That this House notes the conviction on 19th July of Lord Archer of Weston-Super-Mare for perjury; recalls that when news of the purchase of shares in Anglia TV by Lord Archer in January 1994 first appeared in the press he stated, It is completely untrue. I did not buy any shares. That sort of accusation is libellous; further recalls his statement in the Evening Standard of 9th June 1994 that the inspiration for the share purchase came from a discussion at a dinner party at the home of Sir Nicholas Lloyd; notes that Sir Nicholas subsequently stated that the dinner party in question took place on 18th January 1994 after the share transactions, which netted a profit of ??77,219, had taken place; also notes that inspectors investigated allegations of insider-dealing on two occasions in 1994 and 1996 but concluded there was no evidence on which a prosecution could be founded; regrets that reports made under section 177 of the Financial Services Act 1986 into allegations of insider-dealing are never published; records that no Minister in the present Government has seen these two reports but advice to Ministers from officials in 1998 stated that no useful purpose would be served by re-opening the investigation; further notes that it is usual practice for transcripts of interviews between inspectors and witnesses to be made available to the latter to allow for corrections; and believes the relevant provisions of the Financial Services Act 1986 should be amended to allow for the publication of witness statements where a witness is subsequently found guilty of a serious criminal office; and invites the Secretary of State for Trade and Industry to consider whether a conviction for perjury constitutes 'fresh new information' which would warrant re-opening the investigation.

That this House recalls that on 13th January 1994, Lord Archer purchased the first of two tranches of Anglia TV shares and notes his statement in July 1994 that it was completely untrue that he bought shares and that such an accusation was libellous; notes that he subsequently confessed that he had made a grave error in buying shares and his later statement that the Department of Trade and Industry report completely exonerated him; condemns his unwillingness to reply to letters about these issues from the honourable Member for Pendle; calls on the noble Lord to explain why he bought shares on behalf of Mr Broosk Saib, why he was confident the share price would rise, why he asked for the transaction to be done on new account dealing terms, whether the shares were to be held as a long-term investment and, if so, whether the noble Lord or Mr Saib would pay the ??240,000 for the shares on settlement day; and calls on the noble Lord to follow the injunction of the Chairman of the Conservative Party who said in September that it would be better for the noble Lord to speak out rather than not.
