Businesses in flood risk areas should seek out the best insurance quotes available to them and may benefit from using an appropriate broker. There are a range of insurance products available, including the British Insurance Brokers’ Association (BIBA) Commercial Property scheme for small and medium-sized enterprises, and parametric insurance products.

To ask His Majesty's Government what assessment they have made of the adequacy of existing insurance arrangements to cover liabilities arising from the use of autonomous artificial intelligence systems.
Working closely with the Bank of England, the Financial Conduct Authority and other relevant bodies, the Government continues to monitor the opportunities and risks associated with the increasing use of artificial intelligence (AI) technology across the economy.
The Government's current view is that the existing regulatory framework is well placed to manage the evolving risks associated with AI, while supporting innovation and growth. Firms remain responsible for managing the risks arising from their activities, including the use of AI systems, and insurers continue to assess and price risks in accordance with existing legal and regulatory requirements.
The safe adoption of AI by the financial services sector is a major strategic opportunity, with the potential to power growth across the UK. As set out in the government’s Financial Services Growth and Competitiveness Strategy, the ambition is to make the UK ”the world’s most technologically advanced global financial sector”, leveraging the UK’s dual strengths in FS and AI to drive growth, productivity, and so deliver customer benefit.

The availability of insurance is determined on a case-by-case basis by insurers, but the Government engages with the industry on a regular basis through the Flood Resilience Taskforce.

The Government has not made an assessment of the total monetary value of insurance company deductions from business interruption insurance payouts.
The Supreme Court published its final judgment in the FCA’s Business Interruption Insurance test case in 2021. At the time of the judgment, the FCA set out its expectation that insurers should communicate to all impacted policyholders what the judgment meant for their claim and should move quickly to resolve claims as determined by the judgment.
The FCA court case did not cover all potential issues with business interruption policies. The FCA has been clear that, in the event of further court rulings, insurers will need to consider carefully how the rulings impact claims they have already decided.
The FCA is continuing to supervise firms to ensure they are meeting their expectations and has robust powers to take action where necessary.
