In the legacy benefits (e.g. Employment & Support Allowance (ESA), Jobseeker's Allowance (JSA) and Income Support (IS)) there were multiple disability premia (e.g. Disability Premium, Enhanced Disability Premium and Severe Disability Premium). These were complex, fragmented and often underpaid, each with differing and often overlapping rules that made administration difficult and confusing for claimants.
Universal Credit replaces these with a single structure and clearer elements (e.g. disability and caring support), reducing complexity and improving consistency and claimant understanding.
The Universal Credit rate for people who have Limited Capability for Work and Work-Related Activity (LCWRA) and meet the Severe Conditions Criteria (SCC) or the Special Rules for End of Life (SREL) is more than double the equivalent rate of the ESA support group and provides financial support to those with the most severe disabilities and health conditions.

Transitional Protection within Universal Credit is intended to support customers whose entitlement would otherwise be lower at the point of moving from legacy benefits. This includes Transitional Protection provided in respect of the Severe Disability Premium.
Rules apply equally to all forms of Transitional Protection, ensuring that entitlement remains aligned with a customer’s circumstances. This is a standard feature of Transitional Protection and not based on disability status.
The Department keeps all aspects of Universal Credit policy under consideration to ensure it continues to provide effective support.

Transitional Protection is designed to ensure that, at the point of moving onto Universal Credit, eligible customers do not see a reduction in their overall entitlement compared to their previous legacy benefits. These rules apply equally to the Severe Disability Premium Transitional Protection.
All forms of Transitional Protection are a temporary measure and will adjust over time as other elements of a customer’s Universal Credit award change.
Any reduction in the value of Transitional Protection occurs gradually and is offset by increases in underlying Universal Credit entitlement, for example through uprating or the addition of new elements. This means that a customer’s overall monetary entitlement does not decrease as a result of Transitional Protection reducing and will increase once Transitional Protection has fully eroded.
Universal Credit also provides additional support for disabled people, including through elements for those with limited capability for work and work-related activity, which may be included in awards where applicable.

The purpose of the Transitional Severe Disability Premium Element (TSDPE) is to protect certain customers entitled to a severe disability premium who moved to Universal Credit from legacy benefits following a change in their circumstances.
The TSDPE is subject to erosion and termination, in line with managed migration rules. From the second assessment period onwards, the amount of the TSDPE will be reduced by the addition or increase of any Universal Credit element, other than the childcare costs element or the housing element awarded to those who have previously been entitled to Housing Benefit whilst living in specified or temporary accommodation.
Customers who are moved to Universal Credit by the Department for Work and Pensions will receive an amount of transitional protection if their circumstances remain the same and their Universal Credit entitlement is less than the amount they received on their legacy benefit.
The difference will be included as an award of transitional element as part of the overall Universal Credit award for the first assessment period. This transitional element will also be subject to erosion and termination as outlined above.
There are no current plans to evaluate the impact of Universal Credit transitional protection rules.

The transitional Severe Disability Premium (SDP) element’s (SDP TE) serves as part of the wider transitional protection in place and is designed to support eligible claimants in their transition from legacy benefits to Universal Credit (UC).
The Social Security Up-rating Regulations 2023 amended the rates used to calculate SDP TE for eligible new claims from 10th April 2023. This uprating aligns awards of the transitional element with the rate of uprating for wider benefits within the annual uprating order.

The Severe Disability Premium was abolished for claims to Universal Credit for working age people as a result of the Welfare Reform Act in 2012.
The Severe Disability Premium is currently still paid to eligible claimants in receipt of Employment and Support Allowance. It is being phased out as people move to UC.

The severe disability premium in Employment and Support Allowance and the additional amounts for persons severely disabled in State Pension Credit are not separate benefits in themselves but are payable as part of the award to those who are eligible, i.e. those severely disabled people who live independently and who are most likely to need to purchase care. When a claim to either benefit is made, the claimant is asked questions, for example if they are in receipt of a qualifying disability benefit or if anybody is caring for them, which helps to determine if the premium or the additional amount is payable. Once entitled to the benefit, claimants are required to report any change of circumstance including ones which may lead to the awarding of the premium or the additional amount. The Department also makes use of the information that it holds to prompt enquiries of the claimant as to possible entitlement to the premium or the additional amount. There is information for claimants about the severe disability premium and the additional amount for persons severely disabled on the relevant pages of www.gov.uk.
