To ask the Solicitor General, whether the Crown Prosecution Service provides guidance to prosecutors on addressing expert or academic evidence that uses alternative terminology for female genital mutilation in criminal proceedings.
FGM is clearly defined in the Female Genital Mutilation Act 2003 and CPS prosecutors apply that statutory framework alongside the Code for Crown Prosecutors. CPS’s prosecution guidance for FGM recognises that expert medical evidence may assist a jury on technical matters; however, alternative terminology used in academic or professional contexts does not alter the offence definitions or the legal tests. Prosecutors assess any expert evidence for relevance, admissibility and weight, and will ensure the statutory terminology is used in court.

An ineffective trial is a trial that does not go ahead on the scheduled trial date, and so a further listing is required. This can be due to action or inaction by one or more of the prosecution, the defence or the court. If a trial is deemed ineffective due to the witness being absent, this would indicate that the trial has been delayed.
The Ministry of Justice publishes ineffective trials statistics by reason including trials that are rescheduled due to “prosecution witness absent – professional/expert” here: Criminal court statistics quarterly: April to June 2025 - GOV.UK. These statistics can be filtered by Local Criminal Justice Board to isolate figures for Greater Manchester. We do not have access to data on ineffective trials due to the absence of a defence professional witness.
The Ministry of Justice cannot provide data on cases that “did not progress” due to the non-attendance of professional witnesses. This information would only be held in the individual court records for cases that are discontinued, and examination of these records would be of disproportionate cost.

The Government does not recognise the concept of “parental alienation” syndrome and does not think it is capable of diagnosis. Having reviewed relevant family court judgments and published guidance by various organisations, the Government recognises that there is a need to review the role of unregulated experts in the family courts.
The Government is already taking action on concerns about unregulated experts in family court proceedings. We are working with the Family Procedure Rule Committee on this issue to make changes to the Family Procedure Rules and their associated Practice Directions to restrict the instruction of these experts.
There are existing mechanisms within the family court system for a case to be reconsidered. A parent may apply to the family court to have an existing order varied or discharged. The court will consider all of the circumstances of the case and make any decision based on the welfare of the child, which is its paramount consideration.

Between January 2023 and March 2025, the Ministry of Justice undertook a comprehensive review of civil legal aid. This included family legal aid. The evidence from the review indicated that the housing and debt, and immigration and asylum sectors face particularly acute challenges with service provision and high demand.
Following a consultation, we recently announced uplifts to housing and debt, and immigration and asylum legal aid fees, which will inject £20 million into the sector each year once fully implemented.
The Government keeps legal aid policy, including family legal aid and remuneration for expert witnesses, under review.
