The department is currently working with the City of London Academies Trust to consider the site’s suitability for the expansion of one of its schools, Newham Collegiate Sixth Form, from 600 to 800 students. The project is currently at the Feasibility Study stage, and is expected to complete this early this year. A decision will then be taken on the most appropriate way forward.

The Education and Skills Funding Agency (ESFA) and its predecessor body, the Education Funding Agency, handles complaints about open academies and free schools. The ESFA cannot change the decision of an academy or free school about a complaint but will review whether the academy or free school considered the complaint properly, in line with its procedures. Where the ESFA identify a concern, they will ask the academy or free school to reinvestigate the complaint or change its procedures.
From 11 September 2015 to 10 September 2018, the ESFA received 6886 complaints about academies and 347 complaints about free schools. Currently the ESFA's systems require the manual interrogation of records in order to identify the number of upheld complaints.
The ESFA were able to quickly refer many of these complaints back to the complainant, as they had not exhausted fully the academy’s complaint procedures. This is required before the ESFA can become involved.

The department has acquired the former East Ham Police Station to become a free school and we are working with the City of London Academies Trust to consider its suitability for one of their schools. The purchase of East Ham Former Police Station was completed on 4 February 2014 and the purchase price was £3,350,000. The department approved £599,470 for works to the former East Ham Police Station, of which £476,947 was for the demolition of the accommodation building at the rear of the site, and the remainder was used for essential maintenance works to the Grade II listed building to ensure it was safe.

The Education and Skills Funding Agency (ESFA) received a Red Book Valuation in August 2015 for the Bowring Sports Club Ground and exchanged contracts in December 2015 subject to planning approval. The ESFA is still in the process of seeking planning approval therefore the acquisition of the site has not yet been completed.

Official market value is subjective and at a specific point in time, we do carry out Red Book Valuations as per Treasury Green Book guidelines but these reports are carried out as a guide to the sites value and are treated as commercially confidential documents.

In agreement with the Free School Trust, the ESFA is now seeking to secure a suitable site within Wakefield.

The Department acquired the former East Ham Police Station for a free school and has every intention to use this site for a school. We are considering the latest set of free school applications in the area and we continue to review the options for this site.

Where management or other prior surveys are available, the Education Funding Agency (EFA) will consider these before acquisition. Depending on the type and scale of works, the EFA will also carry out more intrusive surveys, where landlord’s consent can be obtained.

Costs are controlled very carefully when purchasing sites for free schools and we consider the specific needs of the schools on a case by case basis when allocating funding. The Education Funding Agency does not pay in excess of what a site is worth or purchase expensive sites if there are better value for money alternatives in the area. The Department is establishing an arm’s length body, LocatED, to provide additional commercial expertise in securing value for money sites for free schools. Value for money is judged on the whole development cost of a free school, including the site purchase and the subsequent construction or conversion of an existing building.

The Education Funding Agency has not been approached by the Trust and has not agreed to provide advance funding.
The financial statements ending 31 August 2016 show a cumulative carry forward surplus of £173,401. We are looking into the reference to a deficit of £522,760 and we will seek clarification from the Trust on the issues raised.

The Education Funding Agency has two frameworks of contractors which are used for procuring the vast majority of school building projects. These are currently under review and as part of this process we are reviewing the information exchanged at key points throughout the process between all parties to improve communication. We are also undertaking stakeholder engagement surveys with schools to establish where communication can be further improved.
