In 1991, in what was then the Social Chapter, the EU provided for member states to reach agreement on certain aspects of social policy. The UK exercised its right to ‘opt out’ from the Social Chapter. In 1997 the UK Government decided it no longer wished to ‘opt-out’ of provisions in the Social Chapter. As a result the contents of the Social Chapter were incorporated into the Amsterdam treaty, coming into force in May 1999. The Statutory Instruments introduced by the DTI, implementing the four Social Chapter measures already agreed by the other member states prior to the UK ending its ‘opt-out’, are as follows:"Sex Discrimination (Indirect Discrimination and Burden of Proof) Regulations 2001 (implementing Directive 98/52 which extended to the UK Directive 97/80 on the burden of proof in cases of discrimination based on sex). These provide that once a prima facie case of sex discrimination has been made in an employment tribunal claim, the burden of proof is placed on the defendant (usually the employer) who will need to demonstrate that sex discrimination has not occurred;""The Part-time Workers (Prevention of Less Favourable Treatment) Regulations 2000 (implementing Directive 98/23 which extended to the UK Directive 97/81 on the framework agreement on part-time work). These provide for entitlement of part-time workers to the same pro-rata terms and conditions of employment as full-time workers;""The Maternity and Parental Leave etc. Regulations 1999 (implementing Directive 97/75 which extended to the UK Directive 96/34 on the framework agreement on parental leave). These provide for parents to have the right to 13 weeks unpaid leave for the purposes of caring for a child. The leave must be taken by the child's fifth birthday, or within 5 years of the child's placement for adoption;""The Transnational Information and Consultation of Employees Regulations 1999 (implementing Directive 97/74 which extended to the UK Directive 94/45 on the establishment of European Works Council). These require companies with at least 1,000 employees in total across the member states and at least 150 workers in each of two or more of those member states, to establish structures for consulting workers on issues that affect them."Since the Treaty of Amsterdam came into force in 1999, further Directives and Regulations have been adopted under Articles 136-139 of Title XI of the EC Treaty, i.e. the ““Social Provisions”” Chapter.

Mr. Stephen O'Brien: To ask the Secretary of State for Trade and Industry what her estimate is of the administrative costs to UK

Mr. Sutcliffe: DTI has estimated the administrative cost to UK employers of transposing the Social Chapter Directives in its
Regulatory Impact Assessments. The Directives in question concern: (1) Parental leave (including the 1999 extension to the
implementing Regulations) (2) European Works Councils (3) Part-time work (4) Burden of proof in sex discrimination cases (5) Fixed
term employees (6) Information and consultation.
The total administrative(or implementation(costs to UK employers associated with the provision of these EU Social Chapter rights is
£0.68 million a year. Additionally, the DTI identified one-off implementation costs, estimated to be in the region of
£3.3 million. It should be noted that the Department's Regulatory Impact Assessments also highlighted significant benefits
associated with the Social Chapter Directives.

The UK signed-up to the social chapter on 2nd October 1997, following its endorsement of the Treaty of Amsterdam. On 1st May 1999,
it came into force having been ratified by all the member States.
The attached table shows the information requested, relating to change in jobs by sector, between the closest data reference points
to these dates, September 1997 and June 1999, and the latest data reference point, June 2004.

Mr. Brady: To ask the Secretary of State for Trade and Industry if she will list European legislation passed under the Social

Mr. Sutcliffe: Since 1997, four Directives have been agreed under the EU Social Chapter: the Burden of proof in sex discrimination
cases Directive; the Part-time Workers Directive; the Fixed Term Work Directive and the Information and Consultation Directive.
The Government has implemented all of these in the United Kingdom, with the exception of the Information and Consultation Directive,
which is due to come into force in April 2005.
In addition, as it agreed when it ended the UK's opt out of the EU Social Chapter, the Government has implemented the Parental Leave
Directive and European Works Council Directive, which were agreed before 1997.
These new rights have helped to set decent minimum standards in the workplace. In doing so, the Government has kept burdens on

Mr. Sutcliffe: The residents of Wirral, South have benefited from the EU Social Chapter by having their employment rights extended
to include: the right to parental leave which gives parents the right to 13 weeks unpaid leave at the birth or adoption of a child;
the entitlement of part-time workers to the same pro-rata terms and conditions of employment as full-time workers, thereby removing
any discrimination and improving the quality of part- time jobs; the provision that once a prima facie case has been made in an
employment tribunal claim, the burden of proof is placed on the defendant (usually the employer), who will need to demonstrate that
sex discrimination has not occurred; rights under the Fixed Term Work Directive that provide for the fair treatment of fixed term
workers and prevent abuse of fixed term contracts; rights under the European Works Council Directive which requires companies with
at least 1,000 employees in total and at least 150 workers in each of the two member states, to establish structures for consulting
workers on issues that affect them.
