There are already permitted development rights – set out in Part 9 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order (England) 2015, as amended – which grant planning permission for development relating to roads.
We continue to keep permitted development rights under review.

That this House notes with concern the growing practice of experienced commercial developers conducting full-scale operations on sites without prior planning permission, relying on the permitted development regime to avoid the requirement for consent; recognises that this practice causes serious harm to residential communities, including noise, pollution, increased traffic and loss of amenity; is alarmed that retrospective planning applications in such cases are frequently allowed to remain undetermined by local planning authorities for periods well in excess of statutory target timeframes, leaving affected residents without recourse or certainty; acknowledges press reports suggesting this is a widespread national problem affecting communities across the United Kingdom; calls on the Government to review the scope and application of permitted development rights with a view to preventing their exploitation by commercial developers acting in bad faith; and further calls on the Government to strengthen local planning authority enforcement powers and to introduce clear statutory timeframes for the determination of retrospective applications.

As announced in April, following consultation, the Government will legislate to introduce permitted development rights to expand EV charging provision, allowing for cross-pavement charging solutions and associated charging points. The Government’s response to the consultation will be published in due course.

The Government understands planning is key to the rollout of EV charging infrastructure and is working to ensure the system supports installations.

Defra is exploring how to improve the planning system for key food and farming infrastructure and working closely with MHCLG, Natural England and the Environment Agency to deliver on these priorities.
This Government is delivering the biggest reform to planning in a generation including consulting on proposed changes to the National Planning Policy Framework that would provide significant support to agrifood developments. This policy has been developed to recognise the need for investment in infrastructure to meet the sectors ambitions for the environment, animal welfare and economic growth.
Major reforms to agricultural permitted development rights were brought forward in 2024. The Government is working with industry to help us better understand whether further reforms will be effective in supporting agricultural development in a way that aligns with Government’s environmental objectives.
