My Rt Hon. Friend, the Secretary of State for Health and Social Care has not had any discussions with these organisations related to reducing overprescribing.
The National Health Service and partner organisations are responding to the challenge of overprescribing, as set out in the Government’s review of overprescribing, Good for you, good for us, good for everybody, in September 2021.
Progress has been made to implement the recommendations of that review, for example:
- implementing the National Medicines Optimisation Opportunities for integrated care boards;
- addressing problematic polypharmacy, when there is potential harm associated with taking multiple medicines;
- delivering Structured Medication Reviews; and
- publication of a repeat prescribing toolkit and oversupply dashboard to support general practices to identify oversupply and improve repeat prescribing processes.
Offering treatments that are not medicines is also key to addressing overprescribing. Many other initiatives delivered across the NHS contribute towards this. These include delivery of personalised care and shared decision-making, NHS Talking Therapies for anxiety and depression, and social prescribing.
We are continuing to address issues with the prescribing of medicines in line with the NHS’ 2025/26 priorities and operational planning guidance.

Transforming Support: The Health and Disability White Paper published on 15 March 2023 sets out that we will work with NHS England to explore accessing relevant NHS medical information, with appropriate consent from claimants.
Discussions are ongoing and we are currently exploring how information is shared between the DWP, hospital and GP IT systems. We are also exploring improvements with the aim of speeding up decision making for claimants and reducing the burden on medical professionals having to supply additional information later in the application process.

Cohorting as a Service uses SNOMED CT Codes from general practitioner (GP) practice extracts, with data being collected using the General Practice Extraction service. This collection is supported by the British Medical Association, Royal College of General Practitioners and National Data Guardian, and collects a specific set of patient data from GP practices in England on a fortnightly basis.
The data includes personally identifiable information such as National Health Service number and date of birth because the information is required for delivering direct care. The NHS England vaccination programme uses the information to identify and contact patients who fall within clinically ‘at-risk’ groups within an age group.
The Secretary of State or NHS England issue Directions for information collection, then approval for collection is obtained, confirming that the Information Standard, Collection or Extraction has been through assessment and is demonstrated to meet the quality assurance criteria set by the Data Alliance Partnership Board.

NHS Digital functions legally transferred to NHS England on 1 February 2023. NHS England is consequently responsible for ensuring it meets its obligations to protect people’s data. Data protection law will continue to apply. This means there must always be a valid, lawful basis for the collection and processing of personal information including special category information within federated data platforms and any other NHS England IT system, as defined under data protection legislation. Data protection impact assessments must be carried out and privacy notices published which explain what data is collected, analysed and shared and for what purposes.
NHS England must have regard to statutory guidance issued by the Secretary of State for Health and Social Care under the power in section 274A of the Health and Social Care Act 2012, which sets out measures that the Secretary of State expects NHS England to take to protect confidential information. The draft guidance has been published on GOV.UK, and the finalised guidance will be published shortly, and kept under review.
NHS England is legally required to report annually to Parliament on how well it has discharged its data functions. NHS England also makes an annual Data Security and Protection submission which demonstrates how they meet data protection obligations.

To ask His Majesty's Government how many people’s GP records have been made accessible to contractors and sub-contractors working on NHS England’s Cohorting as a Service system in 2023; and what data fields have been shared.
The clinical data used in the Cohorting as a Service system covers between 15 and 20 million people in the flu and COVID-19 cohorts. The system is built and maintained by NHS England employees and one main contractor, with less than fifteen people in the team having access to the relevant clinical cohorting data. This data is only accessed by exception, for example to investigate or resolve problems. The remainder of the team use test data for building the service and do not have access to the clinical data.
The system accesses the following data fields:
- NHS Number;
- surname and forename;
- date of birth/age;
- address and postcode;
- ethnicity;
- sex;
- the associated SNOMED5 CT codes and dates for medical conditions and drug treatment(s) relevant to the cohort criteria.

The Cohorting as a Service platform went live on the 20 October 2022. The service currently provides a service to the NHS England Vaccine Programme for COVID-19 and flu and will continue to evolve.

Cohorting uses the same underlying technology platform as NHS England’s Secure Data Environment service. Cohorting is carried out in other national programmes such as screening, which do not use the Cohorting as a Service system. There are forms of cohorting for other purposes such as population health and research; the Cohorting as a Service system is not currently intended to be used for these.

To ask the Secretary of State for Health and Social Care, pursuant to the Answer of 1 December 2022 to Question 84943 on NHS Digital: Cybersecurity, what steps he is taking to resolve the cyber incident that continues to impact NHS Digital data.
This incident was not targeted against the National Health Service but against Advanced, a third-party software supplier to the NHS. We have worked closely with Advanced to restore services. The majority of NHS services have now been reconnected and we are supporting the few NHS organisations still undergoing reconnecting. All but one of the affected mental health providers have now been reconnected and are in the restoration phase.
The incident has impacted data submission to the Mental Health Services Data Set (MHSDS). The MHSDS monthly publication has been reclassified as experimental statistics to reflect this. Caveats are included on the publication page to warn users when interpreting the data. The NHS Digital data liaison service and data quality teams are in regular communication with providers and continue to monitor the impact on submissions and reporting.
