The existing Advisory, Conciliation and Arbitration Service (Acas) Code on time off for trade union duties and activities (“the Code”) has been updated to reflect the changes made by the Employment Rights Act 2025 to the statutory framework on the rights to time off and the provision of facilities for trade union representatives.
The draft Code was laid before Parliament on 6 July 2026. Subject to completion of the parliamentary procedures, the intention is that it will be brought into effect alongside the changes to the statutory framework in October 2026.

DfT Operator Limited (DFTO) is responsible for agreeing and administering reasonable paid trade union facility time for its employees, in accordance with recognition agreements, ACAS guidance, employment legislation and operational requirements. Great British Railways will determine its own arrangements for trade union facility time as part of its future employment and industrial relations framework.

Cabinet Office does not hold a central record of which departments currently (a) operate check off for trade union subscriptions and (b) charge trade unions for that service. While departments are responsible for setting their own policies regarding the administration of trade union subscriptions, the Civil Service Management Code (Section 7.3) provides guidance to departments on voluntary deductions from the pay of civil servants, including trade union subscriptions. The Government has no current plans to update the management code on this matter.

The Framework and Guidance is expected to be implemented only across the Civil Service, including all departments and agencies that employ civil servants. Non-Civil Service central government bodies and public corporations may adopt the framework principles, should they wish, but are not expected to do so. Cabinet Office does not hold a record of which non-Civil Service organisations intend to adopt this approach.

There are currently no plans for the Department or NHS England to issue revised guidance on trade union facility time. Existing relevant legislative provisions are outlined in the ACAS Code of Practice on time off for trade union duties and activities and incorporated into relevant National Health Service employment frameworks, including Section 25 of the NHS terms and conditions service handbook. ACAS is updating its Code of Practice following changes made by the Employment Rights Act 2025. Any implications for the NHS terms and conditions would be considered through the NHS Staff Council supported by NHS Employers, once the updated ACAS Code is finalised.

While there is no separate statutory framework for green representatives, the Employment Rights Act 2025 strengthened rights to reasonable paid time off for trade union representatives and trade union equality representatives. Where a workplace green representative is also a trade union representative, they may benefit from these statutory rights relating to trade union representatives. There are no current plans to introduce a separate statutory framework for workplace green representatives.

DBT received the new Civil Service Facility Time Framework and Guidance on 30 April. DBT and its Civil Service agencies aim to implement the guidance by agreeing to a new Facilities Time Framework with their Trade Unions. New frameworks are at the start of their development, and decisions have not yet been made concerning any changes to staff resources and facilities time.

Following the introduction of The Trade Union (Facility Time Publication Requirements) Regulations 2017, the Cabinet Office Facility Time Framework was updated. The update was to inform departments that they were required to publish the relevant data in their annual reports; on their website; and on the Cabinet Office’s facility time publication service. And that the data for each department must be published annually before the 31st July. This came into effect for the financial year 1 April 2017 to 31 March 2018.

The average spend on facility time as a percentage of the pay bill in 2023-2024 was 0.04%, as answered in Parliamentary Question 2098 on May 18 2026. The Cabinet Office does not hold information on Civil Service facility time for 2025-26. This is because of the repeal of the Trade Union (Facility Time Publication Requirements) Regulations 2017, which came into effect in February 2026, meaning departments are no longer required to report their spending on facility time to Cabinet Office.
