsman investigation and a coroner’s inquest will also take place in due course. Escort staff receive training on issues such as welfare, first aid, use of force and restraint. Prior to a removal, escorts are provided with a risk assessment of the individual, which will include known facts on medical conditions, the risk of self-harm, the likelihood of any attempt to escape and known criminal activities or violent behaviour.

My Lords, does the Minister agree with the Nuffield report that, instead of the risk assessments that are made in care services on a regular basis, we should be looking toward risk-and-benefit assessments, so that people with dementia get some chance to practise everyday activities? In Holland, for example, they do things such as making their own beds, instead of being told that it is unsafe, which is the British practice.

I thought that that was also an important part of the report. The report points to, for example, filling in a pond in a care home, which had given enormous pleasure to people, because of the risk. The noble Baroness is absolutely right. Overall, the Government are taking this report very seriously indeed. It has messages not just for us and how we deal with the dementia strategy but for all professionals and people who are dealing with people with dementia.

My Lords, as somebody who has benefited indirectly from compensation paid by Germany to my mother, who was a refugee, I know that it made an enormous difference to how she felt about the land of her birth, although she was a very proud British citizen. Will the Minister assure the House that today, which is the 20th anniversary of democracy in Poland, he will make representations to the Polish Government, as we have heard that there will be legislation next year or later this year—we have heard that before—that this Government hope to see the relevant legislation passed in Poland?

The saving gateway aims to initiate a saving habit among working age people on lower incomes, and to promote financial inclusion. Eligibility will be passported from entitlement to certain benefits and tax credits, which have been selected to target working age people on lower incomes, and so do not include pension credit.
I refer the noble Baroness to my comments during the Second Reading of the Saving Gateway Accounts Bill on 17 March 2009 (House of Lords, Official Report, cols. 120 and 137).

My Lords, our approach to alleviating pensioner poverty, which was kick-started in 1997, was to concentrate on the poorest first via the pension credit system. That has produced significant improvements in the lot of pensioners overall. We are now spending £13 billion more on pensioners than we would have done if we had simply rolled forward the policies that we inherited. In 1997, the poorest pensioners lived on £69 a week. Now, with the uprating of the guarantee credit, the minimum for an individual is £130 a week and £198 for a couple. Significant progress has been made, but we need to continue to ensure that we build on that.

My Lords, before I address the noble Baroness’s second question, I must say that it is imperative to understand that no one, irrespective of age, should tolerate pain. I appreciate that awareness in this area is extremely important, because we are living in a century when all of us are getting older and, at the same time, there is a suggestion that pain is a symptom of ageing, which it is not. As far as concerns age discrimination, older people deserve to be treated with dignity and respect in all care settings. That is why the Government are bringing forward the equality Bill that includes a commitment to end unfair discrimination in the NHS.

My Lords, as a clinician, I agree that the assessment and management of pain should be at the heart of all good clinical practice. I therefore welcome this report, which sets out the important issues relating to pain in later life and reflects older people’s experiences. It will raise awareness of important issues among those responsible for meeting effectively the healthcare needs of their local population.

My Lords, the noble Baroness makes a very good point. A number of young people with severe mental problems are indeed being admitted to custody and young offender institutions, for example. I know that the staff there spend a great deal of time working with them and attempting to ensure that they are transferred to age-appropriate environments. I do not have the figures, but I will let the noble Baroness have them. However, I know that that is what is happening in those institutions.

However, given that all the evidence shows that both availability and price of alcohol are the key factors in binge drinking, this is not so much a matter for doctors as for government. Will the Government now consider introducing new laws, as recommended by that report, to regulate promotional activities on alcohol and ensure that both licensed premises and off-licences no longer sell alcohol as loss leaders?

My Lords, I thank the noble Baroness for that question. The Government are working with the alcohol industry and other stakeholders to implement a strategy which includes a new public information campaign, an independent review of alcohol pricing and promotion, toughening enforcement for under-age sales and helping more people who want to drink less. Reducing alcohol-related hospital admissions is a new measure of performance for the NHS. We believe that this will encourage more NHS investment to identify those most at risk and provide advice and treatment. However, this strategy is not about preaching to or hectoring people. It is important that people have the necessary information to make their own decisions about the health consequences.

My Lords, given the agreement around the House that spirituality plays a major role in the mental illness of some people in some of our hospitals and in our communities, can the Minister tell us what the Government will do to ensure that there is further training in spirituality of all faiths for those working in mental health? My Lords, the noble Baroness is absolutely correct and would certainly be familiar with this. Psychiatrists, patients and carers should all be fully informed about local chaplaincy services, and know that they now involve clergy and other personnel from many faiths and humanist organisations, as well as several Christian denominations. Chaplains have made a point of establishing good relations across the field. Close liaison with mental health teams will support a holistic approach in this area.

My Lords, I welcome the BMA’s useful report. Tackling the culture of harmful and binge drinking is a priority for the Government, and we are implementing a comprehensive strategy. The report will encourage doctors to play the key role of identifying harmful drinking at an earlier stage.

My Lords, work is already under way on the assessment and diversion of those with mental health problems. We are also working on a training programme to improve mental health awareness throughout the criminal justice system. The review by my noble friend Lord Bradley will consider the recommendations of the excellent report by my noble friend Baroness Corston. His review will look at the diversion of women offenders, as well as of children and young people.

My Lords, my right honourable friend the Secretary of State for Justice has asked my noble friend Lord Bradley to review all the ways by which offenders with mental health problems are diverted from prison to other services. He will look at barriers to such diversion and has assured me that the mental health treatment element of the community orders will be included in his review, which he hopes to complete this summer.
