The hon. Gentleman knows that the Government inherited a justice system in crisis, with a record and rising caseload. He also knows that the last Government closed courts right across the country. We are legislating for structural reform. We are investing £2.78 billion to bring down the backlog. We will continue to look closely at the needs in Kendal, but he recognises that it will take some time to address what we inherited.

Kendal magistrates court was outrageously closed in 2017, on the promise that sittings would continue in other public buildings in Kendal, yet there has not been a single sitting in Kendal since 2020. The Driver and Vehicle Standards Agency (DVSA) is aware that car practical driving test waiting times remain high and understands the impact this is having on learner drivers.
DVSA is continuing to recruit as many driving examiners (DE) as possible, including at Kendal, Heysham and Barrow in Furness. From a previous recruitment campaign, two potential new DEs, following successful completion of training, will be joining Kendal and Barrow in Furness in late autumn.
Currently DEs from Kendal and Heysham are being deployed to Barrow in Furness to meet testing demand. As part of its current recruitment campaign, DVSA has advertised for DEs for Barrow in Furness. This will enable DVSA to meet local demand in Barrow in Furness and increase test availability in Kendal and Heysham.

The Chancellor set out on 29 July a range of pressures on public spending, including £2.9 billion of unfunded transport specific spending. Following this, the Secretary of State’s Written Ministerial Statement on 30 July set out that the Department is undertaking an internal review of its capital spend portfolio which will support the development of our new long-term strategy for transport. Any decisions about the portfolio will be subject to broader discussions and fiscal decisions made at Budget and Spending Review.

The Kendal Northern Access Route scheme is being promoted by Westmoreland and Furness Council (the Council) for consideration for potential funding as part of the Department’s Major Road Network/ Large Local Majors (MRN/ LLM) programme. It would not form part of the Government's Road Investment Strategy.
The Council are currently developing an Outline Business Case (OBC) for the scheme for submission to the Department for a decision on whether to approve it and provide conditional support for the scheme as part of the MRN/ LLM programme.
The latest scheme cost estimate and completion date provided to the Department are £185.3million and July 2027 respectively. However, my officials understand that the Council is considering the scope of the proposals that will be put forward in the OBC, which is expected to be submitted to the Department this year. Therefore, the cost estimate and completion date may change.

To ask the Secretary of State for Environment, Food and Rural Affairs, what steps his Department is taking to ensure the Environment Agency prevents further sewage overflows from manhole number 4103 in Kendal.
Restoring water quality is a Government priority. We will shortly be setting new legally binding targets for water under the Environment Act to provide a strong mechanism for driving long-term environmental improvements.
This Government is the first to take action to tackle the historic infrastructure issue of sewage overflows, with new duties through the Environment Act on the water industry to reduce the harm they cause. Water company investment in environmental improvements has been scaled up to £7.1 billion over the period 2020-25. Through the next Price Review (PR24) we are using the strategic policy statement to Ofwat, the economic regulator, to make the environment a top priority.
Water companies are required to monitor their processes and emissions, and report these to the Environment Agency (EA). The EA runs this through compliance checks to ensure water companies are meeting permit requirements. Where these checks have highlighted breaches in permit conditions, or where evidence of environmental impact is found, the EA has taken strong action resulting in successful prosecutions, including the recent cases against Southern Water and Thames Water.

To ask the Secretary of State for Environment, Food and Rural Affairs, what estimate his Department has made of the date of completion of (a) flood defence maintenance and (b) future flood defence plans for Kendal as a result of Storm Desmond in 2015-2016.
Flood Defence maintenance for the Westmorland and Lunesdale catchments is completed as an annual rolling program which runs from April through to March. The Environment Agency (EA) is on schedule with the 2018/19 program, which is available to view online here:

The proposed Kendal Flood Risk Management Scheme is planned to be delivered in multiple phases in keeping with the EA’s strategic approach to managing flooding risk within the River Kent catchment. The first phase of linear flood defences through Kendal also includes improvements to the Stock Beck drainage system in the Sandylands area. Subject to the approvals of the business case and necessary permissions, construction is due to start in May 2019 and be complete by March 2021.
The next phase, starting in 2020, is proposed to deliver two flood storage reservoirs on the River Kent upstream of Kendal, which will further increase the standard of protection to properties. These are due for completion in 2022. This is subject to approvals of the business case and necessary planning permissions.
Natural flood risk measures within the catchment are being developed and delivered within the same time period as part of an ongoing programme of works.
NHS England has identified south Cumbria as one of just three places in England where travel times to receive radiotherapy are unacceptably and debilitatingly long. Will the Secretary of State meet me and NHS England to talk about how Kendal hospital can be the place for a new radiotherapy centre this autumn?
