There are no current plans to request the Committee on Toxicity to update their review on heat-not-burn tobacco products. However, the Office for Health Improvements and Disparities will continue to monitor international evidence related to the health harms of these products.

To ask the Secretary of State for Health and Social Care, what recent discussions official in his Department have had with the Committee on Toxicity on a potential evaluation of non-tobacco oral nicotine pouches.
We have asked the Committee on Toxicity (COT) to consider the toxicological risks from tobacco-free oral nicotine pouches. The COT held an initial discussion around the paper ‘A summary of data on the bioavailability of nicotine and other ingredients from the use of oral nicotine pouches and assessment of risk to users of the topic (TOX/2021/22)’ at its meeting on 4 May 2021, in which the Department participated.

The Department is considering whether the Committee on Toxicity of Chemicals in Food, Consumer Products and the Environment (COT) should undertake an evaluation of non-tobacco oral nicotine pouches in its work programme in the next financial year. Oral tobacco products are banned under Tobacco and Related Product Regulations 2016 and consequently there are no current plans to ask COT to evaluate such products. COT will not consider smokeless tobacco products because their dangers and harms are well documented in the existing evidence base.

To ask Her Majesty's Government, further to the reply by Baroness Chisholm of Owlpen on 1 March (HL deb, col 789), what was the outcome of the review by the Committee on Toxicity of maximum intakes of folic acid.
At its April 2018 meeting, the Committee on the Toxicity of Chemicals in Food, Consumer products and the Environment (COT) considered a scoping paper on the current Tolerable Upper Level (TUL) of intake recommended for folic acid and the implications of the recently published paper Public health failure in the prevention of neural tube defects: time to abandon the tolerable upper intake level of folate by Wald et al. A copy is attached.
As the scientific database on the effects of folic acid is extensive and the science in several areas has developed significantly since the TUL was last considered in the early 2000s, the COT agreed that the basis of the current TUL for folic acid should be examined. The first detailed discussion paper will be considered at the next COT meeting in July 2018.

The Committee on Toxicity of Chemicals in Food, Consumer Products and the Environment (COT) identified and evaluated over 400 references when producing their 2007 statement, called “Statement on the Review of the Cabin Air Environment, Ill-health in Aircraft Crews and the Possible Relationship to Smoke/Fume Events in Aircraft”. The evidence base consisted of data submitted by the British Airline Pilots Association (BALPA) and references identified as relevant by the COT Secretariat.
All evidence reviewed can be found listed at the end of the Statement. There are no references to ExxonMobil submitting evidence, or being consulted by the COT during the review.

The Department for Transport’s officials are cooperating with the Committee on Toxicity of Chemicals in Food, Consumer Products and the Environment regarding the letter that clarifies the Committee’s position on cabin air. This is to ensure the Committee’s advice is represented in full and with clarity. The letters will be sent to the Members of both Houses imminently, certainly in November.

The Department for Transport’s officials have held a meeting on 7 September 2015 with the Committee on Toxicology and Public Health England to discuss these concerns. All sides agreed constructive steps to ensure the Committee’s concerns are addressed. The Government plans to write to members of both Houses who have received correspondence or responses to Parliamentary Questions on the issue, with a full description of the Committee’s advice in the light of these discussions with the Committee on Toxicology. A copy of this letter will be placed in the libraries of both Houses of Parliament.

We have recently received the final report on cabin air from the Committee on Toxicity (CoT) and agree with its findings that levels of exposure to chemicals in contaminated bleed air would need to occur in far higher concentrations to have toxic effects, and that a causal link to the range of illnesses reported in relation to fume incidents is unlikely.
As stated in the CoT’s paper, any decision to undertake further research would need to balance the likelihood that it will usefully inform further management of the problem against the costs of undertaking the work. Since 2008, successive Governments have devoted considerable resources to the study of cabin air. An international approach to future investigations now seems justified and, with this in mind, the Department for Transport does not plan to undertake any additional research. However, officials will forward the CoT’s paper to the European Aviation Safety Agency in order to highlight the CoT’s suggestions for further research.

As an independent scientific advisory committee, the Committee on Toxicity of Chemicals in Food, Consumer Products and the Environment (COT) chair and secretariat schedules the timing of submitted reports for COT consideration. The department has consulted with the COT secretariat and determined that COT is intending to review the Aircraft Cabin Air Sampling Studies commissioned by the Department for Transport, at the COT meeting on 17 September 2013.
