To ask the Secretary of State for Business, Energy and Industrial Strategy, what independent input the Oil and Gas Authority has sought to inform their investigations concerning the pumping of liquids by Cuadrilla into their fracking site at Preston New Road in Lancashire.
In February 2019, the OGA announced it would work with recognised and independent geologists and scientists to carry out a scientific analysis of the data gathered during Cuadrilla’s operations at Preston New Road between October and December 2018. This work includes inputs from the British Geological Survey (BGS), Dr Ben Edwards, Nanometrics Inc and Outer Limits Geophysics; further information can be found on the OGA website. Additionally, during operations the OGA seeks expertise from external experts, including the BGS and from Bristol University.

The environmental permit issued by the Environment Agency (EA) sets legally binding conditions to control both fugitive emissions (leaks) and point source emissions (from flaring).
The levels of methane in the ambient air are monitored at the site boundary by the operator and independently ‘off site’ by the EA and the British Geological Survey. In January, in line with strict requirements of the site’s permit, the operator notified the EA when methane levels were detected above the reporting thresholds at the site boundary.
These thresholds are set at a precautionary level to ensure a substantial level of protection. The EA’s assessment is that emissions have been well below the levels that would constitute a risk to people or the environment. Cuadrilla has an approved programme of activity to detect and repair leaks. The EA audited this on 15 January 2019 and no non-compliances were found.
There is no evidence to indicate that methane is currently leaking from the site. The notified levels are understood to have been as a result of short term operation of the on-site flare.
The EA is currently reviewing and auditing the operations of the flare and it will subsequently report its detailed assessment and findings.

The Government is reassured that our regulatory regime for shale gas is working as intended. The industry is at the very early stages of exploration and we do not yet know how much of the UK’s shale resources can be extracted technically or economically and what the contribution to the UK economy could be.
We will continue to support responsible companies, working within our robust regulatory regime, who are prepared to invest in this industry as they proceed with the exploration process, to test the size and value of the potential reserves.

The Oil and Gas Authority (OGA) monitors seismicity as part of their regulatory duties at shale gas sites. They review all information submitted to them by Cuadrilla and have assured the Government that events at Preston New Road are conforming to the pre-agreed Hydraulic Fracture Plan.
Information about the seismic events is displayed real-time on the British Geological Survey (BGS) site and Cuadrilla regularly update information on traffic light events on their web-site.
Within 30 days of completion of operations the operator must submit a Hydraulic Fracturing Operations Report to the OGA. The OGA will publish these reports six months after receipt.

The Traffic Light System is working exactly as intended. As I have already set out to this House, there are no plans to review it. The Traffic Light System ensures that induced seismic events remain at a level that prevents the risk of damage to the environment or property.

The Environment Agency has been carrying out regular inspections, audits and unannounced spot checks to ensure that Cuadrilla is compliant with the legally binding conditions in the environmental permit.
Cuadrilla had a small number of non-compliances with their environmental permit in 2017, mostly for procedural matters. This is not uncommon for industrial sites after site inspections and audits. In these instances the Environment Agency has provided advice and guidance to ensure full compliance with the permits. In response Cuadrilla has implemented the required improvements. So far in 2018, no permit non-compliances have been recorded.

The independent oil and gas regulator, the Oil and Gas Authority (OGA), is responsible for ensuring operators mitigate the risk of induced seismicity. The OGA is continually monitoring operations around the Preston New Road site to ensure they remain in line with Cuadrilla’s Hydraulic Fracture Plan, which was independently approved by the OGA, Environment Agency and the Health and Safety Executive (HSE) before the commencement of hydraulic fracturing operations.
The Traffic Light System dictates that if an event of 0.5ML or above is detected and causally linked to operations, Cuadrilla must pause operations for 18 hours and reduce well pressure. Operations are only allowed to resume once regulators are satisfied that any risks have been appropriately mitigated. The very minor seismic events recorded at the Preston New Road site cannot be felt at the surface.

All Government Ministers and officials meet regularly with industry representatives, including those from the energy industry. A register of ministerial meetings is published on a quarterly basis as part of Departments’ transparency data.

The Government has always been clear that shale gas development must be safe and environmentally sound. We are committed to ensuring a rigorous, evidence-based approach is taken to reviewing any applications for hydraulic fracturing.
Hydraulic Fracturing Consent approval will not be issued unless the Secretary of State is satisfied that the legislative conditions in the Petroleum Act 1998 have been met and that he is otherwise satisfied that it is appropriate to issue consent.

My rt. hon. Friend the Secretary of State set out in the Written Ministerial Statement of 25 January 2018 that we will look at the financial resilience of all companies wishing to carry out hydraulic fracturing operations alongside their application for Hydraulic Fracturing Consent.
Therefore I have asked the Infrastructure and Projects Authority to conduct a financial resilience assessment of Cuadrilla as part of their application for Hydraulic Fracturing Consent. The details and timetable for the completion of the assessment are a matter for the Infrastructure and Projects Authority.

If or when an application for Hydraulic Fracture Consent is received from Cuadrilla, the Secretary of State will ask for an assessment of the company’s financial resilience.
