To ask the Secretary of State for the Home Department, whether she has made an assessment of the prospects of the UK meeting the conditions for exchanging personal data under the EU Prüm framework for automated data exchange by 1 October 2021; and what plans she has for future UK...
Under the terms of the UK-EU Trade and Cooperation Agreement (TCA), within nine months of entry into force of the Agreement the UK’s DNA and fingerprint capabilities under the Prüm framework will be evaluated.
The UK continues to exchange biometric data with connected EU Member States and judges it has met the requisite conditions for exchanging personal data. These are set out in Title II of Part 3 of the TCA.
More broadly, the UK continues to exchange personal data with our European partners for the purposes of law enforcement, including under the terms of the TCA, ensuring such data is appropriately protected.

To ask Her Majesty's Government what access they anticipate UK law enforcement agencies would have in the event of a no-deal Brexit to EU-wide databases, including the (1) Schengen-Information system II, (2) European Criminal Records Information System, and (3) DNA databases shared under the Prűm Convention.
The Government’s position remains that leaving with a deal, which includes ambitious internal security arrangements, is in the UK’s best interests. If we leave the EU without a deal, the UK would cease to have access to the EU’s law enforcement databases on exit – including the Schengen Information System II (SIS II) and the European Criminal Records Information System (ECRIS). It is worth noting that the UK is not yet live on Prüm DNA.
The Home Office has been working with operational partners to put in place contingency arrangements to transition our cooperation with EU Member States to non-EU channels in a no deal scenario. We continue to work closely with operational partners to maintain readiness for a range of possible exit scenarios in October, including no deal.

The Prime Minister has made clear that one of the twelve objectives for the negotiations ahead will be to establish a new relationship with the European Union that includes practical arrangements on matters of law enforcement cooperation to tackle cross-border crime and to keep our people safe.
We continue to work closely with EU partners and we are examining the options for future cooperation on measures such as Eurojust and the Prüm Council Decisions once the UK has left the EU but it is too early to speculate at this stage what future arrangements may look like.
