To ask the Secretary of State for Transport, whether utility companies that excavate private roads in order to carry out works associated with the installation or maintenance of utility services are required to reinstate and repair those roads to an appropriate standard upon completion of the works.
To ask the Secretary of State for Transport, whether utility companies that excavate private roads in order to carry out works associated with the installation or maintenance of utility services are required to reinstate and repair those roads to an appropriate standard upon completion of the works.
Utility companies are required to reinstate streets following completion of their works. For privately maintained streets, the Specification for the Reinstatement of Openings in Highways provides that surfacing should be reinstated to match the existing construction as far as is reasonably practicable and to the reasonable satisfaction of the street manager, while requirements relating to backfill and the area surrounding utility apparatus continue to apply.

The Department’s Street Manager digital service enables local highway authorities to record, monitor and co-ordinate street works, including the identification of defective reinstatements. However, use of the service is not mandatory for all types of works and the Department does not hold complete data on the number of defective street works reinstatements identified in each of the last five years. The Department also does not hold complete data on the proportion of defective reinstatements that were remedied by undertakers within the statutory guarantee period.

The Department does not hold data on the costs incurred by highway authorities in undertaking remedial works following defective street works reinstatements, nor on the amount of those costs recovered from undertakers, in each of the last five years. Highway authorities are responsible for the inspection of reinstatements and may recover costs where they undertake remedial works.

The Department’s Street Manager digital service enables local authorities to record, monitor and co-ordinate street works, including inspections. As use of the service is not mandatory for all types of works, the Department does not hold complete data on the number of inspections that fail.
The Department has not made an estimate of the cost to highway authorities of remedial works undertaken after the statutory guarantee period has expired.

To ask the Secretary of State for Energy Security and Net Zero, how many claims for compensation have been made under the Gas (Street Works) (Compensation of Small Businesses) Regulations 1996, since the start of 2025.
The compensation entitlement under these Regulations is a private statutory right against a gas transporter. The Regulations do not create a regime that is administered or overseen by Government or Ofgem. Therefore, the data being sought is not held by Government.

- 2021-22: 0.9%
- 2022-23: 1.0%

To ask the Secretary of State for Transport, whether she has considered extending the statutory guarantee period for the reinstatement of highways following street works; and what assessment she has made of the adequacy of existing guarantee periods in ensuring that undertakers bear the cost of defective reinstatements.
To ask the Secretary of State for Transport, whether she has considered extending the statutory guarantee period for the reinstatement of highways following street works; and what assessment she has made of the adequacy of existing guarantee periods in ensuring that undertakers bear the cost of defective reinstatements.
The Government has no current plans to extend the statutory guarantee period for reinstatements following street works. Undertakers are responsible for the cost of remedying defective reinstatements, and a reinstatement is not deemed complete until it complies with the required standard. Poorly performing undertakers are subject to increased inspections and inspection fees under the performance-based inspection regime, and highway authorities can recover costs where they have undertaken remedial works themselves. The Government keeps the operation of the street works regime under review.

Restrictions on street works following substantial road works are provided for under section 58 of the New Roads and Street Works Act 1991. The criteria for applying those restrictions, including the circumstances in which road works qualify as substantial road works, are set out in secondary legislation. The Government keeps the operation of the street works regime under review and works closely with local highway authorities and utility companies to ensure that works are carried out in a way that minimises disruption to road users.
To ask the Secretary of State for Transport, what consideration his department has given to reducing the 6-month grace period that utility companies have to undertake full repairs to paving in town centres.
To ask the Secretary of State for Transport, what consideration his department has given to reducing the 6-month grace period that utility companies have to undertake full repairs to paving in town centres.
Statutory guidance already makes clear that permanent reinstatements should be completed by utility companies as soon as reasonably practicable and that, where an interim reinstatement is used, it should normally be made permanent within six months.
The Department considers this period to be proportionate, balancing the need for timely, high‑quality permanent repairs with practical considerations such as the availability of appropriate materials and the safe coordination of works.

The Department’s Street Manager digital service enables local authorities to record, monitor and co‑ordinate street works, including inspections. Use of this service is not mandatory for all types of works so the Department does not hold complete data on the percentage of utility works that are inspected by highway authorities.
The Department has not made a formal assessment of digital systems to identify damage to roads or footways. Decisions on the use of technology when carrying out inspections rest with local highway authorities.
To ask the Secretary of State for Transport, what estimate her Department has made of the cost to local highway authorities and local taxpayers arising from defective utility reinstatement works in each of the last five years.
To ask the Secretary of State for Transport, what estimate her Department has made of the cost to local highway authorities and local taxpayers arising from defective utility reinstatement works in each of the last five years.
The Department does not collect data on the impact of utility works on highway condition or the associated maintenance costs for local authorities.
Highway authorities have powers under the New Roads and Street Works Act 1991 to inspect works, require utility companies to remedy defective reinstatements, and, where necessary, carry out remedial works themselves and recover reasonable costs from the utility company.
Under the performance-based inspections regime utility companies with higher defect rates are subject to more frequent inspections and associated charges, to incentivise compliance with the statutory standards for reinstatement.
