The Government has included a measure in the Victim and Courts Bill which will restrict the exercise of an offender’s parental responsibility where they are sentenced to four or more years imprisonment for a serious child sexual abuse offence against a child for whom they hold parental responsibility. Given these changes are untested, the Government has chosen to focus on the cases involving the highest degree of direct risk to children first.
However, the Government recognises the discussions around the appropriate scope of the measure, including whether to extend it to offenders convicted of rape where a child has been conceived as a result. We are looking at this closely and will continue to work across Parliament as the Bill progresses.
The welfare of a child must be the court’s paramount consideration when making decisions about that child’s life. Courts already have powers under the Children Act 1989 to restrict the exercise of parental responsibility and to control who the child should live or spend time with, if it is in the child’s best interest to do so. When considering arrangements to be made for a child, including the extent to which parental responsibility should be exercisable and who exactly the child should live or spent time with, the court must have particular regard to a list of welfare factors, including any harm the child has suffered or is at risk of suffering.
Last month, a devastating report by Women’s Aid revealed that a total of 67 children have been killed over a 30-year period by a known domestically abusive parent, in circumstances related to the courts’ use of the principle of the presumption of contact. Two of those children, Jack and Paul Sykes, are the sons of my formidable constituent, Claire Throssell. All these deaths were preventable. Will the Minister update the House on the progress of the Government’s review of the presumption of contact?

I have a constituency case where one parent has abused their children and the other parent has had to pay for the supervision of those children. The presumption of contact is not working in cases where domestic abuse has happened, so I echo the calls from the hon. Member for Penistone and Stocksbridge for an urgent review of it.

I know that the Justice Secretary is aware of the tragic case of my constituent Sara Sharif. Will she consider reforming family courts and ending the presumption in favour of parental contact despite the fact that there were safeguarding concerns?
I know that the Justice Secretary is aware of the tragic case of my constituent Sara Sharif. Will she consider reforming family courts and ending the presumption in favour of parental contact despite the fact that there were safeguarding concerns?
That case of that little girl, Sara Sharif, is one of the most tragic of recent times, and I know that that view is shared right across the House. That is why a safeguarding review is under way to look at all the agencies that were involved and should have been protecting that little girl from those who ended up killing her. We are looking at the presumption: there is a review, and we will consider the findings of that review and publish our response in due course.
