It is for individual local authorities to assess a property’s council tax liability, or whether it is compliant with any planning permission, based on the individual circumstances and relevant legislation. It is for the Valuation Office to assess whether a property is a dwelling for council tax purposes, and if so the council tax band of that dwelling.

To ask the Secretary of State for Energy Security and Net Zero, what steps his Department is taking to help support people who live permanently on boats and use red diesel in the context of (a) fuel cost relief and (b) other support schemes.
The Competition and Markets Authority (CMA) have put the industry on notice that they are monitoring fuel prices closely, including red diesel which is one of the fuel types used by people living on boats.
Officials and Ministers are meeting regularly with the CMA to discuss the situation, and will not hesitate to take action if companies are found to have breached consumer protection law.
The planned inflation increase on fuel duty for 2026-27 has been cancelled, and Government stands ready to take any necessary action to ensure that consumers are getting a fair deal.

Certain uses, such as non-propulsion use by private pleasure craft, retained the entitlement access to use red diesel after it was withdrawn from most sectors in 2022. In contrast to full duty diesel, taxed at 52.95 pence per litre (ppl), red diesel currently incurs a duty of 10.18 pence per litre.
At Budget 2025, the Government extended the temporary 5p fuel duty cut alongside extending the proportionate percentage cut for rebated fuels, which includes red diesel. This maintains the red diesel rate at the levels set in March 2022 at 10.18 peppl until the end of August 2026, with rates then gradually returning to March 2022 levels by March 2027, an increase of less than 1 ppl. The planned inflation increase for 2026-27 has also been cancelled.
As the Chancellor has set out, the Government will keep fuel duty under review.

Navigation authorities are responsible for managing operations on their waterways and the Government does not direct that. Boaters are expected to comply with the terms of their licences for the benefit of all waterway users, including any restrictions on mooring. In instances of non-compliance, navigation authorities have enforcement powers. Where a boat is occupied, particularly in cases involving potential vulnerability, navigation authorities seek to work with local authority housing and safeguarding teams to assess welfare concerns and avoid disproportionate outcomes.
There is no specific national guidance on the division of responsibilities between councils and the Environment Agency (EA) for removing boats from unauthorised moorings, as such situations typically involve shared and locally determined responsibilities. The EA engages with local authorities on the potential use of its powers to remove unregistered boats from its waterways. Where a boat is moored without permission on land owned by a local authority, the authority leads on arranging its removal with the EA providing support and coordination where appropriate.

Navigation authorities are not housing authorities. Defra will consider the matters raised in the Association of Inland Navigation Authorities position paper about the residential use of inland waterways, and will engage with the Ministry of Housing, Communities and Local Government on the housing-related and other issues that fall within its policy responsibilities.
