The following amounts have been paid in the UK by the Foreign and Commonwealth Office (FCO) and its agencies to the following companies over the past five years. Information regarding spend with those companies by our posts overseas is not available centrally and is only available at disproportionate cost. FCO paid PricewaterhouseCoopers £6,228 in 2004-05, £254,446 in 2005-06, £384,197 in 2006-07, £313,299 in 2007-08, and £341,287 in 2008-09; KPMG £41,918 in 2004-05, £139,536 in 2006-07, £135,733 in 2007-08, and £1,701,658 in 2008-09 (in connection with the vital upgrading of FCO's secure international communications system); Deloitte £13,353 in 2004-05; Ernst and Young £44,148 in 2008-09; PKF £13,113 in 2005-06, and £8,948 in 2006-07; McKinsey and Company £111,625 in 2005-06; and Accenture £65,393 in 2005-06. FCO Services, an Executive Agency of the FCO operating as a Trading Fund since 1 April 2008, paid PricewaterhouseCoopers £38,008 in 2007-08, and £111,186 in 2008-09; and KPMG £128,912 in 2007-08, and £24,320 in 2008-09. For all other years and firms the figure is nil. Total consultancy spending at end December 2009 was £17 million and is tracking at just over £22 million for this financial year—about 1 per cent of the overall FCO budget. The figure for consultancy spending in 2008-09 was £29.9 million. So overall our expenditure on consultancy is falling. Contracts were awarded on the basis of supporting key government initiatives and were the result of rigorous competitive tendering processes conducted in strict accordance with the Office of Government Commerce guidelines, making best use of existing framework agreements. Annual expenditure on consultants is published each year in our annual departmental report, copies of which are available in the Library of the House and on our website. Departmental contract managers within the FCO manage the day to day contract performance and delivery in line with best practice. Departments are not required to report spend data to Buying Solutions, although we periodically provide information to it on request to assist with its audit requirements.

Details of the amounts paid to the named companies by the department and its predecessors in each of the past five financial years have been placed in the Library of the House. Contract monitoring regimes will be determined on a case-by-case basis. The department may choose voluntarily to provide feedback to Buying Solutions but is under no obligation to do so. From the best available management information the Home Department and its executive agencies spend with each company for the period 1 April 2004 to 31 March 2009 is shown in the attached table: All figures provided are subject to accounting adjustment and amendment. The performance of firms under contract to the Home Department is monitored by means of assignment management by the relevant commissioning business areas. Delivery against associated project and programme objectives is managed as part of standard project and programme management practices within the Home Office. The Home Office participates in OGC and Buying Solutions-led forums, programmes, and oversight boards to confer on the performance both during and after assignment of firms and services contracted under Buying Solutions commercial arrangements. In answer to the second part of the Question, contracts are monitored in various ways to ensure delivery of the service and value for money. It is for each department to manage its contracts and the amount of time and intervention required depends on the complexity, risk and cost of the work to be undertaken, allied to the specific details contained in the contractual arrangements. A number of staff will typically be involved, such as business owners, technical specialists and contract/commercial managers. Buying Solutions has put in place a number of framework agreements for use by government departments and the wider public sector, and provides information to departments on their use. These agreements have standard terms and the relevant business area will monitor delivery of the requirement with support of contract managers as required. Reports on all contract activities are not issued as a matter of course to Buying Solutions.

For the Department of Culture, Media and Sport, contracts with the organisations used are either managed by a contract manager or a project manager dependent on the nature of the work and its duration. End-of-contract reports are sent to the procurement team to establish that the work has been carried out to an expected level of delivery. For the agency Royal Parks, the contracts listed were short term and monitored through regular TRP/consultant meetings. There are no reports made to Buying Solutions during or at the end of the contract unless there have been exception reports raised during the use of the supplier for either good or poor performance. The Department for Children Schools and Families and its predecessor department paid £16.5 million to the above-mentioned firms over the past five years. The department does not hold the requested information for its associated bodies, as they are independent and are responsible for their own data. Management and monitoring of contracts are undertaken by the individual business units supported by comprehensive contract management guidance available on the department's intranet. Information on how individual contracts are monitored is, therefore, held by the individual business unit and not collected or retained centrally. However, for central DCSF Management Consultancy Frameworks, which covered the period up to the end of March 2008, a feedback form was used to gather information on the performance of the organisation. This form was issued to individual business units at the end of each contract and requested feedback about the performance of the organisation. Organisations awarded DCSF Management Consultancy Frameworks from those listed were: (a) PricewaterhouseCoopers, (b) KPMG, (c) Deloitte, (j) PKF, and (l) Accenture. Reporting to Buying Solutions during or at the end of a contract would be the responsibility of individual business units, although there is no formal requirement or process for such reporting. To gather this information would be at disproportionate cost.

Figures above cover the Ministry of Justice HQ, HM Courts Service, HM Courts Service Estates and Tribunals Service in both years. The 2008/09 figures include the National Offender Management Service (NOMS) and the 2007/08 figures are for its predecessor agency, HM Prison Service. Both years’ figures exclude probation boards and trusts. Any expenditure incurred by headquarter functions transferred to MoJ from the Home Office are excluded up to November 2008 as expenditure is recorded on Home Office systems and can only be disaggregated at disproportionate cost. The Office of the Public Guardian (OPG) has used none of the companies mentioned. Consultants are employed by the department to provide expertise for a defined period of time that is not available in-house. * The majority of payments to Accenture relate to the development of the Libra, an electronic case management system that enables courts across England and Wales to work in a standard way, using a consistent approach to manage their criminal, accounting and enforcement workload. It also provides a platform to enable further improvements and modernise money handling in magistrates' courts. Having one system has also improved information exchange between the courts and criminal justice partners such the Police, the Driver and Vehicle Licensing Agency and the Office of Criminal Justice Reform. This has led to a reduction in duplication of work and has enhanced services to court users, improving scheduling and monitoring of cases. ** The payments to PriceWaterhouseCoopers include £3.8 million in respect of rent and service charge payments for offices and car parks in the Midlands. How we monitor contracts with these firms In relation to engagement of external professional services, the Ministry of Justice (MoJ) operates a robust "business case" approvals process based on Office of Government Commerce best practice principles. This process requires that a named Contract Manager be assigned by the business area concerned to each contract. Their role is to manage the day-to-day delivery and operation of the contract, for example by monitoring and ensuring the quality of all deliverables, monitoring spend against the pricing schedule and ensuring appropriate skills transfer (where applicable). The role of the Contract Manager is fully supported by the MoJ Procurement Directorate’s Professional Services category management team. Professionally qualified category managers are on hand to assist with and/or manage the resolution of any contractual issues throughout the life of the contract. How the department reports (1) during, and (2) at the end of, contracts to Buying Solutions MoJ works closely with the Office of Government Commerce (OGC), including its Buying Solutions agency, to ensure compliance with procurement best practice and to achieve best value for money outcomes. There is no specific requirement for departments to report to Buying Solutions during or at the end of contracts. (1) In accordance with OGC best practice guidance, and taking into account the value and complexity of the specific contract, Contract Managers determine and implement the extent/frequency of their internal reporting process to their key stakeholders throughout the life of the contract. (2) In relation to end of contract reporting, a key feature of the MoJ business case approvals process is a Post Contract Assessment phase. This requires that the person responsible for managing the contract (typically the Contract Manager) return a post contract assessment to the Professional Services category team within three weeks of the end of the contract. Aspects included are the extent to which key deliverables/expected benefits were met, the quality of the service, whether the contract was delivered to budget, whether and how skills transfer was achieved. A repository for the storing and analysis of post contract assessments is currently in the process of being devised and implemented.

Contracts awarded are monitored by the business area (within HMRC or VOA) receiving the services. The service providers are monitored against the agreed contract, which may include assessment of: delivery against the agreed key performance indicators; delivery of agreed outputs, within agreed timescales; payment, in accordance with the agreed proposal and fees structure; and skills transfer to staff (where appropriate). HMRC and VOA may on occasion choose to use Buying Solution framework contracts but there is no reporting relationship to Buying Solutions since it acts as an agent to departments. HMRC and VOA hold regular business relationship meetings with Buying Solutions at director level but these do not involve individual contract spend discussion.
