The OGA carries out financial assessments, as part of which a Parent Company Guarantee may be required, for all companies when there is a licence transaction to consider, specifically when considering licence award, licence assignment, changes of control, drilling consent, and field development consent. Applications for Retention Areas (such as those applied for by Third Energy) do not trigger a financial assessment.
When a Licensee applies for a Retention Area within an existing Licenced Area, this allows the Licensee to undertake exploration and appraisal activities within a set time period, as set out in the related Retention Area Plan. An application for a Retention Area therefore does not create any additional risk, since the operations will have either been appropriately assessed already, or operations proposed will be financially assessed at such a point it is appropriate, for example, when applying for consent to drill.

As set out in the Written Ministerial Statement of 25 January 2018 [HCWS428] the Government considers that the financial resilience of a company wishing to hydraulically fracture is a relevant consideration. As a matter of policy, we will therefore look at issues relevant to the financial resilience of all companies wishing to carry out hydraulic fracturing operations alongside their application for Hydraulic Fracturing Consent. The Department is still considering Third Energy’s proposals to carry out hydraulically fracturing pursuant to the Direction issued to the Oil and Gas Authority on 29 November 2017 and will respond appropriately in due course.

Where an application for hydraulic fracturing consent is made, the Department requires that appropriate arrangements have been made for the independent inspection of the integrity of the relevant well as set out in condition 2 of section 4A of the Petroleum Act 1998.
In situations where hydraulic fracturing operations commence, the Health and Safety Executive will scrutinise the weekly operations reports produced by the well-operator in accordance with Regulation 19 of the Offshore Installations and Wells (Design and Construction, etc) Regulations 1996, to ensure that the health and safety risks are managed appropriately.

The Health and Safety Executive (HSE) has inspected the pipeline and is content that the gas from the KM8 well can be safely conveyed within the pipeline, under the current risk management systems employed by Third Energy. If there is any breach of the health and safety regulations resulting in formal enforcement action, HSE will make this public.

To ask the Secretary of State for Work and Pensions, how many visits to Third Energy's KMA well site in North Yorkshire at which the integrity of the KM8 well was inspected have been conducted by the Health and Safety Executive since 6 June 2013.
The Health and Safety Executive (HSE) has conducted three site inspections of Third Energy's KM8 well site since 6 June 2013, looking in particular at well integrity. HSE interventions are based on well notifications which are required before activity on the well can begin, and weekly reports by the well operator during this activity, including any hydraulic fracturing.
