Brussels on 5 December: what the Government's stance was on the issues discussed, including its voting record; and if she will make

Mr. Timms: I represented the UK at the Telecommunications Council in Brussels on 5 December.
There was a policy debate on the situation in the telecommunications sector in Europe, and the Council adopted conclusions which
emphasised the importance of developing content, services and applications for the information society, and the widespread
availability and use of broadband networks, using a multi-platform approach as set out in the eEurope 2005 Action Plan. The
conclusions also underlined the importance of implementation of the new regulatory framework for electronic communications, and
agreed that intervention in the form of state aid was not the way forward. In particular, the Council emphasised the importance of
placing the information society and the telecommunications sector high on the agenda of the Spring European Council, and invited the
Commission to report on these subjects in due time beforehand and if necessary put forward appropriate proposals.
There was also adoption of two resolutions: one on the implementation (including the benchmarking) of the eEurope Action Plan 2005;
and another on promoting a culture of network and information security. Council conclusions were also adopted on eSkills. There was
also an agreement on a general approach, without the need for a vote, towards the MODINIS programme which helps fund the
implementation of the eEurope Action Plan 2005, and work on network security. Regarding the dti Department of Trade and Industry
Commission's proposal for a Directive on the re-use and commercial exploitation of public sector information, the presidency
concluded that a common position is likely to be adopted at the March Council following adoption of an opinion by the European
Parliament.
The Commission also gave a short presentation on its eighth report on the implementation of the current regulatory framework for
telecommunications which reiterated the importance of timely, effective and coherent implementation of the new regulatory framework
for electronic communications. The Commission also reported progress on its work on open platforms for digital television and 3G
mobile, and on electronic identification and authentication systems in e-commerce, on which public hearings are expected in the New
Year.
On the reform of ICANN, the private sector company based in the United States that manages the Internet domain name system, the
Commission gave an update on the positive progress towards successful reform achieved at the latest ICANN reform negotiations which
took place in Shanghai in October.

Mr. Plaskitt: To ask the Secretary of State for Trade and Industry what was the outcome of the Telecommunications Council meeting
held in Luxembourg on 3 October. [134446]
Ms Hewitt: There was an orientation debate on the proposed Local Loop Unbundling Regulation. During the debate all member states
stressed their commitment to the Regulation and a rapid timescale for its adoption. I strongly welcomed the Regulation as an
enormously important issue for the development of e-commerce across the European Union, and confirmed the UK fully supported and
would be fully compliant with it. The Presidency hopes that the Regulation will be adopted at the very latest at the next
Telecommunications Council in December.
The Council adopted a Resolution calling for a more co-ordinated EU approach within ICANN (the Internet Corporation for Assigned
Names and Numbers). Welcoming this, the Commission now intends to establish a network of European expertise on internet naming and
addressing issues.
The Commission gave a progress report on the creation of an .eu top level domain name, and it is expected that a Commission Proposal
will follow in October. The Council also took note of a Presidency progress report on the programme to improve the exploitation of
public sector information, facilitate access to venture capital and boost multilingual content on the internet. The Presidency hopes
a Council Decision will be adopted in December. There was also a Presidency progress report on the state of discussions on the new
measures under the 1999 Communications Review.
The Council also discussed the Commission's postal services proposal, the main provision of which is to reduce the area reserved for
incumbent national postal operators (the `reserved area') from deliveries weighing less than 350 grams to those under 50 grams.
During discussions, member states were divided on whether the proposal offered an acceptable pace of liberalisation, with several
member states calling for a target date for full liberalisation. The Presidency hope for agreement at the next Telecommunications
Council in December.

Ms Hewitt: There was an orientation debate on the review of the regulatory framework for electronic communications. During the
debate all member states supported the general approach of the Commission on regulation of access to infrastructures in order to
promote competition. A number, including the UK, welcomed the Commission's proposal that regulation should be on a co-regulatory
basis with business where possible. Regarding the new institutional structure, member states welcomed the Commission's intention to
build on the existing structure, but define the roles of any new bodies. On the scope of universal service, most member states,
including the UK, supported the Commission's proposal to retain the existing scope of universal service, but to keep this under
review.
The Commission presented its Communication on the World Radiocommunication Conference 2000 and the Council adopted Conclusions
giving broad support to the Communication.
The Commission also presented a number of recent or forthcoming Communications concerning: the results of its consultation on
creation of the EU internet top level domain; organisation and management of the internet; unbundled access to the local loop; and
gave an update on the forthcoming postal services liberalisation Directive. The Council also noted Presidency reports on the outcome
of the Conference on Digital Terrestrial Television, and the Ministerial Conference on Knowledge and the Information Society held in
Lisbon on 17-18 February and 10-11 April 2000 respectively.

Ms Hewitt: I represented the UK at the Telecommunications Council on 30 November which adopted a Directive on a Common Framework for
Electronic Signatures. I welcomed this as a major step forward towards clarifying the legal framework for electronic commerce.
In addition the Commission presented a number of recent Communications which were followed by preliminary exchanges of views.
In presenting the fifth report on implementation of the telecommunications regulatory package the Commission drew attention to
progress towards implementation of the existing package of telecoms liberalisation legislation, and concluded that the successes of
the existing regulatory framework had led to market growth with increased competition and lower tariffs. The Commission also drew
attention to the remaining barriers to a single European market in telecoms, including a comparatively low level of harmonisation of
Community licensing and interconnection regimes, incomplete implementation by some member states of Community cost accounting
provisions, and the lack of competition in local access markets in all member states. Member states approved this general analysis.
There was a first debate on the Commission Communication on the review of the regulatory framework for electronic communications. In
presenting the Communication the Commission summarised its approach to the review of the regulatory package which would apply to all
electronic communications systems and said it would report on the outcome of its public consultation in April before making
legislative proposals in May. In the following debate all member states recognised the need for swift action in the face of the pace
of technological change, and simplification of the regulatory framework. A number, including the UK, stressed the need for a
flexible framework with a minimum of regulation. I emphasised that strengthening competition in the market for communications
services is vital to produce an environment in which e-commerce can flourish in Europe, and welcomed the Commission's recognition
that regulation should be on a co-regulatory basis with business where possible. The Council adopted Conclusions endorsing the
Commission's principles for the new regulatory framework as set out in its Communication.
The Commission also presented its Communication on the results of its public consultation on its Green Paper on radio spectrum
policy. The Commission summarised the outcome of its consultation and the areas in which it indicated future legislative proposals.
There was no discussion of the Communication: the Presidency concluded that the Council noted the Commission's intentions which
would require further study when specific legislative proposals emerged in 2000.
There was also a debate on the information society of the future and how to build trust and create effective rules for electronic
commerce. The Commission will produce guidelines on the use of self-regulation in this area for discussion at the Information
Society meeting in Lisbon in April 2000.
The Council also noted, without discussion, the Commission Communication on implementation of Directive 97/47/EC on advanced TV
standards. The Commission also provided an oral update on member states' preparation for the Millennium Bug in energy, transport and
other fields.

Mr. Hood: To ask the Secretary of State for Trade and Industry what was the outcome of the Telecommunications Council held in
Luxembourg on 22 April; and if he will make a statement. [82396]
Mr. Wills: I represented the UK at the Telecommunications Council on 22 April. The Council reached political agreement on a common
position in respect of a Directive on a Common Framework for Electronic Signatures. A Council Resolution on the Year 2000 Computer
Problem was agreed in principle.
The Council also held a debate on the state of the EU telecommunications market. The Commission presented a Communication on the
results of public consultation on the Green Paper on the Convergence of Telecommunications, Media and Information Technology
Sectors, on which Council Conclusions were agreed in principle. The Commission also presented its Green Paper on Access to Public
Sector Information, and provided an oral update regarding developments on Globalisation and the Information Society, Internet Domain
Names, and on the public consultation on the Commission Green Paper on Radio Spectrum Policy.

Mr. Kilfoyle: I have been asked to reply.
The Common position is that adopted by the Telecommunications Council on 21 December 1998 on a series of guidelines, including the
identification of projects of common interest, for trans-European networks for the electronic Interchange of Data between
Administrations (IDA). IDA aims to achieve the most efficient and cost effective means of data interchange in support of European
Community policies.
The Common position relates to a second phase of IDA that will run for five years from the point of adoption. The first phase ran
from 1995-1997 and supported Community policies by the development of networks for the exchange of data related to subjects
including agriculture, fisheries, health, statistics, employment and customs matters. The second phase is likely to continue work in
some of these areas and other areas where Member States and the European Community identify the need for data interchange.
At this stage, there are no specific proposals on exchange of information related to Recitals 8 and 16 of the Common position text.
The proposed budget for the IDA guidelines proposal is estimated as euro 38.5 million for the first three years of the programme.
Any work carried forward under IDA, will take full account of the sensitivity of the data to be passed across a network and the
relevant data protection legislation. Appropriate security measures will be taken to protect sensitive data.

Mr. Hood: To ask the Secretary of State for Trade and Industry what was the outcome of the Telecommunications Council held in
Brussels on 27 November; and if he will make a statement. [62034]
Mrs. Roche: I represented the UK at the Telecommunications Council held in Brussels on 27 November.
The Council reached unanimous political agreement in respect of common positions on two Decisions establishing a five year programme
for the Interchange of Data between Administrations (IDA). No agreement was reached on a draft Directive on a framework for
electronic signatures, and it was therefore agreed that this proposal should be referred back to the Committee of Permanent
Representatives for further discussion.
The Commission also made oral presentations on: a Communication on implementation by Member States of Community legislation in the
telecommunications sector; a Green Paper on radio spectrum policy; and on a report to the European Council on job opportunities in
the information society. The Commission also provided an oral update on: the outcome of the OECD Conference on electronic commerce
held in Ottawa in October; progress within the "Global Business Dialogue" on electronic commerce; and on internet domain name
governance issues. The Presidency made an oral presentation on the outcome of the Conference "Coping with Convergence" held in
Vienna on 3 November 1998.
