The Government takes its safeguarding responsibilities towards children extremely seriously.
Unaccompanied children may only be detained in very limited and exceptional circumstances, and the law places strict constraints on that detention. They may not be held in an Immigration Removal Centre under any circumstances. They must be transferred into appropriate local authority care arrangements wherever possible. An unaccompanied child may only be held in a short-term holding facility for a maximum of 24 hours for the purpose of removal.
A range of safeguards are in place to minimise detention and protect child welfare. These include the requirement to prioritise cases involving children, early referral to and engagement with local authority children’s services, a statutory duty under section 55 of the Borders, Citizenship and Immigration Act 2009 to have regard to the need to safeguard and promote children’s welfare, and a requirement that detention is for the shortest time necessary. Decisions involving children are subject to oversight and operational guidance that is subject to ongoing review and updates to ensure the welfare and best interests of children remain a primary consideration.

I am deeply concerned by the recent reports of Dr Abu Safiya's mistreatment whilst in Israeli custody. The Foreign, Commonwealth and Development Office has raised this case again with the Israeli Embassy in London and at senior levels across Israeli Government.
We have been consistently clear that all detainees must be treated with dignity and in full accordance with international law, and that any allegations of torture or mistreatment must be thoroughly investigated.

That this House expresses continuing concern over the ongoing detention of Dr Hussam Abu Safiya, the former Director of Kamal Adwan Hospital in northern Gaza, following his arrest by Israeli forces in December 2024; notes with grave concern reports that he continues to be held without charge or trial under Israel's controversial Combatants Law, that his detention has been repeatedly extended, and that credible reports indicate he has been held in prolonged solitary confinement and denied adequate medical care; further notes the vital role played by Dr Abu Safiya in providing medical care under extraordinarily dangerous conditions and in bearing witness to the destruction of Gaza's healthcare system; reaffirms that international humanitarian law affords special protection to medical personnel carrying out their professional duties during armed conflict; calls on the Government to continue to make urgent representations to the Israeli authorities for the immediate release of Dr Abu Safiya or, if lawful charges are to be brought, for due process in accordance with international law, together with immediate access to appropriate medical treatment, legal representation and independent monitoring while he remains in detention; and further calls on the Government to continue its work with international partners to uphold the protection of healthcare workers and medical facilities in armed conflict and to ensure respect for international humanitarian law.

I know that the Hon Member has taken a long and passionate interest in this issue, both during and following the six years that she spent working for the release of her constituent, Nazanin Zaghari-Ratcliffe, from detention in Iran.
I am very pleased to tell her and other Parliamentary colleagues that the Foreign Secretary has today (14 July) appointed the Rt Hon Alistair Burt, former Minister of State for the Middle East, to serve as the UK's special envoy for complex consular cases.
The new role has been created to provide additional support in particularly complex cases, including those involving concerns about the welfare of UK detainees, their entitlement to due process and the protection of their human rights. Mr Burt will help ensure that the most complex detention cases continue to receive focused senior attention, supporting the UK's efforts to secure progress and resolution.
Mr Burt will advocate on behalf of detainees and will work closely with families to ensure that their views are heard and reflected in the UK's approach. He will also support coordination across Government and advocate for resolutions in the most challenging cases, ensuring that every possible avenue is being pursued.
He brings extensive experience to this position from his previous ministerial role at the Foreign, Development & Commonwealth Office, where he established a strong track record in handling complex consular cases, including engagement with detainees' families and senior international counterparts, and navigation of sensitive issues in high-pressure environments
