[120113] Mr. Morley: The Radioactive Substances Committee (formally the Working Group on Radioactive Substances) has met on six occasions since the OSPAR Conference in Sintra in July 1998 to discuss matters relating to the implementation of the OSPAR Strategy for Radioactive Substances. Mr. McGrady: To ask the Secretary of State for Environment, Food and Rural Affairs what action will be taken to ensure that the Government meet the commitments of the OSPAR Commission proposals of July 1998 in advance of the meeting in Bremen in June 2003. [116119] Mr. Meacher: In 1998, OSPAR agreed strategies on hazardous substances, eutrophication, radioactive substances, biodiversity, and assessment and monitoring. A strategy for offshore oil and gas was agreed the following year. These strategies set long term goals--in some cases, looking a generation ahead (i.e. 2020). The strategy with regard to hazardous substances sets the objective of preventing pollution of the maritime area by continuously reducing discharges, emissions and losses of hazardous substances, with the ultimate aim of achieving concentrations in the marine environment near background values for naturally occurring substances and close to zero for man-made synthetic substances. The UK has worked with other OSPAR contracting parties, including the European Commission, to update and prioritise a list of substances that cause concern for the marine environment and to identify the most appropriate additional action to achieve the objective. The objective of the strategy to combat eutrophication is to seek to achieve and maintain a healthy marine environment where eutrophication does not occur by the year 2010. A key milestone to this is the assessment of the current eutrophication status of the various parts of the OSPAR maritime area. In this assessment the UK identified 16 marine areas of concern. These are being addressed by action under the Urban Waste Water Treatment Directive and the Nitrates Directive. The strategy with regard to radioactive substances requires the OSPAR Commission, by the year 2020, to ensure that discharges of radioactive substances are reduced to levels where the additional concentrations in the marine environment above historic levels, resulting from such discharges, are close to zero. In July 2002, the Government published a strategy showing how the United Kingdom will contribute to the achievement of the 2020 target. OSPAR's biodiversity strategy aims to protect and conserve ecosystems and marine biological diversity. Annex V was brought into force on 30 August 2000. Since then, the UK has prepared for the forthcoming meeting in Bremen by helping to develop a criteria for identifying threatened and declining species, developing guidelines on the identification and management of marine protected areas, developing guidance on the construction and operation of offshore wind farms, developing an agreement on sand and gravel extraction, and the development of proposed ecological quality objectives which will be piloted in the North sea. The strategy for oil and gas addresses the effects of offshore activity through the setting of environmental goals and the establishment of management mechanisms to achieve them. Good progress has been made, in particular with controls on chemicals being agreed and an ambitious goal being set to reduce discharges of produced water. A goal of all operators having internationally recognised environmental management systems in place by the end of 2005 has also been developed and is expected to be adopted at the meeting later this month. In respect of assessment and monitoring, the forthcoming meeting will invite Ministers to endorse a new OSPAR strategy known as the Joint Assessment and Monitoring Programme (JAMP). This provides the framework for OSPAR's work in this area, both in support of other OSPAR strategies and to facilitate the production in 2010 of a Quality Status Report for the OSPAR maritime area. Overall the UK has been implementing the plans and measures set out above in accordance with these strategies, and the milestones contained within them, and has met its commitments to date.

Mr. Llew Smith: To ask the Secretary of State for the Environment, Transport and the Regions what assessment he has made of the measures needed to protect ocean habitats. [131997] Mr. Mullin: At its annual meeting in Copenhagen on 26 to 30 June, the OSPAR Commission adopted and launched the Quality Status Report on the whole of the North-East Atlantic, the "QSR 2000", along with reports covering the five regions of the OSPAR maritime area. The UK participated, in particular, in the preparation of the reports on the Greater North Sea (Region II) and the Celtic Seas (Region III). Together these reports comprise the first detailed assessment of the health of the North-East Atlantic. The assessment concludes that worsening trends in the pollution of the North-East Atlantic have been reversed, and that many significant sources of pollution have been stopped. Nevertheless, the North-East Atlantic is still under threat. The main fields where action is needed are the sustainable management of fish stocks, the continuing impact of some fisheries on fragile ecosystems, and the elimination of inputs of hazardous substances. Organotin compounds from antifouling treatments of ships and concerns about endocrine disrupters are particularly highlighted as problems. Other important issues identified by the OSPAR Commission are climate changes resulting from human activities and the consequent effects on the marine environment, the need to protect marine biodiversity and ecosystems from human activities, and the impacts of oil spills and discharges of ballast water from shipping. The Government consider, in line with the conclusions of the Quality Status Report, that the long-term OSPAR strategies, adopted by the Ministerial Meeting in 1998 at Sintra (in which my right hon. Friend the Deputy Prime Minister played a leading role) and subsequently, provide a sound framework for future action on hazardous substances, radioactive substances, eutrophication, the protection of marine biodiversity and habitats and the offshore oil and gas industry. The Government will also pursue action in other relevant international forums, including the Framework Convention on Climate Change and its Kyoto Protocol, the International Maritime Organisation (particularly on tributyl tin) and the European Community (particularly on the further development of the Common Fisheries Policy). The assessment also shows that, in spite of major scientific efforts of OSPAR Commission parties over the last 25 years, there are still major gaps in our understanding of the marine environment, and that improvement of our knowledge base remains a priority. The Government will be working, with our OSPAR partners, to develop effective programmes to remedy such gaps. The Government are also considering the implications of last autumn's judgment by the High Court that the EU Habitats Directive extends beyond the limits of the territorial seas. They expect to consult before the end of this year on regulations to transpose the Directive to cover the marine environment within UK jurisdiction outside the territorial seas and have begun the process of identifying possible candidate Special Areas of Conservation in that area.

[128861] Mr. Meacher: [holding answer 3 July 2000]: At its annual meeting in Copenhagen last week, the OSPAR Commission adopted, by consensus, a programme for more detailed work on the implementation of the OSPAR Commission's strategy on radioactive substances. This provides for the adoption of national plans, the submission of detailed forecasts of how the elimination or reduction of radioactive substances from both nuclear and non-nuclear sources will be achieved, in order to meet the OSPAR 2020 goal on radioactive discharges, emissions and losses, and to enable the Commission to develop a collective oversight of progress towards this goal. The OSPAR Commission finalised a first and essential step in the implementation of its long-term strategy on hazardous substances. As a result, twelve new hazardous substances were added to the OSPAR List of Chemicals for priority action. The Commission also adopted several measures to control chemicals from both offshore and land-based sources, including the setting of a new international standard for the regulation of the use and discharge of offshore chemicals and drilling fluids. Under the strategy to combat eutrophication, the OSPAR Commission agreed which areas of the North East Atlantic do not present eutrophication problems, adopted on a trial basis guidelines for evaluating nutrient inputs to the sea, and put in hand work on comprehensive assessments of the areas where there are, or may be, eutrophication problems. The Commission adopted and launched the Quality Status Report on the whole of the North East Atlantic, the "QSR 2000". This report, together with reports covering the five regions of the OSPAR maritime area, is the first review of the health of the North East Atlantic in such detail. The OSPAR Commission also finished reviewing its working methods and established a new organisational structure, to keep the effective implementation of its five long-term strategies and the effective follow-up to the QSR 2000. Twelve OSPAR states adopted a decision requiring a review of nuclear processing in preventing accidental pollution. Although the UK drew attention to its recently published draft national discharge strategy, all the OSPAR states except France supported the decision, and the UK and France abstained. I am arranging for copies of the Summary Record of the Commission's meeting to be placed in the Library when it becomes available.
