I met senior officials from Ofcom on 17 December and again on 11 March.
I am clear delivery companies must do more to meet the rightful expectations of customers.
Ofcom has written to delivery operators to remind them of their obligations and is gathering evidence of compliance with applicable Consumer Protection Conditions.
Under the Consumer Rights Act 2015, sellers are responsible for the delivery of goods bought online until they are in the consumer’s physical possession and is responsible if anything goes wrong with the consumer’s parcel, including goods delivered damaged or lost in transit, to liaise with the courier to find out what went wrong.

All businesses must comply with relevant laws and employers must comply with their legal obligations to ensure that their workforce receive the rights and protections to which they are entitled.
Evri, and other parcel delivery operators, are independent businesses and the government does not have a role in their operational decisions.
Ofcom, the independent regulator for postal services, does not regulate the employment or remuneration models of Evri or other parcel delivery companies.

Ministers have regular discussions with Ofcom in its capacity as the independent regulator for the postal sector with the responsibility and powers to regulate postal services. The government does not have a role in Ofcom’s regulatory decisions.
Following market developments, Ofcom are gathering evidence of operator’s compliance levels with their applicable Consumer Protection Conditions.

All employers are required to undertake right to work checks on any prospective employee to confirm their legal status.
Clamping down on illegal working is a critical part of this government’s work to restore fairness, order and control within the immigration and asylum system. This includes measures in the Border Security, Asylum and Immigration Act to ensure companies who utilise flexible worker models, as seen in the warehouse and delivery sector, are required to conduct right to work checks to prevent illegal working when they contract workers to provide services under their company name. This will include agency workers or self-employed individuals working in the gig economy.
These new legislative measures will restrict the ability of employers to take advantage of illegal workers and encourage businesses to provide work opportunities to only those permitted to work in the UK. It will provide parity across industries and will set a level playing field for businesses to uphold their responsibilities to prevent illegal working in the UK.
A consultation on how to implement these measures has been conducted, the response to which will be published in due course.
In addition to the extended right to work scheme, and as already announced, digital right to work checks will be mandatory by the end of Parliament, making them easier and cheaper for businesses to do.

The passing of the Employment Rights Act, and measures such as the creation of the Fair Work Agency, will create an economy that balances flexibility and security. In doing so, we will ensure an environment where working people and businesses can succeed together. We are committed to strengthening rights and protections to help the self-employed thrive in good quality self-employment.
We have already announced a package of measures to tackle late payments for small businesses and the self-employed, including a new Fair Payment Code. Self-employed individuals are not entitled to the minimum wage and Evri couriers are self-employed. As such, no discussions have taken place with Evri specifically on the issue of the minimum wage.
That this House expresses concern at the nation-wide failures by Evri deliveries, which have caused distress and frustration for many, particularly at this time of year; acknowledges the volume of complaints across the country, including incidents where customers’ parcels were dumped with no attempt at delivery; notes that in September this led to a police investigation in Hampshire after the disappearance of 89 parcels; highlights the unacceptable strain that this causes for those struggling with the cost of living and the detrimental effect of Evri’s failures on small businesses, who rely on these services; and urges the Chief Executive of Evri, Martijn de Lange, to commit to investigating the cause of these issues and to reassuring customers of the steps that will be taken to rectify errors and support seasonal demand.

Does the Prime Minister believe that over 40,000 interactions, either by social media, email or letter, regarding the poor customer service and working conditions at the delivery company Evri warrant an investigation by the relevant Government Department? His Ministers in the Department for Business, Energy and Industrial Strategy think not, but I am sure the Prime Minister would want the general public to believe that he at least is interested enough in this problem to take action.
