Mr. Hutton: I represented the UK at the Health Council in Luxembourg on 26 June 2002.
The Council debated the Commission's package of proposals for review of pharmaceutical legislation, covering the authorisation of
medicinal products through a centralised authorisation procedure and the constitution of the management board of the European Agency
for the Evaluation of Medicinal Products (EMEA). No conclusions were reached.
During discussions of the framework convention on tobacco control, the Commission along with the incoming Danish presidency, urged
member states to be flexible to allow the adoption of a strong European Union position for the next round of negotiations in Geneva
in October. Some member states called for high level political input to seek to avoid adoption of a position that simply represented
the lowest common denominator. The United Kingdom remains a supporter of a strong and effective convention.
Council conclusions on patient mobility were adopted; with the Commission expected to bring forward proposals during the Danish
presidency.
The rest of the agenda covered the presentation of new dossiers or updates on the progress of current legislation. The Commission
presented a draft directive on the safety of tissues and cells, to complement the current one on blood safety, as well as one on
traditional medicines. There were also two recommendations: one on smoking prevention and tobacco control and another on the
reduction of risks associated with drug dependence.
Details of these and other agenda items are set out in the table which will be placed in the Library. No votes were taken on any
issue before the Council.

Ms Blears: My right hon. Friend the Minister of State for Health represented the United Kingdom.
The Council reached political agreement to adopt a common position on the directive setting standards of quality and safety for
blood and blood components. Although a few member states were disappointed that there were no strict requirements for donations to
be voluntary and unpaid agreement was reached on an acceptable compromise form of words.
In the orientation debate on the directive on tobacco advertising and sponsorship all the delegations, which spoke, stressed the
need to ensure that its basis be legally sound so that it is not struck down by the European Court Judgment as the previous
directive had been. The UK, along with other member states expressed support for the directive. The UK raised concerns that global
sponsorship should benefit from derogation until 1 October 2006. The UK also mentioned the need to ensure that the directive was
compatible with other legislation pertaining to e-commerce. There was some discussion of the scope of the directive and Commissioner
Byrne explained that it did not cover indirect advertising. Some states felt the advertising ban should not apply to local press and
publications. There was no opposition to the inclusion of advertising for cigarette papers within the scope of the ban.
Member states discussed the health aspects of bio-terrorism agreed presidency conclusions on the need for a comprehensive programme
of co-operation in this area; strengthening existing networks and exploring other opportunities to ensure a coherent approach in
support of national plans.
Commissioner Byrne made a statement on recent developments in cross-border healthcare. Member states expressed concern over recent
ECJ rulings that treaty provisions on freedom to provide services applied to health services, which had previously been thought to
lie outside treaty competence. The Commission called for further discussions on the detail and will produce a discussion document
for the Spanish presidency conference in February. The UK explained that the rulings had implications for domestic legislation, to
which we were responding, and that there was a need to look further at competence boundaries. Other member states were of the same
opinion.
Commissioner Byrne gave an update on preparations for the next round of negotiations on the World Health Organisation framework
convention on tobacco control. He indicated that the Community position on agriculture subsidies would need to be updated to take
account of references to phasing out of tobacco subsidies in the communication to Gothenburg on sustainable development. The
planned Commission communication on `Health and Poverty policy' will help pave the way for financial support for implementation of
the convention in developing countries.
Council adopted unanimously a Recommendation on the prudent use of anti-microbial agents; and Conclusions on stress and depression
related problems.
The Council noted the Commission's updates on the revision of the medical devices Directive 93/42/EEC and the current state of play
in the process of setting up the European Food Authority.
Commissioner Byrne explained that the Scientific Committee investigating the impact of electro-magnetic fields thought there may be
a link with DNA damage and multiple exposure, but there was insufficient evidence as yet. The Commission will recommend further
studies to fill the knowledge gaps.

Ms Stuart: I attended the Health Council on 18 November in Brussels on behalf of the United Kingdom.
The new Commissioner for Health and Consumer Protection, David Byrne, presented the Commission's fourth report on health protection
in other Community policies and his ideas on the future Community public health strategy. This information was welcomed by Ministers
and a Council Resolution on health protection in other Community policies was then adopted. The Commissioner reported on the
adoption by the Commission of a proposed directive on the manufacture, presentation and sale of tobacco products, which includes
changes to the labelling and tar content of tobacco products. Commission reports on progress achieved in relation to public health
protection from the harmful effects of tobacco and on developments on the negotiations taking place on the World Health
Organisation's tobacco framework convention were presented. Following an open debate on the general policy of reduction of tobacco
consumption, Council Conclusions were adopted on combating tobacco consumption. A Council Resolution was adopted on mental health
promotion and progress was noted on a Resolution on antibiotic resistance to be adopted by the Agriculture Council in December. The
Presidency reported on health issues beyond the present European Union borders, including: health in the applicant countries; health
questions related to the Northern Dimension and the common strategy on Russia; and the euro-mediterranean conference of Health
Ministers to be held in December. The Council noted that Conclusions had been adopted at a previous Council on the importance of
co-operation with the applicant countries in the sphere of public health. The Commission reported on its plans for a new exchange of
letters with WHO to encourage effective working relations. Commissioner Byrne reported on his wide-ranging plans to transform the
Community's approach to food safety, including plans to establish a European food agency. The Council took note of progress reports
on two pharmaceutical directives covering clinical trials and medical devices. Under any other business, the Netherlands raised its
concerns about the impact on domestic health care systems of recent European Court of Justice cases about access to health benefits
in other countries.

Mr. Hood: To ask the Secretary of State for Health what was the outcome of the Health Council held in Luxembourg on 8 June; and if
he will make a statement. [86639]
Ms Jowell: I attended the Health Council on 8 June in Luxembourg, on behalf of the United Kingdom.
The Council reached political agreement on the draft Recommendation on limitation of exposure of the general public to
electromagnetic fields. This will be adopted at a future Council, subject to the lifting of the UK's Parliamentary scrutiny reserve.
The Council also adopted Resolutions on antibiotic resistance and on future Community action in the field of public health and held
an initial exchange of views on priorities and resources for the latter. It also adopted Conclusions on health protection
requirements in Community policies. The Commission reported on the progress of the European Union--United States Task Force on
Communicable Diseases and on the Community's own communicable diseases surveillance network. The Commission also presented a paper
on health and enlargement, following which the Council went into an informal session to which Health Ministers from the accession
candidate countries had been invited. They identified common health problems, particularly increased levels of communicable
diseases, smoking, and drug and alcohol misuse.
In formal session again, the Commission said that publication of its report on the state of migrants' health in the Community would
be delayed to include the health needs of refugees, in the light of the Kosovo crisis. Both the Commission and Belgium gave an oral
update on the current situation following the contamination of food with dioxins in Belgium. After an oral report from the
Commission on Transmissible Spongiform Encephalopathies in the Community, the UK updated the Council on the number of cases of
variant Creutzfeldt Jakob Disease in the UK. The Council also stated its support for the World Health Organisation's "Tobacco Free
Initiative".

Mrs. Lait: To ask the Secretary of State for Health what plans he has to raise in the EU Health Council the health effect of EU
policy in relation to tobacco growers. [76935]
Mr. Hutton: We expect the German Presidency to include an item on tobacco on the agenda of the Health Council meeting on 8 June
1999. The Commission will report on progress made in implementing the recommendations of its 1996 report on the Community's role in
combating tobacco consumption, which includes the issue of tobacco production in the European Union. We intend to indicate our
support for co-ordinated action.
