Mrs. McGuire: [holding answer 14 July 2004]: The Scotland Office is a distinct entity within the Department for
Constitutional Affairs. The Head of Finance at the Scotland Office is Norman Kernohan. He does not hold a professional accountancy
qualification but he has full access to advice from professionally qualified staff in both the DCA and the Scottish Executive. The
Scotland Office was established on 1 July 1999 and since that date none of its accounts have received a qualified opinion.
Questions about the Registers of Scotland are a matter for the Scottish Executive.

Mr. Dewar: [holding answer 29 April 1999]: The fee structure for searches in the Registers of Scotland is set out in the Fees in the
Registers of Scotland Amendment Order 1999, S1 1999/1085 (S87) which was made on 7 April and came into effect on 21 April 1999. The
order introduces uniform fees for searching the Registers for all customers. No distinction is made between solicitors, searchers
and the general public. The pertinent fee rates are as follows:

Dr. Godman: To ask the Secretary of State for Scotland if he will make a statement about the prior options review of the Registers
of Scotland Executive Agency. [80169]
Mr. Dewar: A prior options review of the Registers of Scotland Executive Agency was carried out recently for my Department. The
review concluded that there will continue to be a need for a function to maintain a register of title to land with the power to make
independent decisions in cases of dispute, and recommended continuation of both Agency and Trading Fund status.
Extensive recommendations on issues such as governance and target setting were made to enhance the strategic management of the
Agency and to improve its commercial approach.
I have accepted the recommendations on Agency status and on improvements to the coverage and stringency of the Agency's targets,
which will be revised as soon as possible.
I have not, however, accepted the review's recommendation that decisions on the Agency's accommodation strategy should be brought
forward. As recently as last November, I agreed that the Agency should maintain its presence in its existing, or similar, locations
in Edinburgh and Glasgow until 2007. This option will have the least impact on the Agency's productive capacity at a time when it
will be undertaking the major task of completing the extension of the Land Register to the whole of Scotland.
The recommendations on Trading Fund status, governance arrangements and the future strategic management of the Agency will be
considered by Ministers of the Scottish Executive and the Scottish Parliament. Interim arrangements have been made to continue
Trading Fund status until 31 March 2000.
From 1 July 1999 this will be a matter for the Scottish Parliament.

Mr. McLeish: In terms of its status as a Trading Fund under the Government Trading Funds Act 1973, the Agency is required to make a
6 per cent. return on capital employed across the range of its activities. This target will be reviewed from time to time.
The final report resulting from the Quinquennial Review of the Registers of Scotland Executive Agency will be made available to
interested parties once the Secretary of State has announced the outcome of the review.

Mr. McLeish: The Scottish Law Commission recently published its Report on Diligence on the Dependence and Admiralty Arrestments
(Scot. Law Com. No. 164). This Report contains the Commission's recommendations for reform of the diligence of inhibition on the
dependence of actions.
The total sums paid by Registers of Scotland in relation to the action of Judicial Review raised by Millar & Bryce Ltd. and 2 other
firms of private searchers were as follows: (a) an agreed settlement of £25,000 in respect of the judicially awarded expenses of the
petitioners and (b) £36,807.21 in respect of Registers of Scotland expenses.

Mr. McLeish: Section 6(5) of the Land Register (Scotland) Act 1979 requires the Keeper to issue to any person applying, a copy,
authenticated or otherwise, of any Title Sheet or part thereof or of any document referred to in a Title Sheet. There are no plans
at present to reform the Land Register so that Land Certificates disclose information about previous proprietors and the prices paid
by them.
The existing statutory rights of access to the Land Register, the Register of Sasines and the Register of Inhibitions and
Adjudications will continue to be maintained. The ability to exercise these rights will be enhanced by remote electronic access to
be provided early in 1999.

Mr. Browne: To ask the Secretary of State for Scotland if he will make a statement about the forthcoming Prior Options review of the
Registers of Scotland Executive Agency. [51918]
Mr. Dewar: In accordance with the Government's policy on periodic reviews of Executive Agencies, my Department will shortly commence
a thorough review of the Registers of Scotland Executive Agency. The remit for this review will be as follows:
to carry out a prior options review of the Registers of Scotland in accordance with Cabinet Office (OPS) guidance and the agreed
timetable, by
(a) re-examining the status options considered before the Agency was created, in the light of experience and of any changes in
internal or external circumstances; (b) testing rigorously whether the Agency function is required at all, and the scope for
privatising, contracting-out (which could include market testing), transferring the functions to another body, continuation of
Agency status or transferring the functions to The Scottish Office;
(c) consulting widely among the key players in the Agency (management and staff) and The Scottish Office, as well as customers,
other interested bodies and other suppliers of similar services;
(d) assessing each option in terms of practicability and value for money; and
(e) making recommendations accordingly to the Secretary of State for Scotland.
In order to help ensure that all options are considered fully, comments from interested parties will be welcome. Comments should be
sent by 30 September 1998 to the address below. The results of the Review will be published in late Spring or early Summer.
