My Lords, one of the five organisations that I was able to announce yesterday that the Government are funding to deal with target groups and vulnerable groups is Mencap. We ask Mencap in particular to have regard to that.

My Lords, clearly this is a different assessment that measures different things. However, we are learning lessons from the WCA, and noble Lords will know that we are making considerable changes to it to make sure that it works as effectively as possible. We also expect to make sure that the personal independence payment is focused on the needs of the individual. The assessment is much more appropriate than the DLA assessment, which is, frankly, subjective and inconsistent and relies much too much on self-assessment.

But is she aware that, ever since the Welfare Reform Bill was tabled, certain inflammatory reports have appeared in a number of the media alleging that people on disability benefits are scroungers and layabouts? Does she agree that such inflammatory language can lead only to more disability hate crime? What can the Government do to ameliorate this matter?

My Lords, the noble Lord, whose record in this area, particularly his long and distinguished association with Mencap, is respected throughout the House, raises an important point. Grouping people with disabilities together in a generic way is of itself a problem. Beyond that, it is important that as a society we start to recognise disabilities right across the spectrum, particularly those that the noble Lord has been such a good advocate for—those relating to learning difficulties and communication disorders where often the disability itself is not evident on first sight or first meeting. The noble Lord will know that I have taken a close interest in autism for the past 40 years and I have often described the disability as an iceberg—a third above the surface and two-thirds below. That two-thirds below the surface of the disability is as important as what people see on first sight.

My Lords, hate crime, including that targeting a person’s perceived disability, is an issue that the Government take very seriously. That is why the coalition’s programme for government included a commitment to improve the recording of such crimes. We are also working with the police and others to increase the reporting of hate crimes against disabled people and on ways of identifying repeat victims more quickly.

In that statement, were the Government including the 80,000 people with disabilities living in residential care who are going to lose the mobility component of their DLA, or were the Government simply thinking that such a valuable aid to so many vulnerable people was a total waste of taxpayers’ money?

My Lords, we are taking a very close look at the mobility requirements of people in residential care. The existing arrangements are pretty patchy; the payments are used for different purposes in different places and are often pooled in a way that they are not designed for, in a very complex regulatory framework. We will be looking very closely, as part of the consultation exercise, at what the best form of support should be for people in residential care in this way.

My Lords, the Government's strategy is to go down the path of personalisation of services, on which we clearly look to local authorities to take the lead. As the noble Lord pointed out, we have made £2 billion extra available. In practice, local authorities have much more than that available and it is up to them to make sure that the funds go to those with disabilities in the most effective and efficient way.

The point about the pupil premium is that it is linked to deprivation. As we all know—no one better than the noble Lord, Lord Rix—there is a lot of overlap between children with SEN and children with deprivation. The key point is that the pupil premium is intended for deprivation.

What advice can the Minister offer people with a learning disability, who might find that they can no longer pay rents, which are increasing all the time, particularly in the London area? My Lords, the Government are fully aware that some people will have to make adjustments in their living arrangements. That is why we have put a large amount of resource into helping that transition process. The current figure, which we announced last week, has been increased by another £50 million to a total of £190 million over the SR 2010 period.

My Lords, I thank the Minister for his response, but I would ask for a few more details. The home access programme, as I am aware, ceases to be funded after March 2011. Can the Minister guarantee that it will continue beyond that time? On the question of local authorities being made more responsible for technological services for people with disabilities, is he aware that the House of Lords’ ruling some time ago has meant that local authorities can take resource implications into account when considering their duty to provide support? So, if they are short of funds, which they are likely to be at the moment, a disabled child can literally be without a voice. Is that the Government’s wish?

No, my Lords, it clearly is not the Government’s wish that that should happen. On the noble Lord’s first question, as the whole House will know, I am not in a position to give forward commitments on funding, because we have to go through the spending review first. However, as I think the noble Lord will know, because my honourable friend Sara Teather announced it at the launch of a campaign with which I think he was associated, there will be a Green Paper in the autumn particularly to do with children with special educational needs and disabilities, and the raising of educational attainment is one of the specific issues we want to look at in connection with that. I am sure that he will make representations on that. I completely accept the thrust of his question, that as we look at what will come after Becta, we need to make sure that absolute priority is given to ensuring that children with special educational needs get the help with technology that they need.

My Lords, the Government are committed to supporting those with special needs. This is demonstrated by our commitment to the full assistive technology package for those with special needs, as part of the home access programme. As we manage the closure of Becta, we will work closely with it to ensure that appropriate frameworks continue, and we will of course look with particular care at the requirements of those with special educational needs and disabilities.

My Lords, I congratulate the noble Lord on the leading part that he has played in the powerful campaign around Changing Places. There is a process for changing the building regulations, which generally occurs when looking at a range of issues that might need to be taken into account. There is a process around consultation and research before that can be fully implemented. Currently, it is expected that the review of Part M of the building regulations will not be completed until 2013.

My Lords, as well as the Changing Places campaign being highlighted in last year’s Improving Public Access to Better Quality Toilets—A Strategic Guide, and this year’s revision of British Standard BS8300, which includes for the first time guidance for such toilet facilities, a review of Part M of the building regulations on access to and use of buildings will begin this year, and will consider the possible inclusion of Changing Places facilities.

My Lords, as the noble Lord has mentioned, we entered a reservation with regard to mental capacity issues. We did that because, although we have a system in place where people can be supported and appointed to receive benefits on behalf of others, we do not have a formal review procedure. We need to do that to be compliant with the convention but, as we have stated and made clear, we intend to introduce that system. Regrettably, it cannot be done overnight because a number of people are involved with this; it could take some two years. However, we are intent on removing the reservation as quickly as we can.

My Lords, is the Minister aware that in 2007 to 2008 there were approximately 7,000 prosecutions for racially motivated crime and yet only 141 prosecutions for disability hate crime? My Lords, I hesitate to say that they do not take it as seriously as other hate crimes; I think that they do. One thing that is absolutely true is that we have not collected the statistics as well or as accurately as we should. We are now resolving that. It was done on an intelligence basis through ACPO. I do not think that the numbers of crimes that were seen as hate crimes against the disabled accurately reflected the full scale of what was happening. I will give an example, because some of these incidents are so horrible. Steven Hoskin, who had learning disabilities, was assaulted by three individuals, who made him wear a dog collar, fed him an overdose of painkillers and forced him to fall off a viaduct to his death. These are the sort of appalling things that are done. It is absolutely right that we should focus on this and the statistics do not show the scale of it. We are getting to grips with those statistics and we absolutely must do more about it.

My Lords, I am pleased to inform the noble Lord that the Green Paper, which will be with us in June, will lay out a series of options for reforming the care and support system to ensure good quality and cost-effectiveness. The paper will outline funding systems that are sustainable and affordable for individuals and the state. It will be the start of a dialogue that is of great concern and interest to the noble Lord and many others in the House. That dialogue will then lead to proposals on how to take this forward.

My Lords, because of the noble Lord’s intimate involvement with Mencap over many years and his personal knowledge of this subject, I take his concerns very seriously. In September 2008, we made a commitment to put a statutory duty on schools to record incidents of bullying. Of course, the noble Lord is suggesting that the records of those incidents should reflect the cause. We will consult very shortly on the nature of that guideline and, in particular, will consult organisations such as Mencap and other members of the disability lobby.

My Lords, the Access to Work budget is a hugely important component of the Government’s support for disabled people. The budget has already been increased from £15 million in 1994-95 to £69 million in 2008-09, and we have agreed to double it. The proposal, I believe, is to do that incrementally through to 2013-14, by when it is anticipated that the budget will help some 48,000 people access and keep employment.

That often means that the parents have to give up work to take over the job of full-time carers. Does the Minister believe that the £60 payment in January, offered in yesterday’s PBR, will ameliorate this dire situation?

My Lords, as the noble Lord is aware through his work, it is not the only payment that families receive to support them with their disabled children. A whole range of support and services should be available to them. It is important that families use the systems that are effective in making sure that those services are available to them. It is important that they use the information services and that they challenge local authorities where they think that services are inadequate.

My Lords, the noble Lord raises an important point. If one looks at the overall employment rate and its composition, one sees that disabled people, lone parents and ethnic minorities do not reach the average rate that applies for the rest of the economy. It is certainly right to say that people with learning disabilities have not made the progress that we would wish. That emphasises to me the need to continue to reinforce and entrench those active labour market policies to make sure that we engage with employers through local employment partnerships and city strategies and encourage them to take advantage of the funding streams that are available. In these challenging times, we should not take our foot off the pedal of those important and progressive reforms.
