The South Eastern Direct Award is for a short period of time. As in all other Franchise Agreements, the Franchisee (as the Designated Employer) is responsible for paying employer pension contributions required under the schedule of contributions applicable during their franchise term. The Franchisee and its employees continue to bear all risks associated with changes in pension contributions.

During this period, pay has increased at around the level of the Retail Price Index.
The Secretary of State has made clear that the rail industry should be moving towards using the Consumer Price Index (CPI) as the inflation measure for pay agreements. The pay deals agreed with Southeastern staff during the last 12 months reflect a real terms increase when compared to the CPI and cost of living increases.

Earlier this year the Secretary of State agreed an extension to run until April next year with a further option to include an additional 3 months if required. The award for the next franchise will now be made in the new year.

The Government published its response on the rail fares penalty appeal process consultation in December 2016. The response set out plans to bring forward a new Statutory Instrument which includes provisions requiring that penalty fares appeals bodies should be independent of Train operators and owning companies. The industry has already taken steps towards this objective and the Independent Penalty Fares Appeals Service is currently in the process of winding down consideration of penalty fare appeals.

Staffing levels are a matter for the train operator, as long as they continue to deliver services that meet the requirements of the Franchise Agreement. The 7-period extension announced on 9 June was a priced option in the current Franchise Agreement.
Any existing ticket revenue sharing arrangements continue through the extension. Although preliminary negotiations have taken place with regard to a Direct Award to run services from April 2016, no timetable for formal negotiations is yet in place, and formal negotiations are yet to take place.

On 9 June we signed the 7-period extension to the London Midland contract as permitted in the franchise agreement. This extends the current franchise until April 2016. Although preliminary negotiations have taken place with regard to a Direct Award to run services from April 2016, no timetable for formal negotiations is yet in place. As announced by the Secretary of State, the new franchising programme will provide a more sustainable schedule for rail franchising and the planned competition for the West Midland franchise should see the successful operator providing services from June 2017.

The Operational Research Computerised Allocation of Tickets to Services (ORCATS) is owned by Rail Settlement Plan Ltd, a company administered by the Association of Train Operating Companies and wholly-owned by the train operating
companies collectively. It is one of the means of allocating revenue. Under the Ticketing Settlement Agreement, ORCATS is the default allocation method used in respect of any ticket type and flow. However, it is not mandatory, and train operating companies are free to agree a non-ORCATS allocation in respect of particular ticket types and/or flows if they think that the ORCATS model will not produce a fair estimate of true passenger behaviour.
