Mr. Love: To ask the Secretary of State for the Environment, Transport and the Regions what progress has been made in resolving the outstanding claims for compensation relating to the compulsory purchase of land at Pymmes Park as part of the A406 widening at Edmonton; what parts of the claim by the local authority have been accepted in principle by the Highways Agency; what issues remain outstanding; and if he will make a statement. [111981] Mr. Hill: Compensation negotiations between the District Valuer, acting for the Highways Agency and the London Borough of Enfield are continuing. The Chief Executive of the Highways Agency, Mr. Peter Nutt, will write to my hon. Friend with further details. Letter from Mr. Peter Nutt to Mr. Andrew Love, dated 7 March 2000: The Parliamentary Under Secretary of State, Keith Hill, has asked me to write in response to your recent written Parliamentary Question about compensation being claimed by the London Borough of Enfield for land acquired under compulsory purchase at Pymmes Parks as part of the widening of the A406 North Circular Road. I explained in my letter of 8 December to you, that negotiations between the District Valuer, acting for the Highways Agency, and the London Borough of Enfield were continuing. Exchange land has already been provided to offset the loss of open space at Pymmes Park. The remaining heads of claim include the value of land as well as reasonable compensation for the loss of amenity and other damages to Pymmes Park. The District Valuer wrote to the Council on 3 February, on our instruction, setting out the Agency's position but unfortunately was unable to offer unconditional settlement on any of the nine heads of claim. I appreciate that this does not represent the progress the Council wishes to see, and I too would be pleased to see all these matters brought to speedy, equitable and amicable conclusion. May I suggest that the best way forward is for officials from Highways Agency, supported by the District Valuer, to meet Council officials at Enfield? Letter from Richard Thorndike to Mr. Andrew Love, dated 8 December 1999: The Parliamentary Under Secretary of State, Keith Hill, has asked me to write in response to your recent written Parliament Question about compensation being claimed by the London Borough of Enfield for the loss of a mature cedar tree in Pymmes Park, as a result of works to improve the A406 North Circular Road. I am replying in the absence of Peter Nutt, the Chief Executive. Although the tree was located very close to the highway construction area, it was intended to carry out the road works without disturbing it. Once construction started, however, because of the tree's extensive root system, it was found that it would be seriously affected. Ways of saving the tree including moving it, at an estimated cost of £100,000 were considered but none were found to be practicable. The Agency concluded that the only option was for it to be cut down. Meetings between the Agency, the District Valuer and the Council to discuss the provision of replacement trees, wider landscape proposals for Pymmes Park and compensation matters have taken place and are set to continue. The final settlement of any compensation due will depend on the outcome of these negotiations. In the event that agreement on compensation cannot be reached the Lands Tribunal is available to make an independent determination. As part of the overall arrangements to offset disturbance, the Agency has provided exchange land at the former Willoughby Gas Works, as replacement for public open space land taken from Pymmes Park for the A406 works.

[74202] Ms Glenda Jackson: I have asked the Chief Executive of the Highway Agency, Mr. Lawrie Haynes, to write to my hon. Friend. Letter from Peter Nutt to Mr. Andrew Love, dated 8 March 1999: The Minister for Transport in London, has asked Lawrie Haynes, the Chief Executive of the Highways Agency, to reply to your recent parliamentary Question about the improvements to the A406 between Fore Street and Hall Lane. I am replying in Lawrie's absence from the office. The information you asked for is in the attached table except for the information on the final cost of each of the three contracts. I am afraid it is not possible to provide this until the final accounts have been settled. I have therefore provided figures of the spend to date. The delays in completing what were highly complex improvements to the A406, particularly at Fore Street, are regretted, but as you know, they were largely due to the contractors encountering unforeseen ground conditions. There were also difficulties installing the specialist mechanical and electrical equipment necessary for safety in the tunnel. However, the improved road between Fore Street and Hall Lane now means that traffic on the A406 is able to run much more freely. It no longer has to compete with local traffic at the Fore Street, Angel Road and Lea Valley junctions, thus reducing congestion and delays to all road users. This coupled with the extensive landscaping we have carried out means that local people who live and work in the area can now enjoy a much safer, healthier and more attractive environment. _________________________________________________________________________________________________. [45339] Ms Glenda Jackson: I have asked the Chief Executive of the Highways Agency, Mr. Lawrie Haynes, to write to my hon. Friend. Letter from Lawrie Haynes to Mr. Andrew Love, dated 15 June 1998: The Minister for Transport in London, Glenda Jackson, has asked me to reply to your recent Parliamentary Question about the improvements to the A406 between Fore Street and Hall Lane. The information asked for is on the attached table with one exception. I am afraid that for commercial reasons I cannot let you have an estimate of the final outturn costs. To do so would weaken our bargaining position with the contractor in the event of disputes over the final account or the settlement of claims. I have therefore given figures showing the spend so far. The contracts were let under the Institution of Civil Engineers standard form of contract, which has been used for many years throughout the construction industry for major civil engineering works, and in which the contractor is paid for the actual, rather than estimated, work done. With road schemes it is not possible to identify all of the necessary work in advance of construction and this was true in this case which is a complex project in an urban environment. The disadvantage of using this form of contract is the uncertainty of costs and time but the Highways Agency addressed these concerns in a review of its procurement strategy, which led to an announcement in June 1997 of new procurement initiatives. As a result we are beginning to use other forms of contract, which share risk more equitably. Partnering is being encouraged to get away from the adversarial way in which some of our contracts have been conducted in the past. _________________________________________________________________________________________________. [33714] Ms Glenda Jackson: [holding answer 10 March 1998]: I have asked the Chief Executive of the Highways Agency, Mr. Lawrie Haynes, to write to my hon. Friend. Letter from Lawrie Haynes to Mr. Andrew Love, dated 11 March 1998: The Transport Minister, Glenda Jackson, has asked me to reply to your recent Parliamentary Question about the improvements to the A406 at Sterling Way and Fore Street. When I wrote to you last July, the timetable I gave you for the expected completion of the tunnel and for the full contract was considered realistic. However, since then I am afraid that progress in completing the tunnel has been seriously affected by the unexpected high volumes of water penetrating the walls of the tunnel structure, a problem which became more prominent with the high rainfall of the early winter months. Happily, the contractor has sealed the leaks and the problem is now under control. An added difficulty is the complexity of the mechanical and electrical equipment, which requires highly specialised and skilled personnel. We now expect the tunnel to be completed and open to traffic this June, whilst the full contract is planned to be completed by late Summer. However, with the aim of bringing forward the completion of the full contract, we are working with the contractor to see whether any of the works planned to be carried out after completion of the tunnel, can be carried out in parallel with the tunnel works. If it would help, I would be happy to arrange a site visit, so that you can see the problems at first hand.

Letter from Lawrie Haynes to Mr. Andrew Love, dated 31 July 1997: The Minister for Transport in London has asked me to reply to your recent Parliamentary Question about negotiations with the London Borough of Enfield over the removal of the cedar tree in Pymmes Park. In April 1996 we wrote to the London Borough of Enfield's Principal Corporate Solicitor, reiterating an offer first made in February 1995 to replace the cedar tree with two mature cedar trees. This letter also reflected our view that we were not liable for any compensation other than that negotiated with the District Valuer for the land needed for the A406 improvement. I enclose a copy of our letter for your information. To date, we have not received a response from the Council. Following is the letter: We spoke last week about your letter of 25 March and I promised to set out our views on this. Looking back over the papers, I see that we had told you that we expected to take entry into the park before the end of March 1995. We had also written to you on 28 February to say that we could find no way of saving the tree and to offer to provide two replacement trees. That letter also offered a meeting, an offer which received no response. We wrote to you on 27 April to explain further why we could not save the tree; the offer to provide replacement trees stands, but I do not see that we are liable to provide any compensation other than the negotiated with the District Valuer for the land.

Member. Letter from Lawrie Haynes to Ms Clare Short, dated 18 July 1996: As you know, The Secretary of State for Transport has asked me to reply to your recent question about the compensation being claimed by Enfield Borough Council in respect of land taken from Pymmes Park for the widening of the A406 North Circular Road. The plot of land on which the cedar tree was located is required under an essential licence for the purpose of providing the contractor with working space for the duration of the adjacent roadworks. The District Valuer has reached agreement with the Council on the compensation payable for the use of this land and the Highways Agency propose to arrange for this to be settled shortly. The Council have not raised the possibility of submitting a further claim in respect of the loss of the tree itself. The major part of the land taken at Pymmes Park is required for the permanent works and is proceeding on the basis of an exchange of land. The Highways Agency is arranging for the former Willoughby Gas Works Site to be upgraded and given to the Council as replacement pubic open space for that which has been lost as a result of the highway scheme.
